You are misinformed regarding the divorce issue. In the case of divorce the husband and wife must come to a mutual understanding whether they want to separate. If they decide they want to separate they will live apart for 3 months, during that three months if they decide their decision was wrong then they will get back together. If after 3 months they decide they want to divorce, then divorce is successful. Also, husband must honour the decision of the wife respectfully let go of her respectfully.

Highly unlikely, as Sharia law doesnot require medical evidence.....it only requires witnesses.
Since witnesses can be motivated in a number of ways....true justice is unlikely to be served.

Witness does not mean in the sense of persons; what it means is proof. Lets say there is proof of physical violence(1st witness) and there is a medical evidence (2nd witness).

sir in rape cases there is a proper medical check up is done on female patient and the doctor or the medical report is presented as an evidence in Court and sometimes doctor has to appear as medical expert ( it has much credibility in judicial procedure ) in front of court .... the court can not deny the report of a doctor and now there are more advance techniques like DNA finger printing and DNA analysis etc that helps a lot and act as solid evidence

Actually this concept of "rape worse than death", is a male chauvinistic concept.
This concept arise from our desire to have a VIRGIN woman(regardless of what women think)....so it is not actually out of respect for the women.
This chauvinistic approach actually increases the social burden on women, because even if you consider that crimes like rape can be diminished by giving death penalty....but you cannot practically bring it down to 0%.
So, in a society where rape is seen as worse than death, the life of the unfortunate woman getting raped is finished....in such cases...to avoid social stigma, the only option remains in her hand is to SUICIDE.

Therefore, even feminists are usually against such approach on rape.
They prefer to regard it as HUMAN RIGHT VIOLATION.

So, you don't need to be a woman to understand their problem....you just need to be a human being.

when a human being(male/female) abuses another human being(male/female).....It can be rightfully regarded as HUMAN RIGHT VIOLATION and rape can be logically put into this category as it is basically the same(one person abusing the other).

So, like any other human right violation crime, rape can also be controlled by maintaining law and order properly....there is no logical need for any exemplary punishment only in case of rape.

Actually we feel the need of so called "exemplary punishment" when basic law and order system goes haywire and people plagued by crimes become desperate to do something without realising the true culprit.

We can ruin someone's life in quite a number of ways......even to the point that the person has to commit suicide..........what about punishment for those..............

See it like this.........

Every crime happens when people can't controll something or the other.

People commit rape because they can't controll their lust.
Some people steal when they can't control their hunger.....(should they be given death??
(you can also ruin someone's life by stealing....depends on what or how much you are stealing).
Some people kill, when they can't control their anger.(but in this it's not considered as real murder LOL).
Some people loot, when they can't control their greed.

Lust, Hunger, Anger, greed etc are all different biological phenomenon..........


Therefore, as stealing,looting, killing etc are punishable(nomatter why you did it).....rape should also be punishable like that....why should this offence be treated specially!

Every crime is associated with human suffering/ruining someone's life..... so why only rape be "just too much"
