A US grand jury on Friday indicted diplomat Devyani Khobragade on same criminal charges contained in an earlier indictment dismissed by a New York court just the day before.


Khobragade is charged with visa fraud and making false statements that could together get her a maximum of 15 years in jail if she was every tried and convicted.

US attorney Preet Bharara’s office had charged the diplomat with visa fraud and making false statements in connection with the employment of her housekeeper Sangeeta Richard.

Khobragade was arrested on December 12 outside her children’s school in New York, and strip-searched at a holding facility before being produced in a court.

Shocked and outraged, India demanded an apology, removed barriers from outside the US embassy in Delhi and withdrew privileges extended to American diplomats.

Secretary of state John Kerry did express regrets in a call to National Security Adviser Shivshankar Menon. But Bharara’s office pressed ahead with the case.

As deputy consul-general at the Indian consulate, it was argued, she didn’t enjoy full diplomatic immunity from criminal prosecution.

India transferred her to its permanent mission to the UN, whose staff are entitled to diplomatic immunity. Khobragade was granted hers on January 8.

She was indicted the next day, and the US asked her to leave the country when India refused to waive her newly acquired immunity so she could be prosecuted.

Arrest warrant issued against Khobragade in US visa fraud case

An arrest warrant has been issued against Devyani Khobragade as US prosecutors today re-indicted her on visafraud charges and accused the Indian diplomat of "illegally" underpaying and "exploiting" her domestic maid.

In a letter to United States District Judge William Pauley, US Attorney for the Southern District of New York Preet Bharara informed that Khobragade is "believed" to be in India and the court will be alerted if and when she is arrested.

"An arrest warrant was also issued today. The Government will alert the Court immediately upon the defendant's arrest so that an appearance before Your Honor may be scheduled. At present, the defendant is believed to be in India," Bharara said in the letter.

He said the indictment alleges that Khobragade made false statements to US authorities "to facilitate her exploitative employment of a household employee who was grossly underpaid and overworked."

Bharara said Khobragade is unavailable because her "whereabouts are known but (her) presence for trial cannot be obtained by due diligence or (she) resists appearing at or being returned for trial."

The new charges, which came a day after a US court dismissed an earlier indictment, accused her of visa fraud and making false statements about the visa application of her maid Sangeeta Richard.

The 21-page indictment, filed by the office of India-born Bharara, states that the diplomat "knowingly made" multiple false representations and presented false information to US authorities in order to obtain a visa for a personal domestic worker.

If US justice department is bent to play by the book then so shall we ...

what is the staus of tax evasion and visa violation probes related to spouses of diplomats working in american schools ???

India should take firm stand on this issue and pursue all such cases .

but do we have guts to do that ?

I guess we will have to wait till next government is in place ...

Current government is lame duck and election bound . I doubt if it can have appetite to take US head on ...

It really doesn't matter now as she is back in India. She just cannot come back to the US.
