NEW YORK: US is proceeding with the prosecution of senior Indian diplomatDevyani Khobragade and has no intention to withdraw the case of visa fraud against her.

US sources here said today that more evidence was being gathered against the 39-year-old diplomat before the indictment is filed. The deadline for indictment is January 13.

There is no question of apology to India over the arrest of Khobragade, the then deputy consul general of India, in New York on December 12 which has led to strong protests by the Indian government and widespread indignation in India.

The Indian government has demanded withdrawal of the case and an apology for the treatment meted out to the diplomat.
The sources said that the US government intended to proceed with the prosecution of Khobragade. The indictment will be brought, they emphasised.

They said that everything with regard to the Indian diplomat had been done by the book and that there was no nefarious motive.

The sources replied in the negative when asked if Khobragade, who has been transferred from the Indian Consulate to the country's mission to the UN subsequent to her arrest, enjoyed full diplomatic immunity at present.

They conceded, though, that if she gets UN immunity the diplomat cannot be prosecuted or brought to court for the period of the immunity. The case will be in "suspension" but will not be dismissed, they said.

After getting the UN immunity if she went back to India and then again comes on a visit to the US, she could face arrest since the charges would stand, the sources added.

That would be different. You are actually charge someone outside of their role as a diplomat. But this would create problems with the country of origin as each country can define their own human rights law.

The best solution with diplomatic immunity is complete immunity. If you don't want to provide it to others, let the other country know and its up to their choice to station diplomat in your own territory.
But the ambassador and his family must have complete diplomatic immunity.

Irrlevant. You most defenitely can't expect the justice department to withdraw case. But with full immunity they can't do jack.

Its time for India to retain the best lawyer for this diplomat. Otherwise, she might go to jail.

America cant touch that diplomat.She has full diplomatic immunity.
 
Well the biggest problem is that this diplomat did not even have immunity, and moving her to UN can't apply that immunity retrospectively, either. She broke the law in the US while she did not have immunity, and she will face prosecution just like any suspected criminals.

she has full diplomatic immunity .But i like this part.From now on India will maintain certain distance from US.That sure.

There is many ways out this situation like planting class A drugs on some yanks backpacking India and throwing them in jail (max sentence for class a drugs is death penalty) this can be used to blackmail the yanks at their own dirty games.

If she has full immunity, the DA would not have arrested and charge her. You have trouble handling the truth that your diplomat has no immunity and she is being charged. And India better get the best lawyer for this upcoming trial.

Did not know that. Did she have diplomatic immunity when the case was filed against her? Asking because some people call her a diplomat and the US isnt treating this as a high profile case.
