A Muslim woman who was gang raped in India has said her attackers asked her whether she ate beef in what some suspect was another crime by Hindu vigilante groups.

The 20-year-old and her 14-year-old cousin were attacked by a group of men who trespassed into their home in Mewat, Haryana, and murdered their uncle and aunt before sexually assaulting the female victims two weeks ago.

Local police originally arrested four men for trespass and sexual assault, but after protests from the local community the men were charged with murder.
Now the older victim has said the men asked the victims whether they ate beef before insisting they did and proceeding to attack them.

She told NDTV: “They asked if we eat beef. We said we don't, but they insisted we did.
"Then they said we're hurting you before so you don't and that if we tell anyone we'll will be insulted."
Senior police officers have so far reportedly said the men had no link to so-called "cow vigilante groups".
But the Muslim community has expressed fears about a rise in attacks by Hindu groups.

NEW DELHI: Indian police Friday arrested five men for “animal cruelty” after they were caught skinning a buffalo and beaten on suspicion of killing a cow, an animal considered sacred by Hindus.

The mob bashing in Uttar Pradesh state is just the latest such attack by Hindu vigilantes in India, where there has been a spate of assaults and murders in recent months of accused cow killers.

Police said a Hindu mob raided a dairy farm in Aligrah where they found five low-caste men skinning a buffalo, an animal not considered sacred and whose slaughter is legal at permitted abattoirs.

The men claimed the animal had died of natural causes and the dairy owner had requested they remove the hide, but the mob alleged it was a cow they had slaughtered and set upon them.

Local police chief Rajesh Kumar Pandey said an investigation would determine how the buffalo died, and the skinners would be held for questioning.

“They have been arrested on charges of animal cruelty, and further charges will depend on the outcome of the autopsy report,” Pandey told AFP.

None of the attackers — all high-caste Hindus — had been arrested as police had not received a formal complaint from the victims, he added.

Footage of the incident aired by local broadcasters showed the attackers punching and kicking a man while he was being taken away by police.

The five men were Dalits, whose status at the bottom of the Hindu caste system designates them to skinning cows, a major source of hides for India’s booming leatherwork industry.

Last year four Dalits were stripped and beaten in Gujarat state by Hindu vigilantes for skinning a dead cow. The low-caste community refused to clear carcasses from the streets for months in protest.

Cow slaughter, and the possession or consumption of beef, is prohibited in most Indian states, with some carrying life imprisonment for infringements.

Buffalo is widely consumed in India, particularly by Muslims and Dalits, and India is the world’s leading exporter of buffalo meat, known as carabeef.

But the Muslim-dominated slaughter industry has long been viewed with suspicion by Hindu hardliners, who suspect cows are killed in secret.

There was a crackdown on the slaughter industry in India’s main meat producing state of Uttar Pradesh after Prime Minister Narendra Modi’s right-wing party won power there in March.

Violence against Muslims and Dalits accused of killing the holy beasts has spiked in recent months.

Two Muslims were beaten to death this week on suspicion of stealing cows while another was killed by vigilantes for transporting dairy cattle by road last month.

According to the Human Rights Watch [HRW], Indian authorities should prosecute so called “cow vigilantes”.

HRW expressed concern, on Thursday, stating that authorities blame the victims rather than “cow protectors” who attack targets and even kill them in some cases. In a statement, HRW said that “the police, too often, have filed complaints against the assault victims, their relatives, and associates under laws banning cow slaughter.”

According to the HRW, these attacks are generally aimed at Muslims, who have no religious restriction on eating beef, and Dalits. At least 10 Muslims have been killed by cow vigilantes in seven incidents since May 2015, one which included a 12-year-old boy. It also stated that, often, the victims are robbed of cash and cell phones.

HRW cited specific cases including a mob attack last week, in which five members of a cattle-herding family were attacked on the suspicion that they were going to take their cows to slaughter them. An online video showed the mob attacking an elderly man and setting fire to the family’s shelter.

HRW’s South Asia Director, Meenakshi Ganguly, said that “self-appointed ‘cow protectors’ driven by irresponsible populism are killing people and terrorising minority communities. The government should condemn this violence and take prompt action against those responsible for these attacks or face allegations of complicity.”

In another case, four Dalit men were beaten, stripped and tied to a car in July 2016. HRW also took note of the fact that many vigilantes are linked to extremist Hindu groups affiliated with the ruling Bharatiya Janata Party [BJP] and last week’s attackers were associated with the party since they were chanting slogans supportive of BJP.

The organisation took note that Prime Minister Narendra Modi had called for protection of the cows during the national election in 2014 as well as during his time as Chief Minister of Gujarat.

New restrictions on cattle slaughter in India

Indian government has banned the sale of cattle for slaughter at animal markets across the country.
Under a notification, titled the Prevention of Cruelty to Animals (Regulation of Livestock Markets) Rules, 2017, those who wish to sell cattle — bulls, cows, buffaloes, steers, heifers and camels — may do so only after they formally state that the animals have not been “brought to the market for sale for slaughter”.

At the same time, buyers of cattle at animal markets will have to verify they are agriculturalists and declare that they will not sell the animal/s for a period of six months from the date of purchase.
The rules, notified by the Ministry of Environment, Forest and Climate Change on May 23, demand that buyers “follow the State cattle protection and preservation laws” and “not sacrifice the animal for any religious purpose”. They also prohibit cattle purchased from animal markets being sold outside the State, without permission.

Monitoring committees at the State and district levels will be set up to implement the rules and monitor the functioning of animal markets. Such markets will be identified and registered; any new market that is set up will need the approval of the District Animal Market Monitoring Committee, which will be chaired by the Collector or District Magistrate.
To inhibit smuggling, animal markets may not function within 25 kilometres of a State border and 50 kilometres of an international border.

The new rules banning the sale and purchase of cattle from animal markets for slaughter aim at regulating such markets and also the sale of bovines, Environment Minister Harsh Vardhan said on Friday.
Noting that the rules are very “specific”, the Minister said that sellers and buyers have to ensure that cattle are not bought or sold in the markets for slaughter purpose and an undertaking to this effect has to obtained.

The notification drew the strongest response from Kerala, where Chief Minister Pinarayi Vijayan declared it was part of a plan to further the RSS agenda. He said in a statement that the Centre’s action was contrary to diversity, which is the core of Indian democracy. All major parties in the State, barring the BJP, were critical of the decision with the Congress Leader of the Opposition Ramesh Chennithala describing the notification as a threat to human rights.

While individuals have not been prevented from selling cattle for slaughter, representatives from the meat and livestock industry have expressed serious concern about the impact of the notification. D.B. Sabharwal, secretary general, All India Meat and Livestock Exporters Association, said representatives from the industry have asked for a meeting with Central government ministers and senior officials including in the Ministry of Environment, Forest and Climate Change to inform them about the adverse impact on industry, employment as well as the export sector.

He said that 90% of buffaloes are sourced from mandis by middlemen for sale in slaughterhouses against a mere 10% that is bought directly from farmers. He added while the Centre is empowered to frame rules, implementation of the regulation of livestock falls under the State government’s ambit.
Sources said that Harsha Vardhan, who recently took charge as the new Minister of Environment, Forest and Climate Change, is likely to meet the industry representatives soon.

The notification banning the sale of cattle for slaughter at animal markets under the Prevention of Cruelty to Animals (Regulation of Livestock Markets) Rules, 2017, issued on Friday follows a Supreme Court directive to the government to form an inter-ministerial committee to recommend ways of preventing cattle smuggling.

“The balance and harmony of all faiths, this court is bound to it. Your petition makes generalised statements on a very, very sensitive matter.. We have to close our eyes to centuries and centuries old traditions,” Chief Justice of India (as he was then) H.L. Dattu orally observed in court to a petition filed by a journalist, Varaaki, in September 2015.

The petition had contended that “faith, religion, customs and practices should not take precedence over lawful rights, human or animal. This being true for all religious communities, whether it be Durga pooja, the slaughter of lambs for Easter, turkeys for Thanksgiving or goats for Bakri-Eid.”
In April 2017, the apex court had asked the Centre to extend to India-Bangladesh border areas its rules framed to counter the smuggling of cattle to territories in Nepal.

Legal precedents also show that the court had differed on the question whether beef was a “poor man’s diet”.

In yet another case of mob justice by self-appointed 'gau rakshaks' a group of more than 20 people raided the parcel van of the Kochuveli-Guwahati Express in Bhubaneswar railway station alleging cattle smuggling.

The vigilantes attacked the loco pilot train and his assistant along with two persons who were legally transporting 20 milch cows.

The cows, owned by a Noida based agro company where being transported from their farm in Salem, Tamil Nadu to Ampati, Meghalaya, following an order received from the state government.

When the train reached Bhubaneswar railway station on Wednesday night, some 25 vigilantes who claimed to be members of Bajarang Dal barged into the train and attacked the caretakers.

"Without asking anything, the youths started beating me black and blue. They even manhandled a passenger and two railway staff before unloading all the 20 cows from the train," Umesh Singh , one of the caretakers said.

The Meghalaya government also confirmed that the cow which was being transported were ordered by the state.

"Our chief minister has launched a dairy mission to help farmers with milch cows. We have selected three companies through an e-tender process. Vertex Agro Private Limited is a big firm among them. It was sending us with the 20 cows from Salem," Dr B Rijal, director, Directorate of Animal Husbandry and Veterinary of Meghalaya said.

The cattle were later shifted to a cow shelter in the city. The Government Railway Police have registered a complaint against the Gau Rakshaks, but no arrests have been made in the case.
