'Sikhs are not Hindus’ campaign finds support in Pak

I've never ever blamed Hindus for Attack on Golden Temple, Terrorism in Punjab or 84 Genocide etc... I've always defended India on this very forum. In return, was given a Certificate of Traitor, Khalistani Support and should leave India etc...

If I can defend India, I do have right to crticse what I believe is wrong. If this makes, me traitor, Khalistani Terrorist etc. I'm happy to wear such badge with Honour as I'm clear about my consensus.

By the way, the Article 25B is same as the clause you are referring too. India and Pakistan both are same on this page. If there community would get support from anywhere, they'll accept it, like I am. This is my POV.

welcome to so called anti-national camp :toast_sign:

Plz ignore these so called "NATIONALIST" ..........and just troll them with non-sense posts ............as they dont have sense:bunny::bunny:

The Constitution of India has labeled Sikhs as Hindus. Sikh's are not Hindus. Period. It's the legitimate demand of Sikh's in India and not of 2 Lakh People.
You may read the Article 25 B from the lenses of Neutral Perspective, you'll find their is no misunderstanding among Sikhs, it's other way around. :)

Madam, it has not.

Here is complete Art 25

25. Freedom of conscience and free profession, practice and propagation of religion

(1) Subject to public order, morality and health and to the other provisions of this Part, all persons are equally entitled to freedom of conscience and the right freely to profess, practise and propagate religion

(2) Nothing in this article shall affect the operation of any existing law or prevent the State from making any law

(a) regulating or restricting any economic, financial, political or other secular activity which may be associated with religious practice;

(b) providing for social welfare and reform or the throwing open of Hindu religious institutions of a public character to all classes and sections of Hindus

Explanation I The wearing and carrying of kirpans shall be deemed to be included in the profession of the Sikh religion

Explanation II In sub clause (b) of clause reference to Hindus shall be construed as including a reference to persons professing the Sikh, Jaina or Buddhist religion, and the reference to Hindu religious institutions shall be construed accordingly

Now Explanation I here

Explanation I The wearing and carrying of kirpans shall be deemed to be included in the profession of the Sikh religion

The use of word Sikh religion clearly indicate that it differentiate Sikh Religion from other, including Hindu, religions.

Article 25, instead of declaring Sikhs as Hindus as construed by many, does the opposite. It declares Sikhism as an independent religion.

Now Explaination II here

Explanation II In sub clause (b) of clause reference to Hindus shall be construed as including a reference to persons professing the Sikh, Jaina or Buddhist religion, and the reference to Hindu religious institutions shall be construed accordingly

Here analyse this statement.

In sub clause (b) of clause reference to Hindus

This means that for only in case of interpretation of sub clause (b) of Art 25

Hindus shall be construed as including a reference to persons professing the Sikh, Jaina or Buddhist religion,

Sikhs, Jains, and Buddhist religion would be considered legally equivalent to Hinduism.

Now some point to note:

1Art 25(2)(B) does not declare Sikhs to be part of Hinduism. It only declares that Sikhs , for certain legal matters would have same laws as Hindus, Buddhist, and Jains. Instead, the naming of these three groups as religions in same sentence in which Hinduism is mentioned highlights their being different from Hinduism.

If there is a court case to decide whether Sikhs are Hindus or not, the side advocating that Sikhs are not Hindus would be using Art 25 to demonstrate their case, not otherwise.

It is a matter of acceptance of distinct identity of a religion. Article 25 (b) of the Constitution just deprives the Sikhs of their legitimate rights. It clubs Sikhs with Hindus. Hindu marriage act considers Sikhs & Buddhists to be at par with Hindus. We have different marriage acts for Muslims & Hindus but not for Sikhs.

Sikhs had a separate marriage act called Anand marriage act, and it has been separate from Hindu marriage act since 2012.

In 2012,India Passed The Anand Marriage (Amendment) Bill, 2012,Sikhs will be able to register their marriages under the Anand Marriage Act instead of the Hindu Marriage Act

AMRITSAR: Following an appeal from Akal Takht, the supreme temporal seat of Sikhs, the community in Pakistan has also supported amendment of Section 25(B) of Indian Constitution and started "Sikhs are not Hindus" signature campaign at Nankana Sahib.

Two Sikh organizations in Nankana Sahib, birthplace of Guru Nanak Dev, Sikh Resource and Study Centre (SRSC) and Young Sikh Panthers have also started the online signature campaign.

Director of SRSC Gurmeet Singh told TOI over phone from Nankana Sahib on Thursday that though the amendment was to be made in the Indian Constitution, "being a Sikh I feel that we should support the cause for the distinct identity of Sikhs". He said his organization has also started the campaign on social networking sites.

Earlier, one lakh signatures have been obtained during the three-day camp held at Amritsar by All India Sikh Students Federation (Peermohammad) faction in support of the petition which was started ahead of US president Barrack Obama's scheduled visit to India on January 26.

President of recently constituted Young Sikh Panthers Dilawar Singh said they had begun the camp at Nankana Sahib and would also hold similar camps at various gurdwaras. "This is our contribution for the cause of Sikh identity". However, he said Sikhs and Hindus had always lived in perfect harmony but when Sikhs' identity was in danger then they had to begin the campaign.

On the issue of Nanakshahi Calendar (NC), both the organizations supported implementation of Canada-based Sikh intellectual Pal Singh Purewal-authored calendar. "We are following Akal Takht approved NC which was implemented in 2003 but we have rejected the amendments made in NC in 2010. These amendments were made under political pressure and not as per the aspirations of Sikhs," said the SRSC director.

Of course they are not Hindus....But simply Sikhs and Hindus have religious acceptance to each other...

Is there any such petition type of thing, where Sunnis or the Shia demand such recognition?

Sikhs, Jains, and Buddhist religion would be considered legally equivalent to Hinduism.
You are interpreting it wrong. The line is Hindus shall be construed as including a reference to persons professing the Sikh, Jaina or Buddhist religion,
It means Hindus should be considered including persons professing the Sikh, Jaina or Buddhist religion,
That is why there is no mention of Islam in this list.
