KOCHI: The Kerala high court has stated that just because one person is a Maoist he can't be called a criminal. Also, one can't be taken into custody for the reason that he is a Maoist.
Justice AM Muhammed Mushtaq said that a Maoist can be arrested and put behind the bars only if he or she indulges in unlawful or anti-national activities.
The court was hearing a petition filed by Shyam Balakrishnan of Wayanad stating that he was arrested and harassed by the Thunderbolt team alleging Maoist links.
The court also ordered a compensation of Rs 1 lakh for the petitioner.
