Pakistan court overturns convictions of those imprisoned for Daniel Pearl murder

I wonder why govt isn't doing anything about this judiciary? I get it that current govt doesn't have clear two third majority and might not want to go into an open conflict with judiciary. But my question is, can't we move a bill or make any constitutional amendment to bring judiciary in line? I'm sick and tired of this pathetic state of affairs when it comes to Pakistan judiciary in particular.

Whilst everyone calls this shameless, I think we have to remember exactly how the US protected Raymond Allen Davis after his rampage.

After they did that, I don't think they can complain when we do this to the people who killed one of their citizens.

Except that this guy is a militant and an extremist. Nothing good comes out of releasing a guy like this.

ISLAMABAD, Pakistan — A regional Pakistani court on Thursday overturned the convictions of the men involved in the killing of U.S. journalist Daniel Pearl in 2002.

The ruling by two judges on the High Court of Sindh province can still be appealed to Pakistan’s Supreme Court.

“As per the court’s judgment, Omar Saeed Sheikh has been found guilty of kidnapping and not of murder. The accused was in jail for 20 years,” the defendants’ lawyer Khawaja Naveed told The Washington Post.

Saeed had been sentenced to death for Pearl’s murder, but now with just a seven-year sentence for kidnapping, he could be released, given the 18 years he has already served.


The three other men convicted with Saeed — Fahad Naseem, a computer expert; Salman Saqib, a religious activist; and Sheikh Adil, a police officer — were ordered released by the court.

The kidnapping and murder of Wall Street Journal reporter Pearl in January 2002 shocked the world at the time. He had been in Pakistan researching the connection between a radical Islamic preacher and Richard Reid, who attempted to blow up an airliner with explosives in his shoes.

Pearl was told he was meeting with the radical cleric when instead he was kidnapped by militants organized by Saeed, a British-born Pakistani. According to the Center of Public Integrity’s Pearl Project, 9/11 mastermind Khalid Sheikh Mohammed then took over the operation and filmed the beheading of Pearl for al-Qaeda propaganda purposes.


The murder has been seen as the beginning of a trend targeting journalists in conflict zones.

In 2014, the radical Islamic State group filmed the beheadings of a number of its hostages, including journalist James Foley.

Well...If relevant authorities do not provide enough evidence to sentence the killer, then the court can not do much...So the responsibility to convict the killer is more on the securuty appartus of Pakistan than courts here..

As per many liberals in case a bearded man is convicted then he should get swear punishment or in plain words should be hanged. But in case of Kalbushan or Abhinandan they should be released for sake of peace and justice. Daniel Pearl himself was under suspicion to be CIA agent. However our country is open for every enemy of the country to enter here get whatever propaganda material and then defame our beloved country/religion. There are numerous people who were debriefed by foreign agencies with the free will of Govt.
We are beggars and have no self respect when it comes to Daniel Pearl we are ready to defame our courts and even demand shamelessly to hang a person for crime in which he was not involved. But we are too afraid to demand Daniel Pearl's background or Raymond who himself spying in our beloved country yet forcefully the victims families were given blood money. Many of so called Islamic terrorists were once USA's beloved and honored persons.
It is a social issue that USA and UK especially should check why well educated Muslims are turning against their own countries.
The people running Anti Islamic sites/Pages or blogs with clear evidence of funding from West are free to plunder the countries ideology and our liberals or let me say so called people with Muslim names shall fully support them.

See...there is a difference between Kulbusan and these criminals....When you are putting Kulbusna in jain, you can punish him as per your will. Except India, no one really cares as this issue is between India and Pakistan..

But in this case, if you release an alleged criminal, then the impression will be created as if you are on side with the killer of the Western Journalist...Now, what will be the value add for Pakistan by creating an impression in global media where your country failed to penalize a high profile criminal...

In this age, truth is an illusion...Global media perceive and create perception based on their interest...So each country manages its policy to avoid providing any material that will create any -ve perception about their country...So, now, with this case, Pakistan allowed a space to be exploited by others where all the alleged high profile terrorists by the global body are not getting punished by Pakistan...

I don't know what happened in that case but atill the point remains. This is from Peshawar high court:


the guilty must be punished to the extent of law and in this case be made an example. However Iam not familiar with the case but there are varying factors which might have come into action.

Could be, the complainant nominated all male members of the accused's family maliciously ? Which is a usual public practice so the other party suffers along with the family, in some cases the females are specially targeted just to send them behind bars for no matter how lil the jail time could get. Taskeen rooh!

The culprit getting benefit of the doubt along with others when prosecution failed to prove the prima facie motive behind the said occurrence even of those involved besides the main accused? but he still faces the trail

The judge is corrupt ? But then which state institute don't have bad apples?

A few years ago it was claimed that Khalid Shaikh Muhammad, who is in US custody, was the one who beheaded Daniel Pearl. This from an investigation by Georgetown University. You can look it up and learn more about it. My details may be hazy.

No we aren't! Atleast I don't not want to be associated with these shameless coconuts running isb. If I were to be a country, there citizenship would have been revoked and a pan shoved in their hands to beg for the rest of their miserable lives. May be this way they could buy food from their own pockets?

The court found there was sufficient evidence to convict Ahmed Omar Sheikh of abducting Mr. Pearl, a Wall Street Journal reporter, but not of killing him.

A two-member bench of the Sindh High Court in Karachi, headed by Justice Mohammad Karim Khan Agha, found that there had been sufficient evidence to convict Mr. Sheikh of kidnapping, but not of murder, said Mr. Sheikh’s lawyer, Khawaja Naveed Ahmed. “The court ruled that the charge of abduction was proven,” he said.

The court reduced Mr. Sheikh’s sentence to seven years. Because he has been imprisoned for 18 years, he was expected to go free along with Fahad Saleem, Syed Salman Saqib and Sheikh Muhammad Adil, the three other men whose convictions were overturned, Mr. Ahmed said.


American officials have said that they believed Khalid Shaikh Mohammed, the accused mastermind of the attacks of Sept. 11, 2001, had personally carried out Mr. Pearl’s murder.

While the Pakistani authorities arrested and identified several people in the abduction and killing, their court cases saw acquittals or long delays. At least two people allegedly involved in the murder plot were killed in police shootouts.

Just because the US acted disgracefully in the Raymond Davis case does not mean we need to do the same.

It does, otherwise they will feel as if they can do whatever they want without consequence.

Except that this guy is a militant and an extremist. Nothing good comes out of releasing a guy like this.

The security problem these people pose is the only thing about this that concerns me.

SO WHAT?........The americans released Raymond Davis after he murdered a Pakistani citizen. So screw them.

Its unfortunate what happened with the journalist but you under no circumstances can keep a guy in jail for a crime he didn't commit. 20 years spent for abducting are an over kill but if our elite feels obligated to kiss up to the white Christians then yeah he deserved more than what the law had to offer.
LOL! You Pakistanis... He is a hardcore terrorist. Not just some ragtag kidnapper and this guy was in an Indian prison for kidnapping three foreigners for release of some terrorists, although busted and imprisoned, but was released along with two Pakistani terrorists, Masood Azhar and Mushtaq Ahmed in exchange for the Hijacked IC 814 plane. And all terrorists escaped to Pakistan, Masood Azhar took a different career path and went on to become a Global Terrorist.

These two were involved in Kidnap and the beheading of Daniel Pearl. The timing is important, this guy was probably an ISI asset given he was arrested and "let go" by you know, but the police released his confession statements, he then surrendered to Former ISI guy Brig Ejaz Ahmed who is now your Interior Minister.
Conveniently now acquitted.

And Daniel Pearl was not a white Christian, he was an American Jew. The Pakistani terrorists who beheaded him were flaunting that on cam holding his severed head.

As per reports they overturn the decision. What was the initial decision and why these kangaroo courts overturned the decision? Any terrorist pakistan capture is released by kangaroo courts. Which law do they cite?

Suppose you are a judge and I being the lea chief present a guy in your court booked under Terror charges, would you just hand him a capital punishment to please me or after going through the evidence and witesses's testimonies ?

Which law do they cite?

Depending on the nature of offence committed, Pakistan penal code, at act, code of criminal procedure

Now if he was a white guy in a white or brown society he could right away sue the state for keeping him in jail more than what is prescribed by the law.
