On Monday, lawyers in Islamabad violently protested the demolition of their chambers by the Capital Development Authority (CDA) at the Islamabad judicial complex.

A mob of lawyers smashed windows in the Chief Justice block, chanting slogans outside the IHC Chief Justice's office. The CDA had on Sunday night demolished illegal chambers set up by lawyers in the premises of the district and sessions court in Islamabad.

Sources say the Special Security Unit was not present when the lawyers started their protest. Officers from the Islamabad police arrived at the scene after a long time, the sources said.

IHC CJ Athar Minallah was reportedly forced to confine himself to his chamber as the violence unfolded. The protesting lawyers chanted slogans against the IHC CJ, while journalists and several protesters clashed when the journalists tried to record footage of the hooliganism on display.

The entrances to the IHC have since been closed since 10am, the sources said, adding that lawyers and clerks have been barred from entering, and the service road leading to the court premises has been closed.

Justice Mohsin Akhtar Kyani had offered the lawyers to sit in the bar room, saying their problems will not be solved till they were willing to sit and talk.

He had asked the protesting lawyers to remove their colleagues from the chamber of the IHC CJ so they could talk.
If the lawyers feel they have been abused, they should sit down and tell us, he said.

ISLAMABAD: Police on Monday booked the lawyers who stormed the Islamabad High Court (IHC) building and vandalised the property there in response to the Capital Development Authority's (CDA) action against illegal structures.

A press release from the high court announced that FIRs have been registered against all the lawyers involved in the violence, adding that police are conducting raids to apprehend those involved in the incident.

Twenty-one lawyers have been booked by police for being involved in the protest and separate contempt of court proceedings will be initiated against those found guilty of the offence, read the high court's press release.

The IHC stated that it had sent a reference to the Islamabad Bar Council to suspend the licenses of the lawyers who were involved in the protest.

IHC deserved this. Tbh lawyers are known for vandalism and anarchy. They have done this countless time. Attacking doctors blocking roads and threatening police at police station and the list will go on. The thing is every dept have black sheeps but incident regarded lawyers same to lie at exact same category. They think they are bigger than the law and they have hence proven once more that they are right. Let see what do the high court judges do.?
I heard something very shocking (I don't know if it's true or not but really hopes that it's false) that Pakistan judiciary system ranks at 120 place out of 128.

Lawyers attacking the courts is literally an attack on the rule of law. If they are angry about their offices being deemed illegal constructed, they should put forward their case and argue the merits. They are suppose to be lawyers.

I read they are being charged with terrorism, which seems like a stretch. Charging them with rioting, destruction of government property, and going against their oath to uphold the law, should be more than enough, no need to throw the book at them, otherwise the nuances will be lost when actual terrorism cases are brought before the court.

conviction on these charges, should carry the penalty of jail time, having to pay restitution for the damages they have caused, and lose of their license to practice law. If they know that those are the consequences, next time, any other “lawyer” will know what will befall them for similar behavior. Let this incident be case law for all lawyers to study.

LAHORE: The Punjab Bar Council (PbBC) and Lahore High Court Bar Association (LHCBA) on Tuesday expressed support for the stance of Islamabad’s lawyers protesting against the demolition of their chambers by the capital administration.

In separate statements issued on behalf of PbBC vice chairman Sardar Abdul Basit, LHCBA president Tahir Nasaraullah Warraich and other office-bearers, the two bodies said the chambers of the lawyers bulldozed in Islamabad had been built five years ago. They demanded the government reconstruct the demolished chambers of the lawyers and take action against the officials of the Capital Development Authority (CDA) involved in the ‘illegal’ operation.

They also demanded withdrawal of the FIRs registered against the lawyers and transfer of Islamabad’s deputy commissioner Hamza Shafqaat. The lawyers also announced plans to hold protests across the province if their demands were not met.

According to the security official in charge at the IHC, Inspector Mohammad Hayat lodged the FIR under Pakistan Penal Code and Anti-terrorism Act with the Ramna police station, nominating Tassaduq Hussain, Shehla Khan, Hammad, Umar Siyyam, Ahsan Majeed, Khalid Mehmood, Shaista Tabassum, Yasir Khan, Naheed advocate, Tashfeen, Raja Farrukh, Naseer Kiyani, Arbab Ayub Gujjar, Raja Zahid, Nusrat Perveen, Liaquat Manzoor, Naveed Malik, Asif Gujjar and others for storming into the IHC, damaging property and injuring officials on duty.

Earlier, the Supreme Court Bar Association (SCBA) condemned the demolition of lawyers’ chambers by CDA’s enforcement wing. “The events that led to today’s incident were very regrettable and necessitate for thorough probe and investigation as such; SCBAP hereby demands a high-powered Judicial Commission constituted by Honourable Chief Justice of Supreme Court of Pakistan so that those found responsible must be brought to book quickly,” the SCBA said.

Also, the Islamabad High Court Bar Association and the District Bar Association, in a joint statement, regretted the closure of courts and requested the Supreme Court chief justice to hold a judicial inquiry into the matter.

It was late Sunday night when the district administration, Capital Development Authority (CDA) as well as local police had launched an anti-encroachment operation in the surroundings of the district courts in Islamabad’s Sector F-8.

Dozens of illegally-constructed offices of the lawyers were demolished and around 10 lawyers were taken into custody for putting up resistance against the drive. In response to the operation, some 400 lawyers gathered in the district courts on Monday morning.

Later they left for the Islamabad High Court in a convoy of 100 cars, reaching the court without any hindrance. The lawyers stormed into the chamber of the IHC chief justice and damaged the property.

They broke windows with flower pots and also abused the judges.

The protesters manhandled the staff and even beat up the superintendent of police deployed at the Chief Justice Block. They forcibly stopped media from covering the unruly protest and also manhandled some journalists.

Chief Justice Athar Minallah as well as other IHC judges tried to calm them down but to no avail, as the protesters continued the siege of the Chief Justice Block until the Rangers as well as police reinforcement took control of the premises.

The elected lawyers’ representatives held a session with the judges and tabled a charter of demands to end the standoff.

According to the demands, they sought reconstruction of the demolished chambers on state’s expense, removal of deputy commissioner and release of lawyers detained in the overnight operation. They also wanted the chief justice to announce acceptance of the demands before the lawyers in the bar room.

ISLAMABAD: The Islamabad High Court (IHC) on Wednesday summoned 17 lawyers on Feb 18 in contempt of court case.

The lawyers were accused of storming the Chief Justice Block on Feb 8 and holding the chief justice and other judges hostage for four hours.

IHC judicial registrar office issued the show cause notices to the lawyers including the Islamabad Bar Council member Naseer Kayani, Raja Zahid, Tasadduq Hanif, Yasmin Sindhu, Ahsan Majeed Gujjar, Arbab Ayub Gujjar, Faisal Jadoon, Farzana Mughal, Hamad Dar, Nazia Abbasi, Shaista Tabassum, Kulsoom Rafique, Kamran Yousafzai, Hafiz Malik Mazhar Javed, Khalid Mehmood, Raja Amjad and Raja Farrukh.

The show-cause notice accused the lawyers that they were “part of a mob/crowd consisting of a handful of enrolled advocates which left the district courts at about 9am on Feb 8, 2021 with the intent to storm the Islamabad High Court, intimidate the Hon’ble Judges and thus bringing disrespect and disrepute to this court”.

It accused them of forcibly breaking the main door of the Chief Justice Block and attacking the uniformed police personnel.

It alleged that the attackers “resorted to vandalising the court premises, rowdyism with the intent to intimidate the chief justice”.

As per the show-cause notice the mob “held the chief justice and other judges as hostages and forced the judicial proceedings to remain suspended for four hours” which deprived the litigants of justice.

As per the notice, the above mentioned lawyers have “committed contempt of this court” and are liable to punishment under Article 204 of the Constitution read with Sections 3 and 4 of the Contempt of Court Ordinance 2003.

The lawyers were directed to submit explanation within seven days and appear in person on Feb 18.
The lawyers were among those 400 who stormed the IHC building on Feb 8, injured the IHC’s staff, besides they also damaged the furniture and smashed the window of the Chief Justice Block.

Police have registered an FIR against 21 lawyers under various sections of the Pakistan Penal Code and Anti-Terrorism Act.

The IHC on Wednesday also issued contempt of court notices to 12 more lawyers including Akhtar Hussain, Asad Ullah Khan, Khalid Mehmood Khan, Asif Gujjar, Rustam Malik, Shoaib Chaudhry, Mohammad Umer, Naveed Hayat Malik, Nusrat Parveen, Saiful Islam Sindhu, Shela Shan Abbasi and Zafar Khokhar.

Meanwhile, IHC Chief Justice Athar Minallah during hearing of a case remarked that only 5pc of the lawyers attacked the High Court. He remarked that it is embarrassment for those 90 lawyers who laid their lives for the rule of law.

Justice Minallah said that he had asked the police to stay away when the attackers stormed the Chief Justice Block and stayed there as hostage for three hours.

He said that during seven years of his judicial career he never supported any illegal act nor would he support such an act in future.

ISLAMABAD: Islamabad High Court (IHC) Chief Justice Thursday observed that he was surprised to see Hammad Saeed Dar Advocate among the group of violent lawyers who had attacked the IHC.

He said Hammad Dar was very aggressive among the lawyers' mob. It was the IHC which had given relief to Dar when he was kidnapped on January 2, he added.

Chief Justice Minallah said it did not matter if 200 out of 6,000 lawyers were involved in the violent incident, which had disgraced the whole fraternity.

He expressed these views while hearing the case regarding the disappearance of Hammad Dar Advocate.
The petitioner’s lawyer, Abdul Rafay Advocate, said it was an unfortunate incident.

It may be mentioned that Hammad Dar’s father Sufian Dar had approached the IHC when his son was disappeared on January 2. Dar was recovered on January 4, on the directives of IHC.
