Section 154 says that whatever is told to police officer he should record it in first information report aka FIR.

154 states

  • Information in cognizable cases. Every information relating to the commission of a cognizable offence If given orally to an officer incharge of a police-station, shall be reduced to writing by him or under his direction, and be read over to the informant, and every such information, whether given in writing or reduced to writing as aforesaid shall be signed by the person giving it, and the substance thereof shall be entered in a book to be kept by such officer In such form as the Provincial Government may prescribe in this behalf.Information in cognizable cases. That is exactly why I would trust the highest court in the land to interpret the law and no one else.

I can imagine a scenario where the SC would choose not to interpret this properly or with bias. While, the legal framework would have been completed, such a ruling, and there have been a few in our country’s history, will degrade the moral authority of the legal system. This is not to say that we wouldn’t accept their judgement as a matter of law. It’s just that we would not believe that justice has been served. In common law, justice has to not only be served but seen to be served.

Otherwise, moral authority problems arise. This is one of the many reasons our justice system rank in the bottom of the worlds systems.

Regardless of your concerns, the SC remains the final arbiter available for matters of law, whatever it may decide.

I saw the exchange while on the treadmill. I must confide to a feeling of sadness at this comedown. He has totally lost his mojo. No former head of state, any head of state, should be treated so condescendingly by nothing more than a media anchor. Shocked to even find him agreeing to a face to face interview in the first place.

I hope he recovers well and moves to a safer location.

Whether I can read English or not, the Supreme Court and its interpretation of the law is what is important. And binding. By law.
Sorry interpretation is the matter where there is ambiguity not for the straight forward cases.

Supreme court is also bound by law and case history ...
 
It is not SC job ...

All legal matters fall under the SC. If it can order the registering of the FIR, it can also determine whether it has been registered in an acceptable manner, or not.

Okay but SC will debase itself and its moral authority by giving the wrong judgement. A systems legitimacy comes from natural law and if the SC is seen to be biased, this will call into connection their own legitimacy.

You're trying to put common sense in someone who has no stakes in Pakistan, take this vcheng guy as a spokesperson of pentagon/remnant of PPP.
