The US is demanding additional payment from Turkiye due to increased F-35 costs

Regardless of what Turkey does on the side by purchasing S-400, it was never part of the contract of the F-35 fighter program.

Really? Turkey has to abide by CAATSA as well as NATO requirements, and we do not know what the actual contractual obligations were for both countries under the F-35 sales agreement and Tukey's participation in the whole program, do we?

Sounds pretty clear what the issue is, but then we hear that USA has actually said that it is Turkey that owes it money by doing acts that have caused F-35 programs costs to go up, but it has offered updated F-16 jets as an alternative.

The first part, yes, but the second part: there is no offsetting of the payment made for the confiscated aircraft and other aircraft in production against the F-16 modernization. These allegations have been repeatedly denied by both the foreign ministry and the defense ministry. These two issues are already legally independent negotiations. And the negotiations between the Turkish and American delegations on the F-35 dispute are conducted by separate delegations: on the other hand, the negotiations on the F-16 purchase are conducted in a separate channel. In fact, the procedure for the F-16 modernization under Foreign Military Sales has been completed completely independently and is now in the relevant committee. Military negotiations on the F-16 have been completed. The US Department of Defense sent it to the State Department. The administration informally notified Congress through the State Department. If there is no objection from there, the process is completed and official notification is made. Agreements have been reached with the administration levels.

The problem there is that a group of senators is trying to tie the authorization of F-16 exports to specific geopolitical conditions, some of which are directly contrary to the national interests of our country. The main one is the requirement to recognize an airspace that TR does not recognize. Finally, in February, another new demand was put forward, and they tried to link this sale to the condition of Sweden and Finland joining NATO. These preconditions are the factors blocking the F-16 sale.

If you read the JSF contracts, it says that disputes within the program cannot be taken to any arbitration court and that disputes can be resolved through dialogue mechanisms between the parties. A mechanism on this issue has already been in place for about 2 years, with one round in the US and one round in TR. Don't ask who would sign this stupid contract, unfortunately they did.

Turkey is short-changing itself. It should hold off Sweden and Finland's NATO membership for as long as it does not get back into the F-35 program and has a sale contract in place for at least 50 F-35s. Why just bother with an F-16 upgrade and additional new units in return for letting the Nordics into NATO?

I would rather wait and see how both countries proceed in their negotiations on this matter and how the matter is finally settled, rather than make one-sided claims or speculate at this point.
