Gujarat HC raps Narendra Modi govt for 'inaction' during post-Godhra riots

AHMEDABAD: The Narendra Modi government was on Wednesday pulled up by the Gujarat high court for "inaction and negligence" on its part during the 2002 post-Godhra riots that led to large-scale destruction of religious structures.

A division bench of acting chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala made these observations, while ordering compensation for over 500 religious structures in the state.

The court was hearing a petition filed by Islamic Relief Committee of Gujarat (IRCG).

Inadequacy, inaction and negligence on the part of the state government to prevent riots resulted in large-scale destruction of religious structures across the state, the court observed.

The government was responsible for repair and compensation for such places, it further said.

The court said that when the government had paid compensation for destruction of houses and commercial establishments, it should also pay compensation for religious structures.

The court also ordered that principal judges of 26 districts of the state will receive the applications for compensation of religious structures in their respective districts and decide on it. They have been asked to send their decisions to HC within six months.

IRCG's petition in 2003 had sought court's directions to the government to pay compensation towards damage of religious places during riots on the ground that the National Human Rights Commission, too, had recommended and the state government had in principle accepted the suggestion.

The state government had opposed the IRCG petition, saying it was a violation of article 27 of the Constitution.

The government further said that there was no policy with regards to compensation for restoration/repair of religious places damaged or destroyed during the riots.

Lawyer for IRCG, M T M Hakim hailed it as a "landmark judgement" in the country, in which compensation has been ordered for destruction of religious structures.

"This is also probably for the first time that a court has held the state government responsible for inaction and negligence during the 2002 riots," Hakim said.

The failures of the Gujrati bjp vas evident right after the riots when the army wasnt called in, it was as bad as 84 almost.

Good work HC, the state govt was morally responsible for the riots. Many Hindu and muslims died. The state govt should act in better way to stop riots.

When Train was burnt, The parlimanet was in session, I watched the session, Sonia and opposition didn't said a word to condemn the brutal attack. Infact she and congress waited for situation to worsen,If they have forced central govt, central govt could have sent paramilitary forces hence riots could have been averted.

Sonia, Bajpai, Kongress, BJP, Hindu Muslim, Mulayam, laloo all were responsible for Gujrat riots, All must be made accountable for their crime.

Good move by Gujrat HC, very commendable and a true testament to Indian jusdical system- attacking the CM like this despite the pressure they must have been under is truly admirable.

Modi and all these other dinosaurs need their day in court just like the scum who instigated the '84 riots and sat back and watched Indians die. Has to be the final nail in Modi's hope for being PM, he still has blood on his hands and if he can't run a state fairly and peacefully for all how can he run a much more diverse nation.


Justice is too slow coming in many cases in India.

fact of the matter is whether you like it or not but the reality of the demographic politics of South Asia have always been interlinked so in simple terms the ground realities of the demographic strength today in the region are for 807 million Hindus you also have a rapidly growing population of 500 million plus Muslims that is 807/500 = 1.6 which is less then a ratio of 1/2 which simply means that never in the history of the Indian subcontinent has the demographic balance been so even as it stands today. now having said that do you even realize that by holding onto you stubborn & destructive revisionist theory what type of volatile situation you are inviting for India & South Asian @ large

Not condemning the attack was the best thing to do in that situation. Narendra Modi purposely inflamed the situation by saying that "It was a pre-planned act. The culprits will have to pay for it. It was not communal violence. It was a violent, one-sided, collective act by only one community."

Seriously, the congress is not without blood on its hands, as the 84 riots will attest to. However, I simply don't see how you guys can defend Modi here. His statements (not to mention other testimony) make it obvious that he was complicit in the massacre of thousands of muslims.
