Here we Singaporeans are, working hard to integrate the PRC and ASEAN better and there the Viets are helping to spoil the show for us all. I believe Malaysia is together with Singapore hoping to get China more involved in ASEAN. I doubt war would break out though. Your leaders are observers in ASEAN anyways, so we probably can work issues out with dialogues.

5. Vietnamese ceded any legal claim to the Paracel and Spratly Islands on September 14, 1958.

North Vietnam won the civil war against South Vietnam. Therefore, the diplomatic document signed by Vietnam Premier Pham Van Dong on September 14, 1958, which ceded Paracel and Spratly Islands to China, is in effect and legally binding.

  3. No foreign aircraft and no foreign vessels for military use may enter China's territorial sea and the air space above it without the permission of the Government of the People's Republic of China.

  While navigation Chinese territorial sea,every foreign vessel must observe the relevant laws of the People's Republic of China and regulations of its government.

  4. The principles provided in paragraphs (2) and (3) apply also to Taiwan and its surrounding islands,the Penghu Islands,the Dongsha Islands,the Xisha Islands,the Zhongsha Islands,the Nansha islands, and all other islands belonging to China.

  The Taiwan and Penghu areas are still occupied by the United States armed force. This is anunlawful encroachment on the territorial integrity and sovereignty of the People's Republic of China. Taiwan,Penghu and such other areas are yet to be recovered,and the Government of the People's Republic of China has the right to recover these area by all suitable means at a suitable time. This is China's internal affair,in which no foreign interference is tolerated.

6. The entire Vietnamese government admitted to Chinese sovereignty over the South China Sea islands and territory.

On June 15, 1956, Vice Foreign Minister of the DRV (North Vietnam) Ung Van Khiem admitted Chinese sovereignty over the Spratly and Paracel Islands.

Another DRV official, Le Loc (Temporary Head of the Asian Mission), concurred in Chinese sovereignty over South China Sea islands.

In their civil war, North Vietnam (i.e. Democratic Republic of Vietnam or DRV) conquered South Vietnam and became the government of an unified Vietnam. Let's hear it directly from the DRV's mouth with regards to Chinese sovereignty over the Paracel Islands.

"Truong Nhan Tuan: Based on a number of documents from Peking, on 15/6/1956 the Vice Foreign Minister of the DRV Ung Van Khiem, at the time of hosting a visit from the Chinese temporary ambassador in Vietnam, spoke the following: “According to documents that Vietnam has presently, historically speaking, Tay Sa and Nam Sa islands belong to China.”

Nguyen An: Tay Sa and Nam Sa means the Paracel and Spratly islands?

Truong Nhan Tuan: Yes, the Paracel and Spratly islands....China also presents other evidence, such as the incident of Le Loc (Temporary Head of the Asian Mission) also present at that time adding that: “From a historical perspective, the archipelagos of Xi Sa and Nan Sa (Tay Sa and Nam Sa) belonged to China since the T’ang dynasty.

Truong Nhan Tuan: Yes. The famous one is the diplomatic note of Pham Van Dong, written on 14/9/1958 which admits the territorial waters declared by China a few days before. The Chinese declaration was that the archipelagos of Hoang Sa, Nam Sa, and Truong Sa belonged to China.

Nguyen An: So it was an admittance of Chinese sovereignty over these islands?

Truong Nhan Tuan: In reality, there is nothing in the content of the letter that explicitly states admittance of Chinese sovereignty over the Paracel and Spratly islands becaue the letter only states that Vietnam “make notes and admits the declaration of China regarding territorial waters of China” but does not mention about sovereignty over the Paracel and Spratly archipelagos.

What makes the justification somewhat weak is because during the war, when the Chinese navy invaded the Paracel islands in 1974, there was no objection from the DRV. This silence becomes a weighty piece of evidence for China to claim that Vietnam had admmitted Chinese sovereignty over the Paracel and Spratly archipelagos already.

Nguyen An: Based on what you just presented, is this the reason why Qin Gang (Chinese Foreign Ministry Spokesperson) commented that Vietnam’s position regarding sovereignty over the Paracel and Spratly archipelagos changed over different periods of time?

Truong Nhan Tuan: This is correct. But the legal significance is not simple. Declarations made by officials in North Vietnam at that time may be a reality. The fact that Peking presents them without protestations or justifications from Hanoi tells us that it is probably true."

China has never “occupied” Scarborough shoal. While we have exercised sovereignty and
jurisdiction since our independence. We have a lighthouse there since 1957. Control of the area which is effected by frequent patrols as allowed by our small fleet of boats and policing of these
waters for decades without protest from any other country claimants, including arrests of both
chinese and vietnamese fishermen illegally fishing in Philippine jurisdiction or using illegal fishing methods in our waters. In the 1700's philippine map(Carta Hydrographical y Chorographical De Las Yslas Filipinas by Fr. Pedro Murilo Velarde, S.J. and published in 1734)clearly state that scarborough
shoal was already part of zambales province, under effective control of the spanish in the
Philippines back then.

All you(Chinese) did was criticize Philippine evidences about the treaty of Paris, about
republic act 3046, about Unclos. China is fabricating their claims. Notice that instead of proving
their claims, they try to discredit the claims and evidence of other countries like the Philippines
and Vietnam which holds a lot of history in the areas involved. However, these evidence are real
and factual and cannot be rebuked, unlike that of China's where their claims are unclear, the
evidence either fabricated or missing.

The Chinese claim to have 'been there first' is like arguing that Europeans got to Australia before
its aboriginal inhabitants.
China's historical evidence is NOWHERE TO BE FOUND. And everything is just based on what their government claiming. No pictures available on the net or newspapers. The Chinese government is just fabricating LIES about their history.

Just because China decided to one day include the entire SCS as part of their maps they become the owner of waters long controlled by other South East Asian countries like Vietnam, Philippines, Malaysia and Brunei??? Answer: NO!!!

For sure, China has the power to impose its will. But its aggressive stance towards the Philippines, so often seen as an especially weak state, has alerted others, including Japan, Russia and India

Europe. The Scarborough Shoal is not just a petty dispute over some rocks. It is a wake-up call

The Philippines has indisputable sovereignty and jurisdiction over Scarborough shoal and China is
welcome to try to rebuke it in the courts any time. The philippines has already invited china a
number of times to resolve the dispute through arbitration by the international court, which china turned down repeatedly because they know themselves theyll lose. It is therefore without doubt,
that the Philippines is the rightful owner of scarborough shoal and that its sovereignty is
indisputable.

transparency and diplomacy should be used to resolve maritime issues.

ASEAN
Leaders of the Association of Southeast Asian Nations (Asean) have agreed that the regional Code of Conduct in the South China Sea should integrate provisions of the United Nations Convention
on the Law of the Sea (Unclos), a treaty that the Philippines cites in its claim to disputed
Scarborough Shoal and other islands.

EU-Asia Center director Fraser
Cameron said during a forum in Manila that the EU supports a rules-based
international system and liberty of navigation. The EU believes that territorial disputes should be
resolved “in accordance with international law through peaceful and cooperative solutions.”

New Zealand supports the position of the Philippines and other allies
that claimants to the Spratly chain of islands must heed the United

stand that Manila's dispute with China over ownership of Scarborough

JAPAN
President Benigno Aquino III on Tuesday night secured Japanese Prime
Minister Yoshihiko Noda’s support for a peaceful resolution of the
six-nation dispute over the potentially oil-rich Spratly islands.
Following the meeting, the President and Noda “confirmed that freedom of
navigation, unimpeded commerce, and compliance with established
international law including the UNCLOS and the peaceful settlement of
disputes serve the interests of the two countries and the whole region.”
UNCLOS refers to the UN Convention on the Law of the Sea.

AUSTRALIA
Australia said those involved in the territorial dispute — Brunei,
China, Malaysia, Philippines, and Taiwan — should adhere to the United
Nations Convention on the Law of the Sea (UNCLOS), which codifies the
international law of the sea.

Australia’s expression of support came less than a week after Washington expressed its support to Manila over the same issue.

It is interesting that on February 28th, several China’s newspapers strongly denied the accusation that China Maritime Surveillance (CMS) shot at Vietnamese fishing boats or did not have any clash with any Vietnamese fishing boats.

Today, Chinese Foreign Ministry spokesman Hong Lei finally admitted an incident occurred between CMS and Vietnamese boats but no force was used in what he termed an illegal fishing incident.

Picture is worth a thousand words. Japan’s Kyodo News reported the incident with a captured image of CMS spraying and attacking Vietnamese fishing boat on the 25th. Further, forensic evidence shows Vietnamese boat was shot with bullets. Chinese troops confiscated $25,000 worth of fish catch from Vietnamese fishermen.

According to newspaper report the ramming incident happened when the Philippine fishing boat war anchored near a "payao" a
fish aggregating device. Therefore the location of the incident is very near the coast of Pangasinan, since a fishing boat or a ship cannot anchor if the depth of the sea is more than 100 meters.

The big question is how come the Chinese fishing boat is operating in our 12 miles territorial limit or in our 200 nautical miles
Exclusive Economic Zone. There is also some reports from Philippine fishing boat in Palawan that Chinese fishing boat or patrol
boat is operating in Palawan coast. Another question is why the Chinese fishing boat did not help??? If it was accidental, then
they should have helped.
 
When one's nation is poor and illiterate, its people will be an easily target for manipulation by their own selfish politians and some ambitious big nations.
