A case in what court? Iran didn't let a case happen. Perhaps it can be argued that way, once Iran leaves and the issue is decided on the table. If Iran had a good case, it shouldn't have moved its military, kicked out all the inhabitants and then came forward with these points.
There was joint administration between Iran and UAE of some of the Islands up until the early 90s when Iran used its muscle to remove the few Emiratis there. Iran has to live with the world and the UN won't recognize Iran's claims this way and thats why until today these Islands are considered joint administrative bodies between Iran and UAE.
