Three Chinese engineers arrested in India

You mean like the Delhi Airport root that can't even support 1 inch of rain and collapsed?! or the Delhi Metro that collapsed, not once but several times killing many people?! Or the bridges that Indian companies build that is supposed to last a few decades, but collapses after only a few years?!

Lets not talk about collapses at construction sites, China is way ahead of India in this regard. However, listing construction accidents that resulted in deaths is in very poor taste.

So much for the "theory" that Zangnan (aka South Tibet) being free, when in fact it is RESTRICTED by PAP. Don't want any foreigners there to witness the ethnic cleansing of native aboriginals.

As you need a permit to visit even the cities of China, does that mean that China does not want us to see the genocide against tibetans and other minorities.

Racist human rights abuses by Hindu fanatics will be met with the force of justice, if not now in the near future -- Karma will GUARANTEE justice be served. Inshallah!!!

BEIJING: China said on Thursday it will do what it takes to protect the rights of three Chinese engineers, who have been arrested and charged with culpable homicide by the Indian police on Monday.

Chinese members might be interested to know what culpable homicide is according to Indian penal code:

Section 299. Culpable homicide

Who ever causes death by doing an act with the intention of causing death, or with the intention of causing such bodily injury as is likely to cause death, or with the knowledge that he is likely by such act to cause death, commits the offence of culpable homicide.

Illustrations


(a) A lays sticks and turf over a pit, with the intention of there by causing death, or with the knowledge that death is likely to be thereby caused. Z believing the ground to be firm, treads on it, falls in and is killed. A has committed the offence of culpable homicide.

(b) A knows Z to be behind a bush. B does not know it A, intending to cause, or knowing it to be likely to cause Z's death, induces B fires and kills Z. Here B may be guilty of no offence; but A has committed the offence of culpable homicide.

(c) A, by shooting at a fowl with intent to kill and steal it, kills B who is behind a bush; A not knowing that he was there. Here, although A was doing an unlawful act, he was not guilty of culpable homicide, as he did not intend to kill B, or to cause death by doing an act that he knew was likely to cause death.

Explanation 1-A person who causes bodily injury to another who is labouring under a disorder, disease or bodily infirmity, and thereby accelerates the death of that other, shall be deemed to have caused his death.

Explanation 2-Where death is caused by bodily injury, the person who causes such bodily injury shall be deemed to have caused the death, although by resorting to proper remedies and skilful treatment the death might have been prevented.

Explanation 3-The causing of the death of child in the mother's womb is not homicide. But it may amount to culpable homicide to cause the death of a living child, if any part of that child has been brought forth, though the child may not have breathed or been completely born.

Hope they do not face execution.

China gave Indian officials consular access.


NEW DELHI: Indian officials Wednesday got consular access to 21 Indians detained in Shenzhen by Chinese authorities five days ago for allegedly smuggling diamonds.

An official from the Indian embassy in Beijing and another from the Indian consulate in Shenzhen met the detainees and sought information about the circumstances under which they were held, official sources said here.

The officials will now decide whether they needed any help from the embassy in getting legal assistance, the sources added.

Legal aid for 21 Indians in China jail

BEIJING: The 21 Indians in judicial detention in the south China city of Shenzhen are expected to hire a law firm to defend them in Chinese
courts in a day or two, according to Indian officials who met them on Wednesday. Some of the men, arrested during a crackdown on diamond smuggling from Hong Kong, had separate meetings with Indian embassy officials.

‘‘We are trying to help them with legal representation. It is the most important issue for them,’’ S Jaishankar, Indian ambassador to China, told TOI. ‘‘They are being treated well. We have verified that,’’ he said.

But the three Chinese engineers have been charged with culpable homicide where death sentence is generally given as minimum punishment.

Have they got consular access yet? Have they received any legal aid yet? What is their present condition? Have they suffered any police torture?

Many such questions can arise. Whatever their condition is, it is sure that this incident might lead to a catastrophe.

India has VERY OPENLY provided all details relating to the arrest of the three fellows.

The chinese are not even telling the circumstances under which the ppl were arrested....and not even allowing the people to defend themselves...... welll they are NOT ALLOWING THEM TO TALK....!!!!
and the fact that they were not arrested while doing smuggling but picked up from homes randomly and now not being allowed to tell their story makes it seem murky....really murky....these chinese cannot be trusted after all at all.....

THEY CAN GIVE SENTENCE AND PICK ANYONE UP FOR ANY CRIME AND NOT EVEN LET THAT PERSON SPEAK FREELY FOR HIS DEFENCE...!!!!!!!!!!!

Was that a "homicide" or an "accident"? Where is the evidence that shows the Balco collapse was a "culpable homicide"?

If these men are guilty of negligence or deliberate undercutting the material quality they shoud be punished. However, even though China's justice system has been pretty bad, India is worse. The lack of a fair trial is always going to be a concern.

the 3 are being given proper chance to protect themselves......the 21 are not being given even that.....not being allowed even to tell their story to their legal team properly....In case they are innocent how will they protect themselves.....:angry::angry:

when ur chinese govt is not even allowing any info of them outside....n not telling anything where n how they were caught....

U just accuse ppl of wrongdoing and then kill/imprison....Just accusation is enough to kill/imprison anybody...no need to prove the guilt.....:angry:

in nutshell it means if someone looks dangerous,says something wrong,goes against chinese govt or there is need to setttle score with someone... just pick that person accuse of some serious crime, dont prove the crime,dont let them defend themselves and kill/imprison that person......
