گروه‌بین‌الملل-رجانیوز: شورای روابط خارجی سنای آمریکا پنجشنبه هفته گذشته (25 می؛ 4 خرداد) تحریم موسوم به «قانون مقابله با اقدامات بی‌ثبات کننده ایران ۲۰۱۷» Countering Iran’s Destabilizing Activities Act of 2017 را با 18 رای موافق و 3 رای مخالف به تصویب رساند.

به گزارش رجانیوز تصویب قانون فوق- موسوم به S.722- از چند جهت ناقض برجام و قطعنامه 2231 است چنان‌که حتی محمد جواد ظریف وزیر امور خارجه دولت روحانی نیز روز گذشته (چهارشنبه 10 خرداد) در جمع خبرنگاران مجبور به اعتراف در این رابطه شد و گفت : آمریکائی ها باید به این نتیجه برسند ما چون امنیت و پیشرفت اقتصادی مان را از مردم می گیریم این کارها هیچ تاثیری بر سیاست های جمهوری اسلامی ندارد و حتما به موقع ما اقدام می کنیم. اقدام‌هایی هم انجام داده ایم ، اطلاع دادیم به سایر اعضای ۵+۱ که این اقدام، اقدام مخربی است و مخالف برجام است و آنها باید برای ممانعت از آن اقدام کنند.(1)

اعتراف به ناقض برجام بودن قانون تحریمی s.722 تنها محدود به ظریف و مقامات ایرانی نبوده و نیست و حتی مقامات سابق آمریکایی نیز بدان معترف بوده‌‌اند چنان‌که «آدام زوبین»، معاون وزیر خزانه‌داری سابق آمریکا چندی پیش در نامه‌ای خطاب به نمایندگان کنگره هشدار داده بود که این پیش‌نویس توافق هسته‌ای با ایران را تضعیف کرده و در روابط آمریکا با متحدانش اخلال ایجاد خواهد کرد.

زوبین در این باره نوشته بود: «با توجه به اینکه دست‌کم مغایر با روح برنامه جامع اقدام مشترک دیده خواهند شد، موجب واکنش‌های وحشتناکی در داخل ایران و با متحدان ما خواهد شد.»(2)

آوریل هاینس، جان کری، آنتونی جان بلینکن و ریچارد نفیو از جمله دیگر مقامات سابق آمریکایی بودند که اعتراف کردند که تحریم s.722 ناقض برجام می‌باشد و هماهنگ با توافق هسته‌ای نیست.(3)

گفتنی است که تحریم موسوم به " قانون مقابله با اقدامات بی‌ثبات کننده ایران 2017 " از سپاه پاسداران گرفته تا موشک‌های بالستیک و افراد درگیر در فعالیت‌های منطقه ای ایران را هدف قرار می‌دهد و درصدد مسدود کردن دارایی‌های این افراد می‌باشد اما شوری ماجرا در جایی بیشتر می‌شود که متوجه می‌شویم مطابق با این تحریم رئیس جمهور آمریکا مجاز به آن است که دارایی افرادی را که از جانب وزارت خارجه این کشور ناقض حقوق بشر، متهم به شکنجه و قتل‌های فراقضایی در ایران می‌باشند را مسدود نماید! چنان‌که در بخشی از این تحریم آمده است:

The President may impose asset blocking sanctions against any person identified by the State Department as responsible for extrajudicial killings, torture, or other gross violations of internationally recognized human rights committed against certain individuals in Iran.

گفتنی است که این قسمت از تحریم s.722 به همراه دیگر قسمت‌های آن – که در گزارش‌های آتی به آن اشاره خواهد شد- از جمله مقررات تبعیض آمیز و استثنایی هستند که آمریکا به عنوان یکی از اعضای 5+1 در بند 28 برجام متعهد شد که مطابق با اصل حسن نیت از اعمال آن خودداری نماید.

در همین راستا در این بند از برجام می‌خوانیم:

28. The E3/EU+3 and Iran commit to implement this JCPOA in good faith and in a constructive atmosphere, based on mutual respect, and to refrain from any action inconsistent with the letter, spirit and intent of this JCPOA that would undermine its successful implementation. Senior Government officials of the E3/EU+3 and Iran will make every effort to support the successful implementation of this JCPOA including in their public statements. The E3/EU+3 will take all measures required to lift sanctions and will refrain from imposing exceptional or discriminatory regulatory and procedural requirements in lieu of the sanctions and restrictive measures covered by the JCPOA.

گروه 1+5 و ایران متعهد هستند که این برجام را با حسن نیت و در فضایی سازنده، برمبنای احترام متقابل اجرا نمایند و از هرگونه اقدام مغایر با نص، روح وهدف این برجام که اجرای موفقیت آمیز آن را مختل سازد، خودداری کنند. مقامات ارشد دولتی در گروه 1+5 و ایران تمام تلاش خود را براي حمایت از اجرای موفقیت آمیز 3 این برجام، از جمله در بیانات عمومی خود، به کار خواهند بست . گروه 1+5 کلیه اقدامات لازم را برای لغو تحریم ها به عمل خواهند آورد، و از تحمیل مقررات آئین نامه ای استثنائی یا تبعیض آمیز و الزامات شکلی به جای تحریم ها و اقدامات محدودیت ساز تحت پوشش این برجام، خودداری می ورزند.

البته باید اشاره کرد که نقض برجام تنها محدود به اصل حسن نیت نمی‌باشد که در گزارش های بعدی به آن اشاره خواهیم کرد اما وزارت امور خارجه و محمد جواد ظریف از آن جایی که خودشان نیز به نقض برجام معترف شده اند بهتر است به جای "خواندن بیانیه" اقدام عملی مناسبی برای واکنش به اقدامات خصمانه آمریکا در نظر بگیرند؛ اقدام عملی که مجلس پیشین در بند سوم مصوبه اقدام متناسب و متقابل هسته ای به آن اشاره کرده و دولت نیز موظف به اجرای آن است.

(Liquid assets freed up in European and Asian banks might have totaled some $50 billion, according to a U.S. Treasury official; in addition, the United States refunded $1.7 billion delivered for an arms deal that was signed before the 1979 revolution but never fulfilled.)
Most significantly, the United States is no longer enforcing secondary sanctions on Iran’s oil sector, which has allowed Iran to ramp up its oil exports to nearly the level it had been prior to sanctions. The International Monetary Fund (IMF) estimated in October [PDF] that Iran’s GDP was growing at 4.5 percent in 2016 as it boosted its oil production to 3.6 million barrels per day. Also, Iran has opened some 300 bank accounts with foreign banks establishing new lines of credit.......Lastly and most importantly, Iran has once again given access to SWIFT banking network which the world uses to pay for the oil shipment.

What exactly is your problem with the nuclear issue? although not all sanctions were removed. iran gained MASSIVE sanctions relief, and a huge influx of frozen funds. This will allow to economy to grow (instead of just being on survival mode)
