Hindu woman, Christian man's marriage not valid without conversion: HC

First I thought it was about Pakistan Justice system when conversion is necessary for inter-religious. I thought India had civil marriages where persons of different religions can marry without conversion. Seem like Indians are copying Pakistan.

We do have civil marriages, under the Civil Marriages Act, which does not require the partners to be of the same religion. Your first thought was right.

This particular case was of one where the couple had married in a temple, a type of Hindu marriage, but where one of them was not a Hindu but a Christian, so ineligible for the temple marriage.

1. who are hell are these parents to file a court petition against their daughter when what she did must be celebrated?? these parents must be punished.

2. the indian police sadly has a tendency to side with criminal parents going against the human rights of sons and daughters in love... in many cases, police instead of catching and executing real criminals have tracked down eloped people and handed them to families who proceeded to "honor kill" them... such police officials must be eliminated publicly.



yeah, let us have the "sanctity" of the traditional "indian" marriage with its "saath janmon ka bandhan" and in the first janam itself the holy activity of torturing or murdering the bride for dowry.

My dear, lets not be blind here and abuse Hindu culture like Pseudo-Se(i)culars. Dowry is present in every society. For example: My family had to give dowry of around 20 Lakhs for my cousin's marriage despite Proposal coming from from boys side and it being love cum arranged marriage.
Marriage between a Hindu woman and a Christian man is not legally valid if either of them does not convert, the Madras High Court today held. Dismissing a Habeas Corpus petition filed by the woman's parents, justices P R Shivakumar and V S Ravi said if the couple wanted to solemnise the marriage as per Hindu custom, the man should have converted to Hinduism or she should have converted to Christianity if she wanted to do so as per Christian custom. In the alternative, their marriage should have been registered under the Special Marriage Act, 1954, if they preferred to follow their religions without conversion.


The woman, who was produced in court by police after the petition was filed, told the judges that she had got married in a temple at Palani, to which they asked how the marriage was valid as per Hindu law if the man did not convert.


The woman, however, remained steadfast in her decision to go with him, which they did as she was a major. "As she is a major she can go anywhere she likes, though they had not married as per law," the bench here said. The judges said that the girl became a major on May 29 and she was free to go to any place at her will. As per law, she did not need care and protection.

This report's headline clearly seems a cheap attempt to sensationalize the matter.

Don't know why you are maligning Pakistan. I have seen Pakistanis of different religions being recognized by the Govt. as per the constitution. It's called a civil marriage.

what you described about your family is a sad thing indeed... capitalism and worship of money goes across communities.

i am the first to agree that muslims in india have adopted evils like dowry and "honor killing"... i am saddened by the change ( towards reactionary attitude ) in indian muslims since 1989 and especially in the last 15 years.

but who do you mean by "pseudo-se(i)culars"??

In Arabs, it's the other way round, the guy pays the dowry, mehar is separate. :D

Live-In relationship is like living in your house as a tenant whereas Marriage is like living in your house as an owner!

I meant the current crop of intellectuals, leaders and paid media persons who pretend to be Secular in disguise of abusing and targeting a single man and organisation. No personal attack intended its just my hatred towards such people who thrive on creating social and communal disharmony to run their shop ( or be in limelight precisely).

I have got sick of this In-tolerance debate which only exists when I watch TV and then think, its not the India we love anymore but a dangerous place for people like us. But the next morning when I step out of of my house, still see the same beloved country which thrives on its diversity and Hindu- Muslim still celebrating their festivals together without any tensions. I feel onus is on people like us to stop listening such people and keep our society intact.
