This news might have been posted elsewhere but i am starting this thread just to discuss the aftermath of this decission.

The Supreme Court of Pakistan has rejected a request to launch a treason case against former military ruler Pervez Musharraf.

The court's announcement follows the failure of the former president and his lawyers to appear in court for a second consecutive day on Thursday.

The court had asked him to explain his decision in 2007 to invoke emergency rule and suspend the constitution.

It has now ruled that parliament is the place to debate Mr Musharraf's actions.

Chief Justice Iftikhar Mohammed Chaudhry rejected a petition to launch a treason case against the former president.

Mr Chaudhry was himself removed from his position as a result of President Musharraf's imposition of emergency rule, but was reinstated after he resigned in August.

Last week, a lawyer petitioned the Supreme Court to open proceedings against the former president for alleged unconstitutional behaviour. Mr Musharraf says his actions were taken in the best interests of Pakistan.

Correspondents say that the court proceedings have jolted the Pakistani political establishment at a time of relative calm and comes as the US wants the country to focus on fighting Taliban militants near the border with neighbouring Afghanistan.

Mr Musharraf - who is currently believed to be in Britain - seized power in a 1999 and sacked Mr Chaudhry and dozens of other senior judges in 2007.

He argued that his actions were taken for Pakistan's sake due in part to the threat from Islamic militants.

Thanks to the CJP for saving Pakistan from another turmoil. Article 6 clause 3 is clear that only Parliament can take action in high treason cases.

(3) [5] [Majlis-e-Shoora (Parliament)] shall by law provide for the punishment of persons found guilty of high treason.

This matter is in the hand of Parliament and I am sure that Pakistan's Parliament will consider the fact the article 6 can be invoked against almost the entire Parliament as majority have supported a military ruler at one point or another per Article 6 clause 2.

(2) Any person aiding or abetting the acts mentioned in clause (1) shall likewise be guilty of high treason.

Part I : Introductory

I will not be surprised if an indemnity is issued for everyone, this way the Sharif brothers, PM, Chaudarys, PPPP, Musharraf, CJP, JI and all else will be indemnified for their past support or imposition of military rule.

Next step should be to add a clause addressing any future coups.

You hit jackpot, CJP could ask for Article 6 there are clauses by which he is allowed to trail on constitutional matters.

Mr Iftikhar is a drama baaz he wants to look clean. After all he gave Musharraf extra powers to amend the constitution without the Parliament and indemnity. So what does this lead to. Iftikhar doesn't want a trail of Musharraf as Musharraf will make Iftikhar guilty of all that happened after his coup.

And I highly doubt the Parliament would want to play into this dirty game.

You are right Interceptor..The thing will go back to 1999 when CJ approved Musharraf Martial Law, gave him powers and of course took Oath as PCO Judge.

Exactly what you pointed. Who can set that apart why would we want to try Musharraf first. What we really want do is try Iftikhar who played his part in providing Musharraf with absolute power.

The only reason that Iftikhar said no to Musharraf when he was told get out, was because he was loosing his job. This is where the political parties took strength. It was now made into a political issue to put Iftikhar back on his seat and make him say no again to Musharraf on his legality of re-election as President. But what we saw was Iftikhar was just a making us all a fool.

In the NBA there are terms such as three way trade and this seems more like a three way trade -)

Musharraf, CJP and NS are the biggest benfeciaires.

Even if Parliament never offer indemnity, it will never try or request a trial against Gen. Musharraf.

As far as the PCO and other actions are concerned, Parliament will not change them. In fact they may validate them in order to protect Zardari.

KARACHI: Awami Muslim League (AML) President Sheikh Rashid said the case against former President Pervez Musharraf is a sheer drama; it is politicians who send abroad the former rulers and file against them lawsuits later on.

Talking to media at Karachi Airport on arriving here, he said the government is unable to solve basic problems of the masses, as this is the party which could not abolish 17th amendment despite all its electoral pledges, political slogans and parliamentarian majority.

No brother cool down. That is maximum limit a general can be dragged. After this invisible forces come to support. It is our wish that he should be trailed but world does not follow “weak man’s” wish. I have already somewhere mentioned on this forum that this is going to be very interesting analytical case for political science students. Judicary will go after her fellow judges not after the generals.
If you are old enough to be witness of Supreme Court thriller when it summoned Aslam Baig about 1988 elections, what happened 2+2-2x0 = 0

He was also retired chief of army staff and Mushraf is also retired chief of army staff.

Keep you fingers crossed and see what happens

mushrraf'S time was far times better than present situations
it is not mushrraf who need to be put on trial
but the corrupted present government composed of zardari and nwaaz

Democracy is democracy not xyz democracy, if fudels are selected then there are many reasons but main reason is adventurous generals ruined the whole system
Can you bit explain how Mushraff time as far better
Nawaz was sent on exile and Zardai was kept in prison for highest time after Nelson Mandila, if he was corrupt why Mushraf did execute him
