Chennai: German teen raped in moving train

You will never have the luxury of even watching white women travelling in your country if you keep going at the same rate.
10 tourists were shot dead in your country just a few months ago. Don't forget that before trolling. Too many skeletons in your closet.
Stop talking through your ***.Everyone knows from where the terrorists in our country get their funds,a terrorist don,t represent an average Pakistani citizen and he got his funds from our neighbours to sabotage and destabilize our country. We are not in moral and ethical deficit like you people .One rape after another and you have a solid reputation abroad as a country of "gang rapists".But still you have a gall to look and bark at Pakistan.

Western women will continue to travel to India in millions just like 2013

The number of women tourists visiting the country has gone down by 35% in the last three months following the brutal gang-rape and death of a paramedical student in Delhi, says a survey.

Also, the overall foreign tourist arrival dipped by 25% in the past three months compared to the same period last year, reveals a survey by the Associated Chambers of Commerce and Industry of India (ASSOCHAM).

After Delhi rape, UK revises India travel advisory - Hindustan Times

After Delhi rape, UK revises India travel advisory
Britain on Thursday revised its travel advisory for citizens travelling to India, advising women to “use caution” following incidents of “serious sexual attacks” against foreign nationals in the country in 2014.

The revised advisory mentions the recent rape of a Danish woman in central Delhi, and notes that British women had been victims of sexual assault or had been the recipients of unwanted sexual attention in various parts of India.

The advisory says: “Women should use caution when travelling in India. Reported cases of sexual assault against women and young girls are increasing; recent sexual attacks against female visitors in tourist areas and cities show that foreign women are also at risk”.

It adds: “British women have been the victims of sexual assault in Goa, Delhi, Bangalore and Rajasthan and women travellers often receive unwanted attention in the form of verbal and physical harassment by individuals or groups of men.

“Serious sexual attacks involving Polish, German and Danish women travellers have been reported so far in 2014. Women travellers should exercise caution when travelling in India even if they are travelling in a group”.

The 'Safety and Security’ section of the advisory says that British women travelling in India “should respect local dress codes and customs and avoid isolated areas, including beaches, when alone at any time of day”.

It adds: “Be wary of confidence tricksters, particularly in Agra and Jaipur, who promise large amounts of cash for delivery of jewellery abroad in return for an initial deposit. The jewellery is worthless and the deposit, often amounting to thousands of pounds, is lost”.

Three foreign women raped in the last 10 days. A cursory glance at Google news shows this as one of the most covered events in the world in the past 48 hours.

ps apologies for using expletives ..

The rape could have been avoided to the core. In a running train even a alarm will awake other passengers, and they will beat him to pulp in no min. But this german didnt even have this conscience? Is she that stupid?
As much as the rape is condemnable, a simple common sense would have avoided this.

why i am not surprised?---please bring something new, rape is very common issue in India now!

Lets not make these domestic civil issues into international issues.

Internationally the concern should be not weather a sexual assault had occurred on a train, but weather the judiciary is able to carry out the administration of the law, fairly and impartially.

From reading the first post, what I can gather is that

1. A compliant was made by the victim to have been raped by a person she traveled on the train with.

2. She states that she did not say anything while being raped because she was too scared.

3. The police made an arrest and a identification parade is pending.

From the facts that I can gather the police made that arrest without "reasonable cause". The police did not have reasonable cause to believe that the suspect had committed a sexual assault. All they had was the compliant of the victim, who under the view of the law is deemed an 'adverse witness'. There were no other witnesses to the alleged rape.

An 'adverse witness' is someone who has a nonaligned interest in terms of the Law. The interest of the Law is to have evidence brought against the accused and that evidence is fair and impartial. As she wants to see accused put in jail, she is not a a witness in which the law will give high regard to. The accused is also an adverse witness, as he has significant motive to lie about what happened in order to stay out of jail, his interest are also not aligned with that of the Law. The statements of both the accused and victim are to be taken with a heavy dose of salt.

In order to sustain a conviction of sexual assault the police need to prove two elements of the law.

A. The accused had penetrated the victim (penal- vaginal penetration).
B. The Victim did not consent to the sexual act.

Even if the police was able to prove that the part A.. The fact that she did not say anything casts serious doubt over part B.

When the media get involved and the police and judiciary isn't able to do its job properly, It is a recipe of injustice. We have seen this in cases in the United States, where innocent people were wrongly jailed over crimes they did not commit after a heat of media attention.

Lastly I'd like to say based on the above facts, it appears as if the accused is actually the victim of a police harassment. The police seem to be the ones in the wrong here. The police had arrested him purely based on the fact that their was a compliant made against him, without any other supporting evidence.

My sympathies to the poor girl. This is just a short time after the Danish rape.

I hope the police get hold of these people fast.
