There was a flame war in the chill thread and all violators received infractions. But he is banned because he had previous infractions which leads to ban when the number reaches 3.

That's indeed the case, but it was the first infraction he received after ban from me. So it's either that previous infractions hadn't been expired or other mods have issued new ones.
