If everyone in the three powers works honestly then all the three powers are a check for each others and therefore each power will work in a way that is good for the country.

But everything stops at IF.

The role of the Supreme Court is to safeguard the constitution. It has no executive powers. Now, the question is, how can it order the removal of the Prime Minister?

I say, a bad precedent

Not at all Parliament is supreme and the power has been bestowed on it by the people that is what gives parliament the right to frame the constitution and in that constitution if we have a separation of powers then all institutions must play their part.

If there are some bleating here about judicial overreach then the constitution also provides for that. If those that complain can muster a 2/3 majority in both houses then they can change the constitution.

Parliament can make a law. They can pass a law to state that a PM can be felon and the Justices would have to interpret that in that manner.

This is the best thing that could happen in Pakistan. lets hope all institutions play the role allotted to them by the constitution

Throw him in jail if it is confirmed he has been killing Pakistani people without giving them their right to trial.

So how do you think they can enforce law on a people who dont recognize Pakistan and dont have any respect for Pakistani law?

In situation where BLA is firing upon soldiers from mountain tops,what the soldiers are supposed to do? Its impossible to go and arrest them,but its possible to call in a a helicopter strike or fire back at the attackers..
In the process if the attackers get killed,how that can be illegal?

Supreme court is taking side with terrorists...

CJ must hang him! and Military should support CJ Decision if its true!

Interesting line of thought. But when USA takes this line of thought wrt drone strikes, you guys cry foul.. A little bit of double standards, it seems...

USA has no jurisdiction in Pakistani borders,Pakistan army has.
So there is the difference genius.
 
The SC can take suo moto notice of things that go wrong beyond a point.

We are liveing in an era where the judiciary is increasingly taking over the role of the executive - not without sufficient reason though.

You a forgetting one thing, We are an Islamic country and have islamic oriented constituion and in Islam Judiciary is supreme, not the parliament.

Then whats the use of people elects?

In international law it is common for legitimacy to be derived from the people in the form of elections etc

The constitution should and allows for differing views and what to do in case of disagreements there are procedures.
 
Oh i kinda hate the fuss this stupid Chief Justice (on the payroll of American Embassy) loves to create every now and then. He let Zardari rule for 5 years, never hanged a single terrorists in 10 years, did not pass any judgment over the karachi terrorists where he himself admitted that all political parties are involved in karachi terrorism, and still people have expectations from him. If anyone, it should be Chief Justice who should be stripped down of his seat for fooling the under-educated nation for 3 years.
