Supreme Court Pakistan and COAS Bajwa Extension: News & Discussions

Establishment or the state is not one person, in pakistan case establishment is Pindi boyS not a pindi boy. The little fight is within, it should settle in a few days Or maybe new year new start..
The ‘Pindi boys’ don’t have the ability to undermine the COAS. The Army has a very strong internal check on personnel acting out of line. Do you really think that MI & ISI can identify spies but cannot identify individuals working to undermine the Chief?

Embarrassing, everything is so embarrassing. We never learn do we.
Until we have reforms in our law schools and higher standards for those practicing law (the lawyers), we’ll keep getting poor quality judges.

.
COAS should decline the extension now for the sake of his institution, for the sake of his self-respect and for the sake of constitution.

I'm not talking about the judiciary here. No person above the institution.

A far larger game is being played, in my view, than what appears to the eyes. Criminal mafia is again gaining strength, day by day, and the downfall of IK has started, apparently.

where is constitution it is written that a COAS tenure cannot be extended?

It’s Pakistan - what do you think would have happened when a new COAS came in? Rumor mongering and speculation galore that ‘new COAS will get rid of PTI government’. The decision to give an extension was more from the perspective of political stability and to end rumor mongering in the media when a new COAS took charge.

In any case, this is the governments prerogative. The SC perhaps can argue that the notification did not follow the proper process but at the end of the day if the SC refuses to allow extension it will be a gross interference of the court in an elected government’s affairs.

Khosa has needlessly started a controversy in his last days as CJ & tarnished his legacy.

On the other hand, no one should complain that the courts are ‘under Establishment influence’ any more.

This.

Also not to mention, one can't have it both ways. To avoid matters say its parliament or executive decision, parliament is supreme this and that and then in certain cases get involved questioning the people chosen by & among the same parliament.

If COAS extension matter is decided by court, then tomorrow people will expect court to also make decision regarding 18th amendment and many other such crucial matters, and not hide with excuses then.

It was mistake to let the current system go on as it is and not have brought massive change to start with. Although one can argue that hands were already bound with razor thin majority.
But yes, sadly the truth is, a criminal (status quo representative) can leave in broad daylight. "Law" is only for rest of us..

On Paper yes, How kiyani undermined the King of Pakistan. The state finds a way, individuals come and go. On Paper Donald trump is the King of the world But in reality he cant put HC in a cell for a day. Even though calling her corrupt, responsible of bengazi etc In the UK we have something called the DLR, Self driving train. In my perspective it’s the best definition of a state, the PM/PresD is in the "driving seat" the people are passengers while the DLR/train in run by the TFL.

@Xestan

So here's what I understand:

1- PM sends summary to the Pres, but then they find out that they need to get the cabinet's approval. They send it back to the cabinet, when 11 people sign. According to rules, other absent members have 24 hours to submit their opinion on this, when it becomes 19. And unless the minister specifically says no, his vote is taken as a yes (CJP mentioned 11 people only). But then the summary does not go to the PM and President again. That's what the CJP says. The summary should have gone to PM and Pres again.

2- According to Army Rules, the word written is "suspension of retirement", not "extension in tenure" (which is now added by the cabinet). CJP says that unless the person has retired, then it cannot be suspended, since it hasn't taken place.

3- The career of Gen Bajwa has been extended as an officer of Pak Army. His retirement is being suspended. But the appointment of Gen Bajwa to the office of COAS is a question mark raised by the court. His tenure as COAS isn't being extended, but he is being re-appointed. So that is the bone of contention. It will be down to interpretation of law in the end.

Point 1 is valid. Couple this with the interview of Arif Alvi, this is a murky water. This government is new, so perhaps IK and others aren't well versed in the legal file work. But what the heck are the secretaries doing? Including the PS to PM Azam Khan? This is just technical and bureaucratic jumbo IMO.

Point 2 I believe is just posturing by the CJP.

Let's see what happens tomorrow, but I think it'll be sorted out.

They've got another agency for that!

Kiyani was COAS.

Pushing conspiracy theories isn't really helpful.

THe right hand of musharaf - But he knew his time had come. Even though he let a few screams/tears go but then eventually took the door out.

Kiyani was the face, the case was the state/pindi boys. The state finds its way.

What theories, its history.

RN - Bajwa and imran were batting and balling (on top taunting, we have the ball and bat, we have the ball and bat and.. some other things), a few "team" players were sitting on the boundary getting bored. Hey they also want to ball or bat, not fair.

We are supporting this government to fix our economy, when it can't even file proper legal work. What a joke......
