I went through most of the pages of the judgement. Three judges that ruled in favour of Nawaz Sharif.
EJAZ AFZAL KHAN, J Said:
In his judgement, he was firmly against using 62/63. He will not disqualify Nawaz Sharif come what may: he will send it to an Accountability Court. Unlike Justice Khosa, who thought that the Court must rise above technacilities, Justice Afzal Khan is of the view that even if the insititutions of Pakistan are corrupt, the Supreme Court should "go by the law and the book."
Justice Ijaz ul Ahsan said:
The JIT has not proved that Nawaz Sharif was the beneficial owner of the London flats. Therefore, he will not disqualify him outright.
Justice Azmat: I am unable to understand what his stance on the issue is going through his judgements. It seems he wants to refrain from using 62/63 but at the same time does not want the issue to stay unresolved.
Based on the above, and on the comments made by the judges during the hearing, it is safe to say that this will probably be going to a trial court. The JIT has not been able to prove any any dishonest action on behalf of Nawaz Sharif (even though everyone, even the judges, know he is a chor). This will go to an Accountability Court, under direction of the Supreme Court judges.
In my opinion, going by the book when the rest of the institutions are not doing their work is morally unacceptable. The Supreme Court needs to understand the circumstances and need justice to be seen.
