Panama Case: Joint Investigation Team probe

on another note
probably nisar saqib will be head of new bench,
while gulzar .n. khosa will be out
because of there dissenting note
another guy to watch is Justice Qazi Faez Isa

maybe the bench will be smaller then recent 5
keep close eye on 184/3
190
and 187/2
Wont make much sense to be honest. The same bench should be there. Two judges have already given there opinion, they might not be part of further procedure but there opinion will/must be counted. The remaining three will should look into JIT findings and then decide. Case closed.

A separate bench can be made to monitor JIT working however. I guess the talks of a new bench are regarding that!!

These 5 judges are the ones who have listened to the case, how can a new comer work as efficiently as they can.

There is one judge that may be retiring, i mentioned that he may be given some extra time due to close the case OR he may be replaced by one new judge.

@Farah Sohail lots of things happening here are unprecedented, given some extra months to a judge wont come as a surprise to me or may be he can be replaced by some new figure. However logically, the bulk of the bench should remain the same. It is these judges that think further probe is required, they asked for JIT, they have given it points to work on, IT SHOULD BE THEM TO DECIDE BASED ON THE FINDINGS OF JIT. I guess the talk of new bench is a confusion and it got mixed with a possible new bench or committee of SC to monitor JIT working. Findings should come to the members who requested it in the first place, not to some new comers. THAT WILL BE ABSURD. I hope Imran Khan also notes this and make sure that this simple logic based procedure is followed. The opinion of two judges included.

@Baghial is saying tht Advocate is retiring in May 2018...? Now I am confused.. I think I read tht he is returing in one two months time...or maybe I misread the year... Dont know...

However if he is really retiring in 2018.. Then its a good news for us..... Because it will mean ..tht there are many chances ..tht this whole same bench will hear the case at the end..as Justice Wajihuddin and Zafar Ali Shah say.. They say tht new bench will be ..for monitoring the JIT only..and after JIT completes its findings..it will come before the same panama bench..

I dont know..tht when will we be clear abt this? When will SC clarify abt new bench or same bench..hearing in the end? Will we have to wait for 60 days...when JIT completes its work..after tht only..we will come to know..tht whether same bench will hear the case or not? Or when SC finalises the JIT members..will SC ..at tht time...give further guidelines...on what will be the future course of action of SC..in this case?

One more thing, I want to know.. If anyone can clarify this...

Theres a story in Express tribune today..tht PML N is thinking for review.. Their POV is tht, judges have given strong observations against sharif family..(i think they maybe referring to J Khosa) ..so when SC has given such observations..how will JIT work independently? Their opinion will be biased due to SC observations..so PML N is thinking to review

I know for a fact..tht PML N knows.tht review ka koi faida nahi hoga.. Review will 100% be dismissed.. PML N knows this...as its scope is very limited... However...if they still go for review,,,then it will be only for ONE REASON..and tht is dealting tactics.. They probably want to delay the process of JIT..so tht JIT doesnt start its work..aur kafi time review main hi nahi nikal jaye..which eventually wil be dismissed..

So My question is... If PML N goes for review..kiya SC ka jo faisla hai..jab tak review par decision nahi hojaata..tab tak SC ka faisla....ruk jaayega ga..implement honay se?? Kiya JIT us waqt tak apna kaam start nahi karsakay gi..jab tak review petition ka faisla nahi ho jaata?? Ya aisa bhi hosakta hai ke JIT bhi saath saath kaam karay aur review petition bhi suni jaaye? But if their main plea..is tht ke JIT wont be independent...after observations of SC judges...tab tu mera khyal hai ke jab tak review ka decision nahi aajata...JIT apna kaam start nahi karay gi? What do u all think abt it???? @PakSword @Guvera @Arsalan @Baghial @QatariPrince

Agar aisa hua ke jab tak review petition ka decision nahi hojata...tab tak JIT apna kaam start nahi karay gi,,,which is more likely..tu yeh sirf PML N ki delaying tactics hongi...to delay this as much as possible...and stretch this till 2018 elections? Because they know fully well...ke review ka koi faida nahi hoga

55 percent respondents to a survey on the Panama case believe that the verdict was in favour of the Prime Minister while only 14 percent believe it was against him, the recent research revealed.

The Supreme Court Announced its verdict on the Panama Papers case on April 20.

G2.jpg

It announced a Joint Investigation Team would be formed to further probe the involvement of Sharif family in the Panama Gate scandal.

Two of the judges of the bench were in favour of de-notifying the prime minister, while three others suggested a JIT be formed.

Declaring the Panama verdict a victory for the party, PM’s daughter Maryam Nawaz said the petitioners had failed to prove any of their allegations and shared pictures of the celebratory atmosphere at the PML-N camp on Twitter.

PTI chief Imran Khan called for Prime Minister Nawaz Sharif to step down until an investigation team ordered by the Supreme Court completed its probe.

Terming the apex court’s verdict "a historic judgment in Pakistan's history", he told reporters on Thursday that all five members of the bench had rejected PM's explanation into his source of income and money trail that led to his children's offshore holdings.

That is what i have been saying as this makes sense. A separate body to monitor JIT but the final findings should be presented to those who actually ASKED for them in the first place and then they can decide. A new panel means back to square one. Also the two judges who are already convinced that NS is not eligible for the office may not be required to be part of that bench. There vote is already on record and accounted for. However they being part of that process conclude it officially will also be appropriate.

AND

Review ka NS ko koi faida nai, just delaying tactics. That also shows that PMLN is far from happy or satisfied from the verdict. This should not be if they have any little common sense.

See this @PakSword this is the perception that needs to be changed. This is what PMLN wanted by staging that drama of celebrations and were quite successful in that. Even our educated and well informed members here on the forum were quite pissed and it took some time to realize that the only possible summary of the verdict is:

  1. Two judges think NS is a dishonest man and is involved in corruption and must be disqualified
  2. Three judges think that NS have not been able to provide ANY justification of the properties and have been misguiding the nation but the matter need further investigation so that the case can be resolved meeting all the requirements of justice system. For that, the want a team to further probe into the matter
With no single entity endorsing NS's BS claims, it is absolutely not in favor of PMLN at all.

If PML N goes for review...on Justice Khosa's remarks...will JIT stop working..until decision of review petition comes???

I want this mayter to be over..within 60 days, even it it means getting clean chit for PM NAwaz... But seems PML N will employ delaying tactics...

Yes, you are right.. It is a delaying tactic and in my opinion, the JIT will not function. Why? Because PMLN is saying that the words used in the verdict may impact the objectivity of JIT members..

2018 ke elections ki tayyari karain..

Jitna main soch rahi hun..mujhe Justice Khosa aur Justice Gulzar ka wisdom samajh aaraha hai.. They knew...all this will happen with this so called JIT..and hence gave their final verdict of disqualifications...

Waisy 2018 elections ka tu wait kar hi lein ge.. Pehle dawn leaks ki report ko celebrate karein ...

What Justice Khosa and Justice Julzar have done in this judgement must be scaring the heck out of the corrupt elite - and what they've said has become part of law as well. Judges with these views, you can imagine what will happen to the less powerful amongst the corrupt in coming years when these judges are CJs!!!

Neutralise the head(s) of the mafia first and foremost, and the rest become easy pickings.

Things are moving in the right direction.

Aagaee kia maidan main? KSA ka buhat bara kirdar hai baji ko bachanay main..

Lagg tu aisay hi raha hai.. Har tv channel par aaraha hai.... ... Matlab officially release nahi hui hai..lekin findings aa agayi hain.. Report PM tak pohanch chuki hai.. PM ki Tariq Fatmi se aaj mulaqat bhi hui hai...

Kisi ka bhi kirdar ho...... Main tu pehle hi din se keh rahi thee ke yehi hoga

The more i think abt it...the more I want to praise these two honorable judges.... I wish..tht I could meet them..once in my life

However..unfortunately...ppl with such views are very few in our judiciary and our country as a whole..and we know..in courts.....its the decision of the majority tht is implemented.. And even being head of the bench or CJ doesnt matter.. Everyone's views hold equal weight..just as Justice Khosa's view in this case didnt matter...practically

Theres one other bad news too.... Justice Khosa will be Chief Justice for only 11 months... Its too short a time, to be able to implement procedural reforms in judiciary

But again, I will say... I have immense respect for these two judges...for their courage and integrity... I have become their fan, for life..for challenging a sitting PM, or in their own words, a GODFATHER

Abb Baja aur Baji ko Kings aur Prince itna pasand kartay hain tou PA kia karsakti hai? We are not independent in taking our own decisions.

True indeed.
Interesting times ahead. We should all do the best we can do individually and collectively. As i always say now, do remember that this struggle and the voice you raise is for the COUNTRY and the future of this nation. It is Pakistan vs The corrupt, never forget that and it will give you strength to stand up to it and never lose hope. That is what PMLN is desperately trying to do, to kill our hopes for a better Pakistan so we can remain there slaves for ever!! Just don't let it happen please. They have been quite successful lately but we need to challenge that mentality and reverse the effects for a prosperous Pakistan.
