Kashmiri Pandit body demands restoration of Article 370

When at school a learnt a story based around King Solomon..........

Two single mothers were sharing a room, and each gave birth to a baby boy at about the same time. During the night, one of the mothers had accidentally turned over and smothered her son. When she awoke early and saw her child was cold and still, the distraught woman took her roommate's sleeping baby to herself and laid her dead baby in its place. Later the other mother awoke, saw the dead baby, and began to wail with grief. But after examining the infant, she quickly realized that it was not her child. Across the room, she could see her roommate tightly clutching her baby.

Now both women stood before the king, tugging for possession of the living infant. "This child is mine!" one shouted.
"No, the dead baby was yours!" the other countered.

How would the king determine which was the true mother? Solomon interrupted their debate and told a guard to take a sword and divide the living infant in two. At first the soldier thought the king was jesting, but Solomon began to glare at the guard's hesitation. Slowly he drew his sharp, gleaming sword and made his way toward the woman holding the baby. Suddenly the true mother threw herself at the king's feet and pleaded,?"Let her have the child, but please do not slay it!" But the other woman said, "Let it be neither mine nor thine, but divide it." Now Solomon knew without a doubt who was the true mother.


In this scenario the baby is Kashmir. Anyone with any love for Kashmir and Kashmiri people would allow the fate be decided by Kashmiri people. Whether the people of the soil decide India or Pakistan i along with ANY Kashmiri people would be fine and dandy. Anyone who objects to this simply doesn't give a hoot about the people or the soil of Kashmir and would rather see it obliterated into fragments. They would rather the baby be slayed then allow the real Kashmir voice to be heard.

Even Indians do not accept Kashmiris as anything except Pakistanis, that is how they treat them.

In no way does it override the rights of residents of that part of the country.

There is no question of political correctness, just of legal rights and moral law.

But of course, that doesn't matter; you voted for the BJP.

Half of Kolkata's/Mumbai/Delhi/Bangalore population is not from there. So these migrants doesn't have right there?
I don't feel my rights are curbed in Kolkata. Why would the right of Kashmiris be curbed?
Why I being an Indian citizen not have right to buy a property in valleys of Kashmir to settle down.

Out of 6 constituencies 3 belongs to BJP. Technically half wants what BJP wants.

The lack of morality is in insisting on the Muslim majority in Kashmir being asked to do what you do not ask the Hindu Majority in Himachal or in Uttarakhand, or the Buddhist majority in Sikkim, or in Arunachal, or the Christian majority in Mizoram, or Meghalaya to do.

Do try to figure out where I'm coming from before bashing me up. That would save me from a lot of lumps from zealous young idiots (not you; I was looking to the left over your shoulder) who go off half-cocked.

He did not say anything inaccurate. That's india - a cowbelt brahmins will decide your eating habits, your spoken languages, rights of kashmiris. A bengali has no rights on bengal - the cowbelt will decide what to do with it. A tamil has no control of his destiny - INdia will decide for him.

Its you who keep this facade that india means something else than that .

Sir ask him to read more about article 371 and variius parts of it.

Article 371 – Maharashtra and Gujarat

Governors of the states of Maharashtra and Gujarat are given special responsibilities to set up development boards in regions such as Vidarbha, Marathwada, Kutchh etc.

Article 371A – Nagaland

Article 371A of the Constitution mainly states that no act of Parliament would apply to the state of Nagaland in matter relating to religious or social practices of Nagas, Naga customary law and procedure, administration of civil or criminal justice involving decisions according to Naga customary law and ownership and transfer of land and its resources. The Legislative Assembly of Nagaland must pass a resolution for an act to be applicable to the state.





The governor is given special responsibilities with respect to law and order in the state as well.

Article 371B – Assam

According to the special provision under Article 371B, the president may provide for the Constitution and functions of a committee of Legislative Assembly of the state consisting of members elected from the tribal areas of Assam.

Article 371C – Manipur

The special provision under Article 371C in the case of Manipur is similar to 371B for Assam. Here, too, the president may provide for the Constitution and functions of a committee of Legislative Assembly of the state, but consisting of members elected from the hill areas of Manipur.

The governor must submit an annual report to the president regarding the administration of hill areas as well.

Article 371D & E – Andhra Pradesh

Article 371D, which was added to the Constitution in 1974, provides equitable opportunities and facilities for the people of the state and safeguards their rights in matters of employment and education. The state government may organise civil posts or direct recruitment to posts in local cadre as required.

Article 371E states that the Parliament may by law provide for the establishment of a University in Andhra Pradesh.

Article 371F – Sikkim

Article 371F was incorporated into the Constitution in 1975. It states that the Legislative Assembly shall consist of not less than 30 members. In order to protect the rights and interests of the different sections of the population in the state of Sikkim, seats in the assembly are provided to people of these different sections.

Article 371G – Mizoram

The Legislative Assembly of the state of Mizoram must consist of not less than 40 members. In addition, following the same provisions as Nagaland, an act of Parliament would not apply to Mizoram in matters relating to religious or social practices of Mizo, Mizo customary law and procedure, administration of civil or criminal justice involving decisions according to Mizo customary law, ownership and transfer of land and its resources.

Article 371H – Arunachal Pradesh

The Legislative Assembly of the state of Mizoram must consist of not less than 30 members. The governor will have special responsibility with respect to law and order in the state.

Article 371I – Goa

The Legislative Assembly of the state of Goa must consist of not less than 30 members.

Article 371J

Article 371J grants special status to six backward districts of Hyderabad-Karnataka region. The special provision requires that a separate development board be established for these regions (similar to Maharashtra and Gujarat) and also ensures local reservation in education and government jobs.

You are a faculty of Nalsar. You know law better than me. Above is the law, no where its told that land can't be brought.

All of the above example including NE and HP you can buy urban properties.

Other than Nagaland and AP you can buy rural properties as well if you have a job/create job in those respective states. For Nagaland and AP not even everybody from the state itself can buy land everywhere just like the restriction in buying tribal lands of WB, JH, CH, MP. As we say ILP is getting eased in those states.

And for getting domicile there it's not that difficult, you don't have to wait 15 years.
This I am telling from my experience in working in real estate portal.

I just saw your post, and will look up the references in the statute-books relating to the other states tomorrow. Surely, running a real-estate portal, you must be aware of the restrictions on the acquisition of property in Himachal, for example, by non-residents of HP.

For HP anyone can buy property anywhere, you need to know the trick. And those who buys knows it.
Short, urban land within municipality if freehold, outside municipality you own the superstructure but land needs to be leased for 99 years just like Salt Lake. Agricultural land can not be bought according to books, but again there are ways out.
I worked with one of the leading real estate portal. But switched my job now.
