Iran to sue Russia for not delivering S-300 missile system: MP​

TEHRAN, Sept. 26 (Xinhua) -- The Iranian lawmaker Alaeddin Boroujerdi said Sunday that the country would sue Russia for the S- 300 missile deal if Russia fails to deliver the system to Iran, the semi-official ISNA news agency reported.

"The issue can be sued if Russia does not provide Iran with missile system and in such a case compensation should be paid to Iran," Chief of Iran's Parliament National Security and Foreign Policy Commission told reporters.

"We hope Russia abide by its commitments," Boroujerdi was quoted as saying.

Russia has scrapped plans to deliver S-300 air defense missile systems to Iran as they fall under the U.N. sanctions, Russian Chief of General Staff Nikolai Makarov said Wednesday.

The S-300 is an advanced mobile missile system which can shoot down aircraft and cruise missiles from up to 150 km away.

Iran inked a deal with Russia to purchase the S-300 weaponry systems in 2007, however Russia delayed the missiles' delivery. The United States and Israel have strongly opposed the sale of the missile to Iran.

I sometimes don't understand, what's reason for Russia changing its position?? Just because of Israel diplomatic meeting?

Last time, Russia said it is important to protect Iran in its interest...

Sanctions. They supported them. They passed. They banned weapons sells. Then Russia first put the order on hold to play it out as long as they could. Then finally they said nope we are not delivering the systems.(Israel talks could certainly play a role too) On a off note what happens when one country sues another country ? Does the U.N. deal with it ? Anyone know ?

It is not a matter of offense, in actuality the situation is indeed the same. From the Iranian perspective, Iran has contracted, paid and not received, hence has sued. It has a simplistic legal pinning which Iran is able to justify and hence it continues with it. The Iranian leadership has always stressed that is stands out for "the rights that it deserves" and so if there isn't action by Iran in this regard it would lead to a backlash domestically and within the leadership.

The involvement of the UN in a dispute between two nations generally depends on the nature of the dispute itself and the amount of consequences it may have for other vested parties/states.

Disputes with legal pinnings between two nations aren't in principle the subject matter for the UN. They remain between the two states.

The sales contract probably contains an arbitration clause specify where to resolve disputes.

If Iran is simply reimbursed of all expenses, then technically it can no longer lay claim if it accepts it but it isn't as simplistic as this because a dispute cannot simply be reversed and place the two parties/countries as if it hadn't even occurred. To point out a simple example, even if the political climate changes, in the Iranian perspective the goodwill attached to Russia as an arms supplier would still be very low at best.

Russia's S-300 missile system​

Russia's decision to ban the delivery of the sophisticated S-300 missile system to Iran will cost Moscow USD1 billion in revenues, a Russian official says.


Konstantin Kosachev, head of the foreign affairs committee of the Russian State Duma, told Russia Today that Moscow could end up paying a huge sum in compensation if Iran sues Russia and wins the case in court.

Moscow will suffer greater political loss if it delivers the S-300 system to Tehran, he added.

Kosachev said that any possible commercial loss for Russia was not comparable with political loss resulted from Russia's non-commitment to the non-proliferation regime, the UN or the Security Council.

After continuous delays and mixed signals regarding the delivery of the sophisticated S-300 missile system to Iran, Russian President Dmitry Medvedev issued a decree last Wednesday prohibiting the delivery of the missile system to Tehran.

Russia was required to provide Iran with at least five S-300 air-defense systems under a contract signed between the two countries in 2005.

Russia argued that the ban was justified under the UN Resolution 1929 against the Islamic Republic.

On June 9, the UN Security Council (UNSC) imposed fresh US-engineered sanctions against Iran over allegations that Tehran's nuclear program may include a hidden military application.

Iranian officials criticized Russia over the ban. Foreign Ministry Spokesman Ramin Mehmanparast warned Russia that siding with the US against Iran will harm Moscow's long-term interests.

"Russia's long-term interests will not be realized by getting engaged in US-sponsored games [against Iran]," Mehmanparast said in his weekly press conference Tuesday.

Mehmanparast said that the UN Resolution 1929 was itself "illicit and unjust," and that such defensive weapons did not fall under the resolution.
