Indian deputy consul general arrested in US on visa fraud charges

Nanny is probably declared absconding by Delhi court in September itself. WTH was NYPD thinking..? Arresting a high ranking Diplomat over the complain of a criminal...

It's unthinkable. West recently shows absolutely disregard to ethics and diplomatic law. I hope India will respond appropriately.

It used to be unthinkable, but in the last 3 years, this is the 3rd time senior Indian Diplomats has been targeted, harassed and humiliated by the US govt.

3 Times in 3 Years, must be some sort of Record. Did such a thing happen to Russian Ambassador in US during the Cold War ?

As far as I know - never. But a few monthes ago they beat and arested Russian diplomat in Netherlands.
But the most flagrant violation - when they forced to seat the number one plane with the President of Bolivia on board and in violation of all laws and regulations ransacked him.

she is a criminal work for the Indian government, you can take an Indian out of India but you can not take corruption out of the Indian, none big deal if she commit Visa fraud in India but she commit the crime in the US, she need to be jail like the all the criminal get caught in the US.

Sentence her 5 yrs in jail then ship her diplomacy a@@ back to India.

no diplomatic immunity if you commit crimes, India should have placed someone with integrity on the job but Indians and integrity is a misnomer

This incident just goes to show Indian blood is treated cheaper than sea water.

by that logic chinese blood must be cheap too !

HOUSTON — Three Houston police officers caused an international incident last weekend when they followed a Chinese diplomat into a parking garage at the Chinese Consulate and arrested him, injuring him in the process, the authorities said.

US want India in their camps.So their top secretaries regularly visit India in the name of bilateral co-operation.So far India maintained a good relation with USA ,but also keep a distance from them.They tried to make a feeling within Indians ,that they are friends of India.Fact is some Indian politicians in GOI and bureacrats also pro-US.But in reality most of Indians including politicians still see USA witha suspicious eyes.
This kind of action also underlined that.May be our governments response will wind up within this protest.But Indians that see this news will really hardened their suspicions against USA .After all USA will not get the same place of Russia in India.

No matter what USA does , it cannot replace the friendship of russia with india.Russia stayed with us all the way, we have a independent foreign policy which suits our nation.
This was the same USA which sent a US carrier fleet in 1971, if they were dead serious about stopping terror they would have asked pakistan to dismantle the terror camps from where India is attacked.

India, US fight over Devyani Khobragade's immunity - The Times of India


NEW DELHI: The diplomatic standoff with the US seemed to worsen on Saturday with the State Department declaring that the Indian diplomat, Devyani Khobragade, charged with visa fraud had no immunity under the Vienna Convention on Consular Relations (VCCR). India is looking upon this argument as a smokescreen created to obfuscate the issue.

It is learnt that India has conveyed to the US that the issue was not about immunity as much as it was about the violation of other norms laid out by the same Convention for treatment to consular officials faced with similar situations.

India has pointed to Article 41 (section 3) of VCCR (Personal Inviolability of Consular Officers) which clearly says that proceedings against a consular officer "shall be conducted with the respect due to him by reason of his official position". India has taken this up forcefully with the US saying that the action by law authorities was in complete violation of this Article and least expected from a friendly country.

The government has been stunned by the manner in which the 39-year-old Khobragade, a mother of two, was detained from near the school where her children are studying and how later she was handcuffed. As a consular official, Khobragade had certain privileges and limited immunity but not complete diplomatic immunity. Even if US authorities were within their rights to proceed against her, they had no business to humiliate her, India reasoned with American officials.

Khobragade's lawyer is insisting on consular immunity saying that the crime may not have been grave. Khobragade was released within two hours of her arrest which, according to legal experts, has rendered the grave crime argument put forward by US authorities hollow. Under the VCCR, a consular officer can be arrested only in the case of a "grave crime and pursuant to a decision by the competent judicial authority". Indian government too believes that this may not have been a case of grave crime.

The US has responded to summoning of its ambassador Nancy Powell here by declaring that she had no immunity under Vienna Convention on Consular Relations. Like what happened earlier with another diplomat Neena Malhotra, who faced similar charges, the Indian government has no option but to make itself a party in the case as it was responsible for reimbursement of Khobragade's babysitter Sangeeta Richard's salary and other expenses. Khobragade is accused of not paying Richard $ 4,500 per month as required under the US laws. However, if all other perks Richard enjoyed were to be monetized, the salary discrepancy wouldn't seem as glaring.

"Under the Vienna convention on consular relations, the Indian Deputy Consul General enjoys immunity from the jurisdiction of US courts only with respect to acts performed in the exercise of consular functions," said the State Department hours after foreign secretary Sujatha Singh registered a protest with Powell.

The US also expressed hope that its partnership with India will not be impacted by the case. "We are handling this incident through law enforcement channels. We have a long-standing partnership with India, and we expect that that partnership will continue," US State Department spokesperson was quoted as having said.
