This is not about veto, ICJ still have no say in our domestic and matters pertaining to security.

The jurisdiction has been established in this case already.
The ICJ heard the matter and delivered its judgment.
Its a fact.
Cant be denied.

Pakistan wrote a letter to india , to provide more details on this guy and india never replied to it ...

Military courts are legal in Pakistan on WOT ... we have already hanged alot of terrorist who were getting money from RAW. All terrorist cases are being handled by Military courts ...
Also Agents always travel on fake passports, if you know how they work..

If you ever read your constitutions then you will never ask this civilian courts. Go first check Indian law about spy and then we discussed
 
Article 94 of the United Nations Charter states that all the members of the United Nations have to comply with the ICJ decisions in the cases in which they are parties. Both the countries have signed and ratified this.
There is also an 'Optional Protocol' to the Vienna Convention on Consular Relations for the compulsory settlement of disputes. Both India and Pakistan are parties to this protocol too.

The court judgments in the contentious cases are final and without appeal, though there is no way ICJ can enforce its decisions. This is where United Nations Security Council comes in to picture. It can compel the states to follow the court’s ruling. But there are several problems with this method of enforcement.

First, a judgement against one of the five permanent council members or its ally countries can be vetoed by that member.
This happened in the Republic of Nicaragua vs The United States of America where the court decided in favor of Nicaragua and awarded reparations to Nicaragua. The US refused to participate in the proceedings and also blocked enforcement of the judgment by the United Nations Security Council.

China, a member of the Security Council, can veto the Jadhav case order in favour of Pakistan.

Second, the Security Council can always refuse to intervene and then there is no way to enforce the judgement.

Third, a coercive measure by the Security Council can be adopted only if international peace and security are at stake. The Security Council has never done that so far.

So in other words, Pakistan can choose to NOT COMPLY with ICJ decisions. And there is nothing India can do.

Bharatis as usual are high on emotion and not thinking logically. "The world has done this and that".. the usual bharati crap - no one outside bharat would really care if he was hanged. ICJ is routinely ignored and countries do not accept its jurisdiction. The ICJ verdict is non binding and Pakistan can use the same argument bharat uses to not conduct referendum in Kashmir to execute him.

Thanks to West Pakistanis wanting to save their skin in 1971 they signed "Shimla Agreement". That's the reason you have ur Pakistani families returned to you. And now you cant throw away an agreement as you wish.

Even God cant mediate btw us.

Nope. Pakistan doesn't need to since Pakistan was rejecting ICJ jurisdiction in this case. Learn more before further making a fool of yourself.

can some one answer me if kulbhushan was indeed involved in instigating terror attack in pak soil then why would India shoot its on foot by internationalizing the whole issue ...?its just PAK Intel trying to make sucker out of its populace for its failure to protect them against terror attacks , after Peshawar school attack questions were raised about efficiency of ISI/PA deep state , they needed a Boogieman ....

Haha.. either you deal bilateral matters without intervention or you accept intervention. There is one side which you can take.

India has already gone to ICJ, where 2008 agreement existed. Now when you'll point at Shimla agreement then we will still take you to a mediator because you've initiated it earlier.

Wait and see, this Kulbhushan will bless Pakistan will favours and more gains than Pakistan could pull on its own. We will thank India and Modi in particular for that ;)
 
Why Pakistani members are so concerned about the verdict and why sartaj ajiz is also clarifying verdict when Pakistan says ICJ has no jurisdiction.

This is ironic. So Pakistani members here are concerned about the verdict because it has jurisdiction.
 
Pakistani contingent was so stupid to not have seen this Indian judge and not request ICJ to exclude him from the bench. This indicates ill-intentions on part of Pakistani lawyers and raises suspicions if they deliberately allowed it to slip. Read the press-release, most of the venom against Pakistan came from this character.
