The ICJ is the primary judicial branch of the UNO, which is spearheaded by UNSC, each of whose members are empowered to exercise their VETO power.

So its not a violation per se.

Example: the High court is always overpowered by the Supreme court.

This is not about veto, ICJ still have no say in our domestic and matters pertaining to security.

What Vienna says about spies? As far as I know, same does not fall under such category. ICJ cannot use its power in case of KY against Pakistan.

Babar Awan has been crying that Pakistan should not have spoken a word other than challenging ICJ's jurisdiction on the matter. As per Pakistan's given (and ICJ's accepted framework), Pakistan is not obliged to accept ICJ on matters related to National Security.

So it's a non binding judgement? Then what's there to seriously worry about? That's the same argument bharat uses to not conduct referendum in Kashmir. Just chuck the judgement and that's it.

This part has to be proved against India . Until then he is innocent.

ICJ can only acquit him if it has any say in our National Security Matters. The execution of Kulbashan is only stayed on the basis of many other international politics and relations. For an easy understanding, ICJ actually provided the time for both parties to settle the matter but saying that it can acquit KY, is not possible under the law.

ICJ is routinely ignored and countries do not accept its jurisdiction. The ICJ verdict is non binding and Pakistan can use the same argument bharat uses to not conduct referendum in Kashmir to execute him.

The matter has not proceeded to that level yet but order only contains the details of arguments presented by both parties and KY's execution is being stayed. ICJ did not mention anywhere that Kulbashan is framed. Saying as such is like that India claimed Stay Order on the day when petition was submitted.

The case here is different. The point is Jadhav was denied consular access and also legal help and council to defend himself justly and properly. Moreover, the way and with secrecy the case was conducted through military courts raise lots of doubts.

First, military courts are legal courts. Second, they have sentences 100s of terrorists earlier and they will continue to operate doing the same. Third, Pakistan can deny India until they prove that Kulbhushan is their National or agree to cooperate with Pakistan by giving access to 13 Indians asked by Pakistan. As per 2008 agreement, counsellor access can be given if India cooperates. Its conditional.

Even if ICJ asks Pakistan to given counsellor access, Pakistan can still claim it is willing but as per agreement, India must cooperate with Pakistan first.
