Devyani Khobragade gets full diplomatic immunity after transfer

Outrage to the point downgrading ties with China? When did that happen? Nobody was asking for Chinese heads on a platter when an Indian diplomat got assaulted(in a court no less) to point of losing consciousness :

Indian diplomat attacked in court by Chinese traders

In Short, Dramabaazi to people who have the time to note said dramabaazi. You know very well how the Chinese would have reacted to a similar "diplomatic offensive."

To answer your other question:

To ensure diplomatic immunity, India shifts Khobragade to Permanent Mission in New York - Indian Express

Not really. Refer the quote above.

what is the source ?

UN is a sovereign body ... just like Edward snowden who is holed up in Equador embassy can't be touched ....Devyani Khobragade can't be touched inside premises of UN .

Shifting her to UN mission is an interim measure ....

This can be followed by subsequent measure such as promotion to ambassador to UN or any other such post which will give her full diplomatic immunity ...

US state department clearance would be necessary when person is yet to enter US ...
as UN headquarter is located in New York ....to get to UN you have to get into US ....

But for person who is already in New York such as Devyani Khobragade ...such clearance may not be required ....

Provide source to your quote, if you have one....thanks .

She is transferred to UN so that US can't contest again on diplomatic immunity. Its like creating layer of protocols to protect the subject in discussion.

And she is not a normal Indian citizen working in US, and the way she is treated was out of bounds. What's the point of strip search on visa fraud charge, which itself is under question ?

Also there is professional courtesy extended to these people.

I don't understand why NRIs are acting like its a normal routine. We all should stand beside her. Its about nation first. They even frisked our former President.

Guilty or not, US should apologize and return her, just like they got out Raymond Davis.

Mate - Why do you think she is not a normal Indian citizen especially when she is not accorded full diplomatic immunity until now? If so, why she needs to be treated differently than what the system warrants? For NRIs living in US, we feel comfortable that the system is more or less fair except for few aberrations. And why do you think we would want that system altered especially when we had seen what a This is nothing but the officer bending the rules for her personal convenience(and not for country) and trying to whip up patriotic ferver and jingoism.

And do understand that NRIs have our responsibility as well - We are the lobby projecting the Indian views here in US not unlike what many think - get the passport and get out of the country stuff. And I am not going to get caught in this jingoistic stuff.

well thing is if you try to humeleate indian diplomats be ready for the same treatment for your diplomats and nationals in india simple as that ...period

Actually I was kind of amazed to read about all the privileges US diplomats have in Delhi / India, although Indian politicians and VIPs are constantly harassed during their visits in the US, which obviously shows the lack of similar privileges for our side. So things have to change anyway, no matter on which side and it would be smarter for the US to change policies.

its time that india also does the same kind of treatment with unrueli and rash US diplomats if they are found in any sought of criminal or anty india activities in india and treat them the way we treat owr hardened criminals and send them to tihar jail for slightest of offences no bail until prooven innocent

They already vulnerable to Indian laws .since Indian government revoke all courtesies given to the
US diplomat.A small case enough for US diplomat.

She is not an NRI. She is there on a diplomatic passport, as an employee of the ministry of external affairs, paid for by the govt of India. She has partial immunity, though not a full one. If she is there on a diplomatic passport, and not on a regular Indian passport, then there are certain protocols that have to be followed.

BTW it is not just this lady who is bending that particular rule - embassy staff of at least a hundred other developing countries do so in the US, because nobody can pay their maids american wages, when they themselves get paid Indian wages. This is quite well known.

No source. I just made that all up to mess with you!!!
:P

However, the complication is that she would have to apply for a fresh diplomatic card through the UN Secretariat, which would ultimately go for clearance to the US State Department. Here is where the Indians are hoping that Washington will show some positive intent by issuing the card and, in doing so, extend full immunity to her.

If this process were to go through, sources said, it would ensure that Khobragade would not be subjected to any arrest or custodial interrogation in the future. The order, sources said, were issued on Tuesday night.

Lol. Now the "Sheriff of Wall Street" can be arraigned in a case of abetting Immigration Fraud and facilitating flight from due process of Law.

This is getting more exciting by the minute. Wonder whether Dept. of Justice will bother to investigate this too?

Its all happening in a Country (?Land of the Free, Land of the Brave?) that helped to create and facilitate and then finally shelter a Terrorist called David Coleman Headley aka Daood Gilani. Who ironically helped in the cold-blooded murder of American Citizens............

Some irony there too.

Hey dint you hear the NRI Amerekan ? you are a respected senior member and you should not say things like that. It makes his life there difficult when he goes for visa renewal and he would be forced to come back to India

According to some reports, India was busy arresting the nanny's husband and child. No wonder the nanny didn't want to come into contact with Indian officials and requested a NYPD escort.

As for absconding and Indian court injunctions against her, they can be ignored if the US authorities believe the nanny was fleeing indentured servitude and forced to work under conditions violating US labor laws. Once (if) she applied for asylum, the whole game changed.

P.S. I am not defending the diplomatic protocol violations. However, the question of who is the real victim in all this remains open.

If India was busy arresting maid's husband and child ....how did they get into US ???

what do you want to prove by typing 'child' in bold ???

Doesn't it show your inherent bias ???

Do you have any proof that India had arrested husband and child ....or you latched on one of the rumor floating ....to justify your rant against India ???

This is called as bigoted opportunism ....

Cherry picking are we??

Problems started with Richard, according to Dr Khobragade's lawsuit against her in the Delhi high court. It said that Richard wanted to work outside on her off days, but she was told that it was illegal according to her visa status, and also because she had an official passport.

You can say that it just an allegation by the diplomat.. But isnt it the same which is done by the maid also? It had not yet proved

What if the maid was doing all these for a US visa? May be she signed the agreement because she thought she can try for another job in US once she left the country..

This is the point most counter arguments have been sticking to, BUT, some leeway in diplomatic circles is allowed as part of mutual understanding. Similar to why US embassy in Delhi was provided extra barricades and gay partners being allowed.
US laws in application to foreign diplomats may sound ridiculous (like paying nanny more than her own wages), and are overlooked on a regular basis as part of privileges.

What US (or maybe hyper-activist Bharara), did here was to break that unwritten agreement and go for Khobragade.

That is why the State department is trying to shift blame to Marshals for the mistreatment.

Thats also why the GOI is furious, and if it comes down to applying the law, is threatening to arrest Gay partners since they dont enjoy full immunity either.

So is that any skin offa my back? The facts are facts; I live with them as will others have to.

And still US chose India over Pak LOL

They r facing the heat now......Pak made them what they r and pak has also forced them what they r today.....An Embarrassment to the planet Earth.

And, the cutomary pakistani enters, making a fool of himself with a meaningless jab. I was wondering why it took so long. What is it this time, that pakistan made america a superpower?

Actually don't bother replying. This is one thread that we dont want to be derailed with pakistani delusions.

US diplomats have faced far worse. We don't gauge our national prestige by how well our diplomats get treated overseas. Gosh Indians sure have their priorities all wrong :coffee:

If US diplomats have faced worse ...then blame it on hypocritical ,divisive and destructive , selfish , self obsessed US policies ....

Off course you can't gauge your national prestige by how well your diplomats are treated ...because at that rate you won't have any prestige left ....

Indians have their priorities all right ...which is why the whole world is condemning rash US action !!!
