The Patriot Act and ICE are authoritarian legislation and agencies.
Actually, there are this common mistake that Patriot Act trump people's constitution right. But actually, according to Mayfield vs US, while the appeal court initial judge that FISA (Foreign Intelligence Surveillance Act) was indeed against 4th Amendment, but a subsequent Appeal by the government at the same court overrule the previous ruling and found the case for the government, due to the fat that FISA only applies to non-US subject within the United States, and there could not be any surveillance material obtain thru FISA and used in any case against a US National, US legal resident and US corporation, and Mayfield have no standing in Federal Court.
The gist of the case is whether or not US Constitutional right were given in blanket to everyone within United States? Or the legal right only applies to US Subject within the United States? The government argue such right exist to protect US subject as intended, which is more inline with second amendment which give "Citizens" the right to bear arms, hence non-citizens does not enjoy the right to bear arms in the US, which mean a non-citizen would not have a legitimate reason to own a firearms in the US. So, if the 4th amendment do violate the right of a foreign citizen, so would the second amendment, and other amendment as well.
However, the 4th Amendment does not including nor excluding foreign person/corporation in the US, mostly because back in 1700s when the US constitution is written, the concept of "Foreign Subject" is not adapted and everyone live within the US are considered an US Subject. Hence you may say The Constitution did not "Specifically" guarantee foreign national any right in the US.
On the other hand, FISA have its own court which serve the same way local law enforcement obtain a warrant from a judge, which it used the same method to issue an warrant, the only different is that FISC would not issue the warrant in public due to national security concern, however, under Freedom of Information Act, one can request those document when the classified status run out.
I don't know what you are talking about on ICE, because ICE is an enforcement arm for border and immigration policy not a legislation...
