I want add this I hope you know this. Pakistan was created by the Lawyers of India and the now Bangladesh, of which I can state Bhutto was a barrister, Jinnah was a barrister and so many others, the lawyers of Pakistan are a important part of Pakistan. I just wanted to add this.

LAHORE: “We understand the law and practice it. Some of our judgments put us in a trying situation. Nations and states which are based on dictatorship instead of the supremacy of the constitution, the rule of law and protection of basic human rights are destroyed”. This has been stated by Chief Justice Iftikhar Muhammad Chaudhry in his address to Lahore High Court Bar reception after covering a distance in 25 hours continuously from Islamabad to Lahore on Sunday. Lahore Police deployed over 7800 police jawans in the provincial capital on the occasion of reception to keep a strict vigilance and security arrangements to deal with the situation efficiently. The Lahore High Court Bar reception was attended by thousands of lawyers, judges of the Lahore High Court, and scores of opposition activists outside on the streets. The address of Chief Justice was participated by 17 judges of Lahore High Court. The judges who participated in the address of chief justice included Justice Khawaja Muhammad Sharif, Justice Saqib Nisar, Justice Zahid Hussain, Justice Shahid Siddiqui, Justice Maulvi Anwar-ur-Haq, Justice Azmat Saeed, Justice Asif Khosa, Justice Umar Atar Bandial, Justice Najam-u-Zaman, Justice Sahir Ali, Justice Javed Sarfaraz, Justice Khalid Alwi, Justice Sheikh Hakim, Justice Jahangir Arshad, Justice Ijaz Ahmed Chaudhry, Justice Saeed Akthar and Mian Hamid Farooq. The topic of the chief justice speech was “Basic human rights and role of the Supreme Court. He also clarified that he would not mention his personal reference in his address but said that the campaign has been named “the supremacy of Constitution and rule of law.” The Chief Justice, while thanking the people for giving him warm welcome said, he has no affiliation with any political party and doing his job as a judge but despite it he was warmly received from Karachi to Peshawar which proved that people want rule of law and independence of judiciary He said basic human rights are a backbone in the formation of a civilized society, adding, articles 3 and 4 could not be suspended even during emergency. He said the human rights had a key position in the constitution, which in fact had the status of a backbone in any civilized society and the human rights and freedom were independent. About the arrested lawyers, the Chief Justice hoped that the courts would be doing justice with them. Justice Iftikhar Chaudhry thanked the media for giving a running coverage to the rally and told that if the media would have not given support, then such a massive gathering could not have been held. He also thanked the judges and the lawyers present in the reception. As a chief justice, he said, he had taken several suo motu actions on letters and applications dispatched by people and the burden of work did not came in his way in dispensation of justice. The chief justice said that Sardars, Wadera and bureaucrats, all were equal in front of law and no one was above law. He said there were two sections in the country; one that considers itself above law and the other does know the ABC of the law. “I have decided 6000 cases of human rights out of 12000 since I took charge as the Chief Justice of the Supreme Court,” he added. Chief Justice Iftikhar Muhammad Ch in his address said that under article 3, basic human rights were covered while under the article 4, every citizen has the right to get justice. Justice Iftikhar Chaudhry thanked the media for giving a running coverage to the rally. He said today is the era of communication, adding that after every moment the news are disseminated for which the credit goes to the media. He also called upon the lawyers to provide cooperation to the journalists. He said as the vehicle has two wheels similarly the bench and bar also the two vehicles of justice. He said the lawyers are lucky as they have available the office-bearers of Pakistan Bar Council and Supreme Court Association and they could take guidance from them. The Chief Justice said the success of every government depends on the upholding of Constitution and rule of law and the dictatorial form of government collapses and disintegrates the societies. The nations which do not believe in supremacy of Constitution could not survive. Earlier, the LHC Bar president, Ahsan Bhawan, addressing the reception said that the lawyers and the people from across the country were with the Chief Justice. He said that we were not struggling for any individual, but fighting a war for the freedom of judiciary. Later, LHC Bar president presented a resolution, which demanded withdrawal of reference against the chief justice, judiciary be allowed to work freely and with dignity, restoration of 1973 constitution in its original shape, allow the exiled leaders to come back to their homeland, hold elections by setting up a caretaker government and the army must go back to the barracks leaving the power. Barrister Aitzaz Ahsan, Counsel of Chief Justice Iftikhar Muhammad Chaudhry, has said that the warm welcome given to the Chief Justice from Islamabad to Lahore is a referendum against General Pervez Musharraf. Addressing a function of Lahore High Court Bar Association arranged in honour of the Chief Justice, he said the Chief Justice caravan reached Lahore in 25 hours and from Islamabad to Lahore he was warmly received which, he said, is the masses’ no trust in the Musharraf government. Aitzaz said the government takes out rallies and processions by asking the government employees but the masses participated in the Chief Justice rally according to their will as they were not forced. He said that from Tamizuddin Khan case to Zafar Ali Shah case the judiciary has always expressed its obedience and offered its services to the government but for the first time in the history of judiciary Chief Justice Iftikhar Muhammad Chaudhry has refused and did not bow before a dictator. He said due to the refusal he has been awarded warm welcome.

Dictatorship thing of the past: CJP

LAHORE: Chief Justice Iftikhar Muhammad Chaudhry on Sunday said history bore witness to the fact that nations and states founded on dictatorship instead of supremacy of constitution, rule of law and protection of fundamental rights faced destruction.

Addressing the Lahore High Court Bar Association, he said the era of dictatorship "is over and now it is a bitter chapter" from the past. "The nations which do not learn lessons from their past experiences and continue to repeat mistakes have to pay the price," he said.

The chief justice said the fundamental rights are protected in the Constitution of Pakistan. "Not only to the Pakistanis, but the Constitution also provided protection to all those who are living in the country. There is a detailed list of fundamental rights in the Constitution, while these rights are also discussed in the Articles 3 and 4 of the Constitution."

Justice Iftikhar said the Articles 3 and 4 could not be suspended even during emergency. He said the fundamental rights had a key position in the Constitution. "It is binding on the courts under Article 4 of the Constitution to maintain the rule of law, therefore, courts are bound to stop any act of administration and legislators against this principle."

The chief justice, in the start of his speech, thanked the bar for inviting him to address them. He also thanked the media for the coverage. He said the LHCBA's efforts for the rule of law and supremacy of Constitution had always been appreciated.

"The system of the rule of law is based upon this ideology and philosophy. Both the bar and the bench are dependent on each other. The courts cannot work in the right direction without the assistance of lawyers. Therefore, the bar and the bench are two main ingredients for administering justice to the people," he said.

Dilating on the importance of the fundamental rights, the CJP said fundamental rights were crucial for a civilised society. "The formation of a civilised society is not possible in the absence of the supremacy of the Constitution, rule of law or protection of fundamental rights."

He said the Supreme Court had analysed these rights and concluded that independence and fundamental rights were dependent on each other. In consonance with the spirit of democracy, he said, a system should be established in which the representatives of people should govern the state.

He said the fundamental rights formed an important part of the Constitution, therefore, the administration or the legislators could not promulgate any law against the fundamental rights. "The judiciary can also suspend such laws as are against the spirit of the Constitution," he said.

He said the Supreme Court had the right to take action under Article 184(3) and the high courts had this right under Article 199. He said he disposed of a number of cases in which he took suo motu notices after receipt of letters and applications dispatched to him by people. The burden of work did not come in his way in dispensation of justice, he added. "Even heavy backlog of cases could not stop me from disposing of cases, involving human rights," he said. "We cannot shut the doors for destitute people," he added.

The chief justice said they had provided justice in as many as 6,000 complaints in the cases of Zina (adultery/fornication), kidnap, honour killings, Vani, Sawara, misuse of authority, illegal arrests, privatisation, illegal allotment of government land, illegal possession by cops. He said they also took action against influential people in habeas corpus cases.

He said the apex court judges also reduced the backlog. All that was not against any personality or department, he said, adding: "These actions were taken for the welfare of the society and in the interest of the rule of law."

Earlier, addressing the lawyers, the counsel for the chief justice, Aitzaz Ahsan termed the journey of the chief justice from Islamabad to Lahore as a referendum (against the government). He said it was not a rally of the government in which employees of various departments were forced to participate. "In this rally have millions of people participated on their own," he added.

He welcomed the participation of 17 LHC judges in the reception besides praising Justice Jawad S Khawaja of the Lahore High Court for resigning from service in the wake of the judicial crisis. He also expressed gratitude to the judges of the Sindh High Court for attending the functions held for the CJP in Hyderabad and Sukkur.

LHCBA President Ahsan Bhoon said the days of the military government were numbered and shortly it would be no more. Pointing towards the lawyers and the general public, he said the people were fed-up with the illegal and unlawful acts of the government and would not bear them any longer. He called as state terrorism the police highhandedness against lawyers at different protest rallies.

Bhoon said the movement of lawyers would continue till the end of the military government. He said the nation by participating in that rally had proved that they were with the chief justice and "against the dictator".

He said the chief justice by taking firm stand against Musharraf had made lawyers to be proud of him. He urged the lawyers, political parties, civil society organisations and the people at large to participate in the movement for the rule of law and restoration of democracy. He said it was duty of every citizen to participate in this movement. Meanwhile, lawyers passed resolution condemning the government for allegedly blocking the telecast of different TV channels in different parts of the country.

HYDERABAD: Activists of the Jamaat-e-Islami (JI) staged a protest demonstration here on Sunday against the suspension of transmissions of three private television channels and blamed the Muttahida Qaumi Movement for depriving viewers in Hyderabad and other parts of Sindh from viewing live coverage of Chief Justice Iftikhar Muhammad Chaudhry’s visit to Lahore.

Carrying banners and placards and holding party flags, the JI activists gathered outside the Hyderabad press club and raised slogans against the Muttahida.

District President MMA Abdul Waheed Qureshi, JI Ameer Sheikh Shaukat Ali, Rao Masood Ali Khan and others addressed the gathering and condemned the Muttahida’s attitude, which they said was an attack on freedom of media.

They said the ruling parties were afraid of the courageous chief justice and added that the overwhelming welcome given to his caravan from Islamabad to Lahore was a referendum against his opponents. They demanded that attempts to gag the press should be stopped immediately and assured the television channels and the media community of their complete cooperation.

CJ Address

In our young days we were told that whatever a judge says becomes a law and can be quoted in support or against an issue in a court. And, the august Chief Justice of a country who is perse a law unto himself has said a lot during his address to the Lahore Bar Council. I have my obvious limitations of the knowledge of the law and as such will leave the legal aspects and overtones of his address to the jurists and legal experts, but what I could not comprehend was his remarks that the advancement of Science and Technology in a country depended upon the Supremacy of the Constitution, Independence of Judiciary, the Rule of Law and the dispensation of Justice etc. (words to that effect). When the CJ broached upon the matter of the advancement of Science and Technology in his address I thought he would say that it depended upon Higher Education, intensive and continuous R&D, economic condition of the country to make huge funds available for tests and trials, availability of capable, dedicated and selflessly hard working scientists (the like of late Dr. Abdus Salam Khan – the Nobel laureate) etc. What have the independence of judiciary and such like ideas to do with it? We all know the tremendous progress made by the USSR and China in the higher fields of atomic and space technologies and under what state of the independence of judiciary or the supremacy of the law then obtaining in their countries?!

Honourable, Sir, your every word counts. Kindly use them very judiciously.
