Chennai: German teen raped in moving train

This types of crimes happen in India frequently as it is an artificial creation and not a nation state.

Granted there were horrendous rape incidents like Delhi gang rape in India but the media(Indian media initially and nowadays Western media) has started to unfairly highlight these kinds of news beyond a reasonable level. Can't blame the Indian law enforcement agencies much as seen by the alacrity with which they have arrested the accused in the recent Danish woman rape incident in Delhi and here. Indian authorities need to step in to counter the propaganda while tightening up the prevention of these kinds of crimes by some means.

In most countries, rape stories are usually in the local news. Because that way makes the most sense.

Since of course it would be impractical to run every rape story at the national level, there are simply far too many occurrences in any given country to do something like that.

But the Indian media, for some strange reason wants the rape stories in India to not only be national news, but INTERNATIONAL news as well, since the international news will tend to follow the domestic news coming out of a country.

Very strange business strategy on their part. I'm sure they are making loads of profit in any case.

Lets not make these domestic civil issues into international issues.

Internationally the concern should be not weather a sexual assault had occurred on a train, but weather the judiciary is able to carry out the administration of the law, fairly and impartially.

From reading the first post, what I can gather is that

1. A compliant was made by the victim to have been raped by a person she traveled on the train with.

2. She states that she did not say anything while being raped because she was too scared.

3. The police made an arrest and a identification parade is pending.

From the facts that I can gather the police made that arrest without "reasonable cause". The police did not have reasonable cause to believe that the suspect had committed a sexual assault. All they had was the compliant of the victim, who under the view of the law is deemed an 'adverse witness'. There were no other witnesses to the alleged rape.

An 'adverse witness' is someone who has a nonaligned interest in terms of the Law. The interest of the Law is to have evidence brought against the accused and that evidence is fair and impartial. As she wants to see accused put in jail, she is not a a witness in which the law will give high regard to. The accused is also an adverse witness, as he has significant motive to lie about what happened in order to stay out of jail, his interest are also not aligned with that of the Law. The statements of both the accused and victim are to be taken with a heavy dose of salt.

In order to sustain a conviction of sexual assault the police need to prove two elements of the law.

A. The accused had penetrated the victim (penal- vaginal penetration).
B. The Victim did not consent to the sexual act.

Even if the police was able to prove that the part A.. The fact that she did not say anything casts serious doubt over part B.

When the media get involved and the police and judiciary isn't able to do its job properly, It is a recipe of injustice. We have seen this in cases in the United States, where innocent people were wrongly jailed over crimes they did not commit after a heat of media attention.

Lastly I'd like to say based on the above facts, it appears as if the accused is actually the victim of a police harassment. The police seem to be the ones in the wrong here. The police had arrested him purely based on the fact that their was a compliant made against him, without any other supporting evidence.

You are correct but for one simple fact.

In India, as per the law, the statement of the 'rape victim' (real or artificial) carries more weight than the statement of the accused and the accused can be arrested WITHOUT bail just based on the 'victims' statement.

And that is where the international concern should justly lie, not the fact that someone was raped.

Crimes occur everywhere, we cannot stop it. But we have to make the judiciary is in check, we shouldn't lower ourselfs to that of criminals and put innocent individuals in jail.

Benjamin Franklin originally stated "It's better to let 100 criminals go free than to convict one innocent man."

That statement at it's core was meant to basically promote the idea that every person, even the guilty, deserves a fair trial.

Because defending even the guilty to our best ability keeps the system fair and honest, without it we loose all sense of judicial integrity.

You are absolutely correct. Unfortunately rape has become another media sensation in India after that Delhi incident both in Indian media and international. There are many countries with much worse rape statistics than India, many of those countries are developed western countries but we hardly get to hear about it. It's a crime you can't completely get rid of, like murder. The media will continue to sell rape stories as long it brings them money/viewership.

Female tourist should stay away from India, no point travel to India and risk to be rape in public.

In spite of all of this jealousy from some of our neighbours , Western women will continue to travel to India in millions just like 2013, unlike their countries. And this will last for a loooong time to come.

Yes and keep on getting molested by you guys. I guess its a win-win situation for you all.

Since India does not have the jury system, the law tries to compensate by introducing human elements into the cold logic of the law to provide Justice.

Thank God Indian Media doesn't get this idea till now, otherwise if every single murder in every single state made national news, people will think that Indians have no other job than to kill eachother.

That is true. I am sure that the UK and other Western countries have far higher instances of rape than India.

In Western countries, most rapes happen by men known to woman as free-mixing is so common in Western culture.

The issue with India is that the rapes that are being reported are of the really violent stranger rape, including gang rape.

India has a very strange rape phenomena that is probably found in very few countries in the world.

It is basically a campaign against Indian/Hindu culture. They have been targeting all Hindu figureheads too.
