For a spy or a mercenary it is reasonable to have a trial, even if they do not have the right to become a POW. For a person which has committed perfidy, You cannot trust that he wants to surrender. He still very much a military threat, and might have other means to kill.
Note that if You accept a surrender, then the new POW should face a trial. He cannot be killed after surrender.

To be honest after capture a mercenary have less right after capture than a person who did predify.

Attacking them from a civilian car, while dressed in civilian clothes, without any ensign
making it obvious that the attackers are combatants, is a war crime according to the Geneva Conventions.

You don’t get it.
The reasons there are rules that civilians may not attack soldiers is not to protect the soldiers but to protect other civilians.
If the rules are followed, soldiers do not have to treat civilians with suspicion.
If the rules are not followed, the soldiers will have judge whether a person appearing to be a civilian is a military threat or not.
A civilian acting in a strange way may be killed, and the cause will be this crime.

Israeli forces in Palestinian land erect checkpoints, then open fire on Palestinian family in car because they didn't 'listen to instructions' of Israeli forces. Reality is they couldn't see well but still stopped after they realized what was there, but still got shot at, driver and apparently his wife are injured. Photos of car:

Now they are supposedly going to investigate this incident, but that won't bring anyones life back. They are changing the story and claiming the driver accidentally entered checkpoint area . So they restrict their freedom of movement then open fire on them for entering checkpoints erected all over the place that you are not aware of.

That would be true regardless of whether the soldiers involved were Israeli or some other nationality. People run roadblocks and sometimes officers of the law or soldiers shoot and kill: it may be the right thing to do or it may be an error but it isn't necessarily a crime for them to do so.

Israel is indeed an island of law in a wilderness of authoritarianism and dictatorship.
