18-yr-old Chinese young man who gets life sentence for buying replica guns online shouts in court:“See if you canshoot me with the guns I bought!”
The fate of Liu Dawei that would lead him to a life sentence conviction began on July, 2014. Then 18-year-old, gun enthusiast Liu placed an online order to purchase 24 replicafirearms from a Taiwanese website at a cost of 30,540 yuan (around 4602.07 USD). Buthis parcel never arrived at his home in Quanzhou, southeast China’s Fujian province. Twomonths later, on September 29, 2014, Liu was arrested for arm trafficking. Police haveidentified 20 out of the 24 “replica guns” as real guns. On April 30, 2015, Liu has beensentenced to life imprisonment. In the courtroom, Liu Dawei yelled out at the top of hislungs, “Please shoot me with the guns I bought! I’ll admit guilty if I could be killed!”

The judge evoked Article 151 of PRC Criminal Law: “Smuggling arms, ammunitions,nuclear materials, or counterfeit currency notes shall be sentenced to imprisonment ofover seven years, with a fine or forfeiture of property. Offenses of an extraordinarilyserious nature [...] should be punished with life imprisonment or death penalty, withforfeiture of property.” The judge said, based on the law, smuggling over 20 firearmsshould be given death sentence. However, the judge added that considering Liu’s youngage at the time when the crime was committed, the court thus handed down a life sentenceinstead. In Dawei’s defense, the reason why he bought such a large chunk of “replica guns”was that the Taiwanese online store would not accept an order under 20 pieces.
The crux of the controversy thus lies in the question of where a replica gun is counted as areal weapon on the spectrum. According to “Regulations on evaluating firearm andammunition performance by Public Security Organs” decreed in 2010, “[the object] shouldbe identified as a firearm when the kinetic energy of firearms muzzle is over 1.8 j/cm2.”

The terminologies in the definition may be obscure for most people who lack expertise inthe field. Liu Dawei’s lawyer used a metaphor to clarify, “We are sitting across the table,and I dash a handful of beans onto your face; the force of these beans would be about1.8j/cm2.” Similar standard in Hong Kong goes up to 7.077 j/cm2, and 20 k/cm2 inTaiwan. Even in mainland China, the number was set at 16j/cm2 before 2008.

Liu’s mother, who never thought she would ‘lose her son for a kind of toy he’s been playingwith since child,” said Dawei was ignorant to the existence of such a law. “Dawei neverknew such regulation before he was arrested,” said Liu’s mother.

Liu Dawei is not alone. There are more and more similar cases in recent years. Cai Xue’en,deputy to the National People’s Congress, said that there has been an increase of 30percent of similar cases in Hubei province alone after the new regulation in 2010.

There are efforts made in recent years, dedicating to raising the threshold of the definitionof firearm. There are reports submitted both in the Two Sessions and the National People’sCongress this year, appealing for an amendment in the appraisal of replica guns. Thoseappraisal standards that “go against scientific recognition and common sense” should bestopped, said Zhu Zhengfu, a deputy in the Two Session this year.

There perhaps still is hope for a turnaround in Liu Dawei's case. On April 11, 2016, HigherPeople’s Court of Fujian Province has accepted Liu Dawei’s appeal. Liu and his family arenow eagerly waiting for the final results.

America is a country with its own crazy gun rules

In most states, you can easily buy guns in the local gun show/market.

In the recent Republican National Convention in Cleveland, Ohio you can bring your guns along but you cannot bring tennis balls.

WTF? I almost fell off my chair and :rofl:.

The gun lobby is pretty strong in America, the gun laws are not going to change any time soon.

We are happy for America to be No,1 with their guns. I don't think any other country is interested in challenging for this title.

What was his original intention? For collection?
I hope his appeal could be successful when the story has been already revealed to the public.
Guns have no room in China. If found guilty with dangerous intention, death penalty pls, age is not an excuse.
If his intention is found not harmful in the appeal, then life-sentence is too harsh.

In the same time, regulations should not be eased under any circumstances.
I still wanna stay my current way of life, walking out safely at 2am to have some BBQ on the street.
No gunfire, no drunken dude, no harassment to girls wearing shorts, safe as in the daytime!

There must be something which go a lot deeper than what's reported that leads to his predicament and then the people are using the "age" + the seemingly "confiscation of toy guns" to try to sensationalise the issue
It said there has been a growing trend of possessing toy guns in Hebei alone in recent years and it seems the trend doesnt go down despite the law So the "life" verdict for the boy this time. No mercy. I am sure when the legislators and enforcement agencies have seen a comfortable abatement of the cases of violation, the boy will get a huge reduction of his sentence and even a parole

it is a tragedy.He can buy only one gun,then he would not be judged "smuggling arms."
But he actually bought 24 guns.Somebody may use below to argue against me.

His father and mother are farmers,Dawei Liu ever worked in a factory which is far away from his hometown.
If you are a person who knows China,you then can know that "30000 yuan" is not just a pocket money for Dawei liu.
His family might have far more money than "30000 yuan",but they will not spend "30000 yuan" on toys just for fun.
On the other hand,even if "Taiwanese online store would not accept an order under 20 pieces." is true,then why did Dawei liu buy 24 pieces not 20 pieces?
it is just against common sense.

This is far, far too harsh.

To land a life sentence at the age of 18 for a crime as this is cruel.
punishment is indeed harsh but he did break the law. Its not one or two guns but 20 which is enuf to start a terror attack of big magnitude.

ppl sentenced to life imprisonment do come out early if they show repentance and good behavior. Life imprisonment more than being punishment is a deterrence.

In America, gun is very useful, you know. White and Black both need guns to protect themselves.
Who I hould aim at, if I had a gun in China? Nobody, we are all brothers.
i just can't wait to see in 2050, when the majority of that society changes, way more massive racial riots will happen anywhere. Let them just buy more guns!
