Might is always right ; this is what History teaches you

I really deplore your answer.

It displays laziness and unwillingness to look into the records and annals to determine the correct situation.

I am particularly unhappy that the several times that i have written on this set of issues has seemingly had no impact on those who were members at that time.

This is very saddening.

Are you aware how many times I have written on this precise set of issues on PDF? Are you sure you want me to go through it for one more time? Will you guarantee that I will not have to answer these questions every six months, with every crop of new members?

Do you still insist that I continue, before you have consulted the archived material?
My apologies as I did not know that you have answered these before. I will try and look for them, if there are queries then I shall definitely contact you.

Then what is the Legal procedure that they follow

How about you check for yourself? Hint: Ranbir Code.

My apologies as I did not know that you have answered these before. I will try and look for them, if there are queries then I shall definitely contact you.

That was polite and nicely put. If you find it difficult to trace those, I will definitely clear your doubts. Please do not hesitate to ask; I am delighted to receive and answer genuine questions, and your attitude clearly shows that you are asking about these as being anomalous.

Happy hunting, but don't take too much time; the material is fresh in my mind, and I am not always a crotchety old curmudgeon :p:

As far as I know the Article 370 has been totally diluted post 1953

That is why PDP and NC demand restoration of Pre 1953 status

As Shahid Afridi famously said, Indians are chhote dil waaley.

So dont be surprised. We will kill anyone who dreams of breaking up our country. We won't count the bodies. If it means killing each n every jihadi supporter, WE WILL DO IT.
Shameful attitude

By your defination
starting from Gandhi and Nehru, Bhagat Singh and all other alike, all your Indian Army and Mukti Jodhas of 1971 war.. all are criminals.
Accept it and debate is over.
I will accept all Kashmiris as traitors, terrorist and criminals right now

Not at all. Please try to understand.

Gandhi, Nehru and Bhagat Singh all understood that they were breaking the law, whether occupying nation's law or any other did not matter, they realised and acknowledged that they were breaking the law. You may read Gandhi's repeated explanations at various times during various trials acknowledging guilt, and explaining his helplessness in breaking the law in order to move for his country's independence.

It was not right to break the laws, it was done to tell the British that their rule was unacceptable, but it was never done with the intention of overthrowing the rule of law.

I would like you to read about the precise circumstances of Bhagat Singh's action, and his standing still, shunning escape or any kind of self-defence, and surrendering to the officers of the law. I would also like you to read his writings during this period, when he explained his decision to break the law and its political context, in effect making sure that nobody thought that he had any criminal motive.

Like Gandhi and Nehru, he, too, paid the price demanded by the law for disobedience of the laws.

I doubt that you knew this.

Going on to the Indian Army, it acted AFTER hostilities began, so why you think what you think is not clear to me.

As far as the Mukti Bahini are concerned, it is not for me to defend them. They have their own defenders, the people of Bangladesh, who will tell you what is or is not criminal behaviour. Not my country, not my soldiers, not my freedom fighters.

I hope that this helps you to understand the radical difference between the cases.

Something puzzles me.

Why do you think you need to accept all Kashmiris as traitors, terrorists or criminals? Is that something required of you by someone? Anyone?

Have you some preconceived notions in your mind?

The connection being? It seems that an essential knowledge of Article 370 is needed.

Shameful attitude

This is the need of the hour to face crazy Islamists and crocodile tears of Pakistan.

I wish you would both of you please keep your tempers and remain polite with each other. What a strange way to interact!
@Soulspeek this is strange language.

The only important part of Article 370 that remains is that Other Indians cannot settle down in Kashmir

After 1953 ; Article 370 was diluted to extend and implement the Writ of the Central Government
and Parliament

If you don't follow law of the land you are liable to get shot

Which law you are talking about? You forcefully occupy a land and impose your laws on them and then ask them to follow it? Not fighting for their freedom? Han?
And you call them terrorists? Then those who support/supported Khalistan movement were also terrorists?
Lost of 30 lives don't even seem any problem to you people

<sigh>

It's not so simple.

On the one hand, the Constitution of Jammu and Kashmir clearly stipulates that laws proposed by the Indian parliament will have no effect in Kashmir, unless and until ratified by the J&K Assembly.

Article 370 was never diluted. First, it says that there will be no movement of subjects from the concurrent and State lists to the Central list without the concurrence of the state legislature; second, there is some sort of protection from routine legislature, I forget what it was.

The central government amended the Kashmiri legal system a number of times after the promulgation of the Kashmir constitution; this was done by ordinance, IIRC.
