US 'heartened' at India gang rape case verdict

yes... it means every case where rape actually happened.. if proven guilty.. he will get death... issue is, the guy will try to kill the girl as it will reduce the chance of him being caught. In any case he is getting death, right?

also dont you think the punishment should be proportional to your crime, how can rape be same as murder?

For rape death sentence is proportionate, as justice delivered by Dehli High Court also.

If the perpetrator is proven guilty beyond any reasonable doubt or if he was to confess to the crime, then the punishment is death. Since cases of rape tend to be complex, the judge is allowed to give out other punishments deemed acceptable by society.

If a rapist kills the victim, then his punishment is obviously death.

In my opinion, if you are a rapist, you deserve death. Rape is an abhorrent crime, & it tends to cause tremendous trauma & stress for the victim. It's not just the victim that is affected by such crimes, other women will fear for their safety too. If that's not enough to justify the capital punishment, there have been cases where rapists serve their prison sentences & then terrorize their former victims & other women once released. That is unacceptable, it's better to give them the death penalty & finish them off.

@p(-)0ENiX .. either you are proven guilty of rape or not proven(innocent)... the level of proof requred could be different but how can judge punish somebody who is not proven (no matter how complex it might be)

One can give longer term punishment to repeat offender but it should always be less than murder otherwise it will incentivize murder after rape.

In cases of murder for instance, it is often difficult to prove the accused of being guilty beyond any reasonable doubt. When a criminal defense lawyer realizes that his or her client is guilty of murder, what they tend do is cause doubt within the case to prevent their client from receiving the death penalty or the maximum sentence. Those doubts reduce the sentence even if it's obvious that the accused is guilty. That is why in order for a capital punishment to be given out, the accused must be proven guilty beyond any reasonable doubt. The same applies to cases of rape, if you are guilty, the Islamic law requires the death penalty be given out.

One can give longer term punishment to repeat offender but it should always be less than murder otherwise it will incentivize murder after rape.

Giving the death penalty to convicted rapists is much better than putting other women in danger of being attacked. The death penalty does not incentivize murder after rape, it discourages the crime itself.

There is considerable misinterpretation of the sentence to suggest that India is now giving death sentences to rapists. Many have also been talking about this case being tried under the new tougher laws that came into force earlier this year. Both are wrong, you cannot try these chaps under a law that didn't exist when they committed a crime, though even under that law rapists don't get death penalty for rape alone, only applies if the victim dies. This particular case has been tried under section 302 - for murder. That is why the sentence of death has been given.

I was wondering about the same and have one question. What would have happened if she survived but becomes invalid and scarred for rest of her life??

But unlike U.S, women are not executed in India no matter how heinous their crime is.......
Indian women want the better side of 'Gender Equality'......

i was expecting such reaction from international media after such a landmark verdict in India, but what i do not expected that these international media will fail to recognised the impect and the potraite India in a grey shade insted of accepting that there are other countries who have rape as an epidamic in there and fail to recognised it.

Not very much. Under the old laws, the most that they could have been charged with would have been attempted murder but realistically, they probably would have got 7 years for rape & nothing more.

Good decision by India... A good rapist is a dead rapist. :tup:

They may not kill the woman, but they'll make her life a living hell, which is worse than death.

All the rapists around the world should face the same sentence to be a lesson for others with sick minds that women are not tools.
