Defending your airspace and committing an act of war is totally different. Defending own's airspace is a right for every country. If a foreign aircraft intrudes into a country, that country has the right to shoot it down. It is not considered an act of war

what if US considers it an act of war??

Regarding your other comments- USA is not fighting a loosing war..The meaning of victor has changed..The moment they drove the donkey riding Taliban to tora-bora, They had won the war...They could have carper bombed whole tora-bora and no one would have done a thing..Instead they decided to help Afghans to get rid of the menace named "taliban " and stayed..Thats only fault is that they wanted to change the lives of Afghans..

They were capturing photographs of killing zones where your rouge army killed thousands of Tamils and destroyed their villages/townships into dust.
