That's a mendacious argument, as there are many uninhabited islands in the world that are under clear sovereignty--or does China concede that the Spratly Islands do not belong to it, since they are uninhabited? Japan made legal claim to the island without protest from China from the period of 1895 to 1945, which was enough for the US.

As associated islands of Taiwan that was ceded to Japan by the Qing court in1895, China certainly would not protest Japan's claim to them. But the Japanese surrender, the Potsdam declaration, the Cairo declaration, and the Taipei treaty changed all that.

I am unfamiliar with the language that changed their status, can you please point me in the right direction? I re-read the Treaty of San Francisco and the China-Japan Peace Treaty and didn't see any language to that effect, so any insight you can provide would be appreciated.

China never participated in the San Francisco Peace Treaty, instead it was the Treaty of Taipei where the Treaty of Shimonoseki was formally nullified, hence the return of Taiwan and its associated islands, at least legally speaking.

China, as the treaty does not specify ROC but rather used the general term, China. And yes, Diaoyu island should be administered via Taiwan, and that the Beijing government will have no issue with.
