1 AUGUST 2016

Daily Press Briefing by the Office of the Spokesperson for the Secretary-General

Question: Yeah. I want to thank you very much on behalf of all the journalists here. We have a great opportunity. And my question is not directly related to what you said but it's still an ongoing thing. And it's regarding the Indian-occupied part of Kashmir, the disputed territory, the ongoing atrocities, people are being, you know, killed and there are a number of people who are being hidden [inaudible], what has the United Nations done specifically in this regard and what further United Nations can do, just to stop this act which right now is going on in the disputed territory of Kashmir?

Deputy Spokesman: Well, the United Nations has repeatedly, including just a few weeks ago, put out the message to both sides about the need for them to work constructively with each other on this issue. And we will continue to monitor the situation including, of course, through our monitoring group on the ground, UNMOGIP [United Nations Military Observers in India and Pakistan].

Question: Follow‑up: was the United Nations thing the UN rights are being violated right now in this disputed territory of Kashmir by Indian forces?

Deputy Spokesman: I would refer you to the work of our Human Rights colleagues in Geneva, but we have issued periodic communications on this. Yes, Masood?

Indian Media is claiming that this statement (the underlined part) by the Deputy Spokesperson has been "clarified" today by the Spokesperson.

Everyone knows the mandate of UNMOGIP. It's mentioned clearly on their website. And it has always been the same.

But look at the Indian Media, It is trying to give an impression as if the UN has backtracked on the role of its observers in Kashmir !!

What a bunch of clowns ... No wonder no one takes Indian Media seriously ...

Dujaric actually clarified and corrected spokesman Farhan Haq's(a pakistani citizen) earlier misinformed statement today:

On Tuesday, as a follow-up Dujarric was asked by a reporter why he gave the clarification about the limited role of the UNMOGIP. He said cryptically: "It needed to be said."
The implication appeared to be that the incidents within Kashmir are internal matters of India and, therefore, not under the purview of UNMOGIP that deals with border issues.

Earlier Haq had said, "The United Nations has repeatedly, including just a few weeks ago, put out the message to both sides about the need for them to work constructively with each other on this issue." Asked about "UN rights" being violated, Haq said: "I would refer you to the work of our Human Rights colleagues in Geneva, but we have issued periodic communications on this."

UNMOGIP Mandate

The first team of unarmed military observers, who eventually formed the nucleus of the United Nations Military Observer Group in India and Pakistan (UNMOGIP), arrived in the mission area in January 1949 to supervise, in the State of Jammu and Kashmir, the ceasefire between India and Pakistan; and to assist the Military Adviser to the United Nations Commission for India and Pakistan (UNCIP), established in 1948 by Security Council resolutions 39 (1948)

and 47 (1948)

.

Following the India-Pakistan hostilities at the end of 1971 and a subsequent ceasefire agreement of 17 December of that year, the tasks of UNMOGIP have been to observe, to the extent possible, developments pertaining to the strict observance of the ceasefire of 17 December 1971 and to report thereon to the Secretary-General.

Given the disagreement between India and Pakistan about UNMOGIP’s mandate and functions, the Secretary-General’s position has been that UNMOGIP can only be terminated by a decision of the Security Council. In the absence of such a decision, UNMOGIP has been maintained with those same arrangements since then.

Mandated to observe ceasefire of 17 Dec 1971 .... ONLY.

UN backtracks on role of its observers in Kashmir, says limited to LOC
Diplomacy, International, Kashmir, Security, South Asia August 2, 2016, 11:26 pm Daily World

United Nations, Aug 2 : The UN has backtracked on its assertion that it was monitoring the situation in Kashmir through the UN Military Observers Group in India and Pakistan (UNMOGIP), clarifying that the observers’ mission is limited to the line of control between Indian and Pakistani forces.

Secretary General Ban Ki-moon’s spokesperson Stephane Dujarric gave the clarification Tuesday at his daily media briefing.

Replying to a volley of questions on the Kashmir situation from visiting Pakistani journalists on Monday, deputy spokesperson Farhan Haq had said: “We will continue to monitor the situation including, of course, through our monitoring group on the ground, UNMOGIP.”

Haq had said, “The United Nations has repeatedly, including just a few weeks ago, put out the message to both sides about the need for them to work constructively with each other on this issue.” Asked about “UN rights” being violated, Haq said: “I would refer you to the work of our Human Rights colleagues in Geneva, but we have issued periodic communications on this.”

On Tuesday, as a follow-up Dujarric was asked by a reporter why he gave the clarification about the limited role of the UNMOGIP. He said cryptically: “It needed to be said.”

The implication appeared to be that the incidents within Kashmir are internal matters of India and, therefore, not under the purview of UNMOGIP that deals with border issues.

Dujarric faced several questions on why the UN was not more actively involved in the Kashmir issue, with the insinuation that there was “reluctance” to take it up.

Asked why the UN had not taken up the Kashmir issue as it had matters like the Cyprus dispute, he replied that Ban had had commented on the issue and added: “I will leave it to you analyse it.”

Asked again if Ban was “reluctant” to speak about the Kashmir developments, Dujarric said, “When questions arise, we offer comments.” He added, “I don’t agree that there is reluctance.”

UNMOGIP is not a peacekeeping operation but an observation mission with the limited mandate of observing the line of control and reporting back on situations involving the armed forces of the two countries.

India maintains that the UNMOGIP has been made irrelevant by the 1972 Simla Agreement between Prime Ministers Indira Gandhi and Zulfikar Ali Bhutto that acknowledges the Kashmir dispute as a bilateral issue. Pakistan’s Prime Minister Nawaz Sharif, on the other hand, has called for an expansion of the UNMOGIP and his country continues to file complaints with it about alleged Indian ceasefire violations.

In 2014, India asked the UNMOGIP to leave the government building it had provided the mission.

I dont understand how Pakistan can call it a UN Issue after it had signed the Simla Accord. Aren't Pakistanis backtracking on their own agreements?
the point is when one do human rights violations then comes the role of united nation human rights council...how can we stop india otherwise ?? going on a war again ? making our self supporters of which india calls( terrorists and u listen to them) which in fact are freedom fighters which is already happening ..the thing is when there are innocent human beings killed ,abused, raped, in masses than one should knock the door of security council and thus it doesnt remain a bilateral issue ...

Dujaric actually clarified and corrected spokesman Farhan Haq's(a pakistani citizen) earlier misinformed statement today:

Did you even bother to read what was posted ?

No one denied the Indian claim that a statement has been clarified.

The point is "clarification of a statement" is being presented as "UN backtracking on the role of its observers" by the sensationalist and jingoistic Indian Media.

Do You get it now, Genius ?

The UN did not backtrack on the role of its observers. It always has been the same.

A statement by a Deputy Spokesperson that caused some confusion was clarified the next day by the UN Spokesperson.
