UN asks India to repeal AFSPA


Strongly backing the Indian government’s stand on Maoist violence, the United Nations Special Rapporteur on extra-judicial, summary or arbitrary executions, Christof Heyns, has condemned the violence perpetrated by the rebels in India.

After a rigorous 12-day fact-finding visit, Heyns, who will submit a report of his findings to the UN Human Rights Council next year, criticised the Maoists for killing innocent civilians with brazen impunity.

"Deadly violence has been used by Maoists, insurgents and terrorists in India. The callous nature in which lives, often of innocent civilians, are taken by these non-state actors, need to be condemned strongly. The state has a right to defend itself against such aggression, provided, of course, it abides by the international standards in this regard. The state cannot adopt unlawful or unconstitutional means or create a vigilante force to counter such violence," Heyns told media here.

Heyns also urged India to scrap the controversial Armed Forces Special Powers Act (AFSPA), which gives security personnel sweeping powers to search, arrest or even shoot people.

"AFSPA -- continuously in force since 1958, different states have their own versions as well, as in these particular states that I have mentioned, the Northeast India and Jammu and Kashmir -- has become a symbol of excessive state power. I have heard extensive evidence of action taken under this law that resulted in innocent lives being lost, in Jammu and Kashmir and in Assam, where witnesses from neighbouring states also assembled. This law was described to be as hated by some of the people I spoke to, and a member of a state human rights commission called it draconian," Heyns said.

"A law such as AFSPA, in my view, has no role to play in a democracy and should be scrapped. The repeal of this law will not only bring domestic law more in line with international; standards, but also send out a powerful message that instead of a military approach, the government is committed to respect for the right to life of all people in the country under a ordinary law and order and human rights dispensation," Heyns added.

The anti-militancy law is presently enforced in Jammu and Kashmir and across northeastern India. Several human rights groups, activists and academics regard AFSPA as a draconian law which is not needed now as the scale of militancy has been reduced considerably in the recent past and the Army does not need those powers, which could be misused by it.

On the other hand, the Army authorities deny such charges, and say the legislation is essential to root out insurgents.


Guess now that the communist terrorists are dying and are getting extinct, anti-India players are losing sleep with using democracy as the shield-word. :angry:

Guess it is time to modify our democracy then.

Without AFSPA, the human rights groups and the NGOs will run amok bringing in unnecessary charges on the security forces and will try to demoralize them. I remember a situation in 1990s, when a S.P in Punjab police was hounded by these human rights groups for his alleged human rights violation while fighting terrorism under KPS Gill in 1980s. He committed suicide by falling across on the train.

Granted there are certain human rights violations but the security forces need to ensure that these are punished appropriately.

They can "ask" all they bloody like, it means NOTHING. US has been "asked" many a time to close down Guantanimo, 10 years later it is still there. UN is useless and outdated.

What is AFSPA ?????????

Its nothing but the simple police power given to the army.

For example: Police can search, seizure and arrest a person.

When in a insurgency hit conflict zone army or para military are provided with these power so that they can search terrorists, seize their weapons and arrest them.

Without them no one can act against terrorists.

So fancy pants, its just business pure business. :wave:

well it's not a big deal for our politicians...they know how to deal with it???...twist the rule and give it a new name so that public will think AFSPA is amended but ground reality remains the same....

we need development not brute force in those areas to get rid of these rebel groups once the development will start rebels will start disappearing...

but question remains same how is development possible without peace???? uhh just like chicken and egg problem

and in this whole violence it is the normal villager who is suffering the most of the pain....

Govt should repeal AFSPA from those areas where militancy is almost over but there should be a policy such that if situation again become bad then AFSPA could be implemented immediately without any delay.

What effect this UN statement will have on India? It's only for those consumers who think UN has the capacity to dictate terms with nations. In reality it doesn't work that way. If it did... 1948 resolution will not still be kissing the dust!! End of the day UN is the puppet of five, who just take turn in pulling the strings.
