There was a dustup between Great Wall of China tourists like these when a Canadian woman knocked down 70-year-old Cui Hongfang. The fall killed the Chinese woman, but no charges wil be filed.

A Canadian tourist who knocked over and killed a woman as she hurried down stairs at the Great Wall of China won't face criminal charges, police said.

The unidentified Canadian missed her step and accidentally fell into Cui Hongfang, 70, at the Mutianyu section of the tourist attraction Wednesday, reports Shanghaiist.

The septuagenarian, who was visiting the area with her family from Heilongjiang province, tumbled over.

She smashed her head on the side of the wall and fell down. She then died at the foot of the stairs.

After a police investigation, cops decided not to file criminal charges against the Canadian national.

She was due to fly back home Saturday but has reportedly remained in Beijing.

Beijing-based attorney Yi Shenghua said since Cui was 70, her general health would have been taken into account.

"The accident was unforeseeable since normally a person wouldn't die after being knocked down by a running person," Yi told AsiaOne.

Yi added that Cui's relatives may still ask for the evidence to be reviewed or could file a private prosecution.

God damn, Why this Canadian friend can exempt from the resultant of what she had done?! Although the tragedy could be called "accidental" but this Beech left without any hesitation, even she was laughing! Astounding! I profoundly hope she could think about the morality, which she needs to pay off.

This is true to an extent, but what would the charges be? Manslaughter? What would the charges have been if this had been a Chinese person?

China is suppose to be rule of law now, can't just charge someone with bogus claims. Like the no Chinese can enter sign in a store in Beijing, it's illegal in the US, but not so in China, since we have no anti discrimination laws.

Do we even have a law regarding a case like this?

in the US , negliance causing death?

or sue the family can sue the person in a civil case and get some money.

and yes, there are manslaughter and negligence laws.

That is the case, the discrimination is exists in China but ironically it is not like this in any other countries. Exempt foreigners , be brutal to compatriots

(ECNS) - A Canadian woman named Julie Fortin, who allegedly knocked over a 73-year-old Chinese tourist on the Great Wall, has been forbidden from leaving China, the Beijing Times reported Wednesday.

Beijing's Huairou County court initiated legal procedures to stop Fortin from leaving China, according to the report.

On April 8, Cui Hongfang died after hitting her head on a brick in the Great Wall. Cui was a tourist from Heilongjiang province in northeast China.

Local police ruled that it was an incident of negligence and refused to press charges against Fortin. However, Cui's family has filed a civil lawsuit and demanded compensation.

Fortin had a ticket to leave China on April 11 but remains grounded.

It's things like this that make foreigners not afraid of us even if someday when we have the mightiest military or the biggest economy in the world.

Our media is even worse.

But compare to other East Asian countries, we are a lot of better. And hopefully we won't allow ourselves to keep getting infected by the slave mentality from Taiwan and HK.

And remember during Chairman Mao's era, China was truly fearless despite being dirty and poor.

Putting aside the issue of nationality for one moment, you have to evaluate this incident from the legal facts alone, which is what the police are doing. Of course it is a tragedy when anyone dies unnecessarily but police have to evaluate if the Canadian tourist was being willfully reckless or intended to harm the old woman, which I guess they didn't believe she was. There are no reports the tourist was drunk or under the influence either. It's also a difficult matter of proving how much force the Canadian exerted that would have likely caused the death of a regular person. It seems that the deceased lady was very fragile to begin with and was more susceptible to injury and death than a regular person would have been, which is something the police have to take into consideration. I think at the worst, the tourist maybe guilty of involuntary manslaughter but it is very conceivable this could be ruled a tragic accident. In either case, I believe the old lady's family have a case to sue for damages but it of course in no way would bring her back to them. It is a sad case.

Make sure that we all understand the difference between criminal act and civil responsibility. The canadian is facing a law suit to pay for the consequence of her behaviour in the accident.
