Senate polls: PPP assures PDM parties of establishment’s neutrality

ISLAMABAD: The Pakistan People’s Party has assured the PML-N and other PDM parties that the establishment would remain neutral in the upcoming Senate elections.

Yousaf Raza Gillani’s nomination as the opposition’s consensus candidate from the federal capital is also the consequence of that assurance from the PPP. That is why the PPP’s former prime minister Raja Pervez Ashraf was the proposer while the PML-N’s ex-premier Shahid Khaqan Abbasi seconded the name of Gillani.

According to a PML-N MNA, who is otherwise known for his anti-establishment views, the PPP is convinced that the situation has changed and the establishment will not play any role in the forthcoming elections.

Perhaps that explains why Maryam Nawaz in her speech at the Wazirabad public rally on Monday said that the “selectors” have been forgiven. While addressing them as “meray pyaray selectors” (my dear selectors), she hoped that they would not repeat their past mistakes in future.

A day before this sudden change of heart for the selectors --who have been relentlessly criticised by Nawaz Sharif and Maryam in recent months – PML-N leader Rana Sanaullah talked about the withdrawal of the establishment’s backing to Prime Minister Imran Khan’s government. Sanaullah did not offer any further explanation for his observation.

The DG ISPR in one of his recent interactions with the media categorically denied that there are any behind-the-scenes contacts between the army and the political parties or their leaders. The military spokesman reiterated that the army has no role in politics and asked those talking about backdoor contacts between the army and political leaders to come up with evidence.
As for the upcoming Senate elections, the PDM parties have positive expectations from the establishment and they hope the institution will stay neutral during this important political event. According to a PDM leader, the ruling PTI is quite upset at the moment and fears losing its votes. For the same reason, it is said, the government is expecting the apex court to allow an open ballot in the Senate polls, which most legal experts argue cannot be allowed without a constitutional amendment. Even the ECP has categorically said that without amending the Constitution, balloting for the Senate elections would remain secret.

The Chief Election Commissioner, who was summoned by the Supreme Court on Tuesday, also told the apex court that the Senate elections are held via secret balloting as per Article 226 of the Constitution. When asked by the court what a secret ballot is, the CEC responded that a secret ballot is one where voters cannot be identified. He explained that there is a procedure for voting highlighted in the Election Act. He also clarified that that the ECP under the law cannot take action against candidates for voting for any candidate against the party line.

Senate elections: ECP kickstarts scrutiny of nomination papers

ISLAMABAD: The Election Commission of Pakistan (ECP) has started the scrutiny of nomination papers submitted by candidates for the March 3 Senate elections which will continue till tomorrow (Thursday).
A total of 170 candidates have filed their nomination papers with the ECP. These include 29 from Punjab, 39 from Sindh, 51 from Khyber Pakhtunkhwa, 41 from Balochistan and 10 from the federal capital.
PPP's Sherry Rehman's nomination papers were accepted for the general seat and Palwasha Khan's for the women's seat. The nomination papers of PPP's Saleem Mandviwala and Sadiq Memon have also been accepted.

Sindh Chief Minister Murad Ali Shah was at the Election Commission office along with PPP nominees Sherry Rehman, Palwasha Khan, Saleem Mandviwala, and other leaders contending for the upcoming senate Hussain Shah, Saeed Ghani, and others were also present at the ECP office.

Similarly, Finance Minister Abdul Hafeez Shaikh, Special Assistant to Prime Minister Dr Sania Nishtar, and MQM-P's Faisal Sabzwari's nomination papers have also been accepted. A code of conduct has been prepared by the ECP to ensure transparency in the Senate polls.It has to be followed by political parties, candidates, voters and election agents, read a statement issued by the commission.

ECP has invited political parties to consult on the code of conduct on February 22. A code of conduct for transparency in the Senate elections will be issued after consultation, the statement notified.

Meanwhile, the returning officer (RO) reserved the verdict in a plea filed by PTI seeking the rejection of the candidate papers of former prime minister Yusuf Raza Gilani. The RO was hearing a plea filed by PTI leader Fareed Rehman urging the ECP to reject the nomination papers of Gilani, the joint candidate of PDM from Islamabad, as he was convicted by the Supreme Court.

The hearing on Wednesday was held twice after the RO granted time to the PTI leader’s lawyer to come up with arguments. At the early morning hearing, the RO granted time to the PTI leader till 3pm to come up with arguments in the case.

When the PTI counsel sought extra time, it was opposed by Gilani’s lawyer. The former prime minister’s lawyer contended that his client has completed the sentence given to him by the Supreme Court. He added that after completing the sentence Gilani was able to contest the election.

“Yusuf Raza Gilani’s disqualification ended in 2017,” said the lawyer. However, the returning officer rejected the argument and granted time to the petitioner's lawyer to submit his argument by 3pm today.
When the hearing resumed at 3pm again, the PTI leader, through his lawyer, contended that the former prime minister does not meet the criteria as defined by Article 62 and 63. He also argued that the PPP leader’s nomination papers be rejected as NAB was hearing the Toshakhana reference against him. He alleged that the former premier “abused” his powers as a PM.

“Violation of PM's oath [leads to] lifelong disqualification,” said the PTI lawyer. He said that as cases are being heard against the former prime minister he should not be allowed to contest the elections.
However, Gilani’s lawyer intervened and claimed that the case against his client was filed to carry out a media trial. He added that the PTI lawyer was only giving references of cases that were under trial. He further told the RO that if a case is under trial, it does not mean that Gilani’s nomination papers should be rejected.

The lawyer also told the RO that the sentence given to Gilani lasted less than five minutes. He quipped that he did not know that the PTI leader was "arguing the case on behalf of the National Accountability Bureau".

The RO, after hearing the arguments, reserved the verdict in the case and adjourned the hearing till 9am the next day.

 
The age factor of these senators is a grave concern. Lawmaking requires a sharp mind not an old mind. Furthermore the list speaks of capitalism unchained running wild upon Pakistanis.

KARACHI: An appeal has been filed against the acceptance of the nomination papers of Pakistan Tehrik-e-Insaf leader Faisal Vawda for the forthcoming Senate elections before the SHC election tribunal.

Appellant Qadir Khan Mandokhel submitted in the petition that the returning officer accepted PTI MNA Faisal Vawda’s nomination papers without proper appreciation of facts and law. The appellant submitted that Continued from page 1

Vawda had misdeclared about his properties, assets and dual nationality in his nomination paper at the time of the general election 2018 as such he cannot be considered to be “Sadiq and Ameen” in terms of Article 62 of the Constitution.

Mandokhel submitted that nomination papers of the PTI leader should have not been entertained as Vawda is still a MNA and sitting federal minister and he cannot apply or file his nomination form for the Senate unless he has given an application to forego his National Assembly seat and his ministerial responsibilities. The appellant submitted that his complaint against Faisal Vawda was already pending before the Election Commission and the Islamabad High Court for disqualifying him from becoming MNA due for filing a misdeclaration in nomination forms of 2018 elections. The court was requested to reject Vawda’s nomination form and disqualify him from contesting the Senate polls.

The case against Vawda is a simple open and shut issue. It can be adjudicated in half an hour. Was and is Vawda a UK citizen . He is and he knows it and the UK Home Office knows it and Imran knows it and the ECP knows it .
BUT the ECP took no action for over a year. Their excuse ,Vawda never turns up for the hearings.
Vawda's excuse is that he is establishment anointed and cannot be touched
The ECP is a player too and a tool of those that cannot be named
