Reinstatement of Pakistan's chief justice ends a crisis, but it might lead to another

Musharraf charged with treason in petition filed with SC

LAHORE: An advocate on Tuesday filed a petition with the Supreme Court charging former president Pervez Musharraf with ‘high treason’ and seeking his trial under Article 6 of the Constitution. The advocate, Zahid Hussain Malik, has also asked the court to direct the government not to allow Musharraf to ‘escape’ from the country. The petitioner’s lawyer said that Musharraf’s actions of November 3, 2007 were tantamount to subversion of the constitution as outlined in Article 6. The imposition of emergency led to the sacking of the entire superior judiciary, he said. He requested that the federal government -- through the defence secretary – be ordered to proceed against Musharraf in accordance with the provisions of Article 6 read with the High Treason Act of 1973, and also called for his trial by a courts martial under the Pakistan Army Act. He also called for punishment for those who were ‘guilty’ of collaborating with Musharraf. staff report

However, what makes him a rascal in my eyes is his track record to the elevation of CJ and his past deeds of self-benefit, nepotism and favoritism that makes him equally as corrupt as anyone else.
You are free to disagree. However, please do not call the CJ names. He is the CJ of Pakistan and this forum is on public viewing. If you really want to continue calling CJ names, please start your own blog and do whatever you like to.

Let’s get few things straight here before the discussion on the reinstatement of the CJ of Pakistan proceeds further.

As per the Article 209 [Chapter 4: General Provisions Relating to The Judicature] of [Part VII: The Judicature] of the constitution of Pakistan, only the Supreme Judicial Council of Pakistan can hear the cases of misconduct against the Judges. No other authority including the Senate and/or the President of Pakistan (Dictator or not) can dismiss a Judge let alone the Chief Justice on the basis of misconduct (that includes corruption charges as well). The President can only refer a case of misconduct to the Supreme Judicial Council of Pakistan.

On March 9 2007, President Musharraf suspended Chief Justice and referred his case to the Council on charges of corruption.

On July 20, 2007, CJ was reinstated to his position in a ruling by the thirteen-member bench of Pakistani Supreme Court which also cleared him of the misconduct reference filed against him by the President without investigating the allegations leveled against him. The ruling combined 25 constitutional petitions filed by the CJ and other interested parties, but referred most of the issues raised by the 24 petitions not filed by CJ himself to lower courts for extended adjudication. All thirteen of the sitting Justices agreed that Musharraf's action had been illegal, and ten of the thirteen ordered the reinstatement of gthe CJ and that he "shall be deemed to be holding the said office and shall always be deemed to have been so holding the same."

It is also important to note that the lawyers of Musharraf tendered an unconditional apology for submitting frivilous documents in support of the alleged charges and the Federal Government was fined Rs. 100,000.00

So, anyone who calls CJ names or accuses him publicly for corruption can be "held in contempt". Certainly the 13 Justices who heared the proceedings and the Lawyers nominated by the President were better informed than the few on this forum who let go no chance to insult the honourable CJ of Pakistan. So be careful, do discuss but within the limits of civility and law.

LOL Are you warning members that they will go to Jail if they accuse CJ?CJ was/is corrupted and opportunist.He lost my respect when took PCO Oath under Dictator Musharraf.I hope one day he rots in hell.

And you lost my respect after showing this level of defiance and ignorance. In my view, the 13 honourable Justices and the Lawyers from both the parties are more credible and informed than you are. If Mr. Pirzada and Malik Qayuum couldn't prove anything against the CJ, why should I listen to your rants.

Not the whole armed forces, civilian establishment and the trading community, but the select few black sheeps. First of all, nothing will happen; second of all, if by some miracle, these black sheeps do see the wrath of the law; this will afterall be good for the respective Institutions and for the well being of the Pakistan.

Incase you are wondering his partners in allegation are members of his party PML(Q) and institutions within the army and the government and in honesty I think all of our nation is already facing the punishment of having him in power.

You are right I AM FREE TO DISAGREE and the last time I checked we were living in a democratic Pakistan with freedom of speech rights intact! He is a mere CJ not a holy prophet that he cannot be criticized and labeled the way I feel about his character and personality. He is under the microscope just like the rest of us people.

On the other hand, you should also stop shooting your foul mouth off against Musharraf as he was the COAS of the Pakistan Army which protects our borders day in and out so the likes of you could blabber about having democracy in Pakistan.

So keep your HOLIER THAN THOU attitude to yourself and like I said before, try real hard in growing up and having a more democratic & free mindset. RESPECT IS EARNED NOT DEMANDED! and just because your feel differently about the CJ does not really mean that the rest of the world has to also tow your twisted mindset!

The difference between your language and mine is more than obvious, that is because you don’t care about law and believe in the language of force. I on the other hand, believe in civility and in the supremacy of law. There is obviously no point carrying out any more discussion with a person of your caliber. Your character at this stage seems no different then a stooge protecting the likes of maybe the 'honorable' President of Pakistan ASIF ALI ZARDARI (who actually tasked ISI and FIA cyber wing to find out who was defaming him and on Facebook he has a whole group labeled ULLU KA PATHA after him with a membership of around 45000 people) or maybe the 'honorable' party leader of MQM Altaf Hussain. Lets learn to respect these rascals at the same time we start to respect the ones down the line.

Musharafs actions regarding Chief Justice of Pakistan were illegal and against the constitution. The same was proved by the decision of 13 members full bench of SC.

President can neither sack nor stop a chief justice from working. He did that so violated the constitution.

The reference you are talking about was also not prepared properly. It was merely a document of accusations collected by a spy agency's officer and was filed as a reference which is not correct. The government in the end had to tender an apology for the same and was fined. The same was confirmed three or four days a go by Malik Qayum the then attorney general on 50 Minute at Geo Tv.

One can not question the decision of the SC this is contempt of court with six months jail sentence or a fine or both.

One can only file a review petition under the constitution and perhaps Epool should do the same if he disagrees with the verdict.

Epool, everyone is free to freely criticize any public figure. You may criticize, but if you keep using uncivil adjectives in a forum of civilized gentry, you're sooner or later bound to run out of favor and end up on everyone's ignore list.

That freedom, however, does not extend to any one of our members, as they are not the topic of discussion here.
