What's new

PTI's Azadi March 14th August 2014 l Updates and debate.

It is ill-defined because the court can't define things, I think I have made this clear earlier.

Well, let us move the discussion on lest we get sidetracked on this tangential issue, but suffice to say that in a properly working legal system of justice, it is the courts that have the responsibility to define exactly what laws relevant to each case mean, precisely and clearly.

Sir we are discussing legal system here and I think we should also know the fact that there's a difference between constitutional laws and other forms of laws. o_O It is always the court which decides what should be accepted and what should be declined.
Anyway, lets agree to disagree.

I think we should also know the fact that there's a difference between constitutional laws and other forms of laws.

What is this difference Sir? The law is the law, nothing more, nothing less. Different laws cover different areas, but their application is similarly exacting, as it should be, for ALL laws.

For example, to keep our discussion somewhat relevant to this topic, the court utterly failed to provide the standards of legality and constitutionality that it used for its order. Such confusion on part of such a senior court can only mean one of two things: either the petition is not robust, or the honorable judges are not robust.

People can draw their own conclusions.

Kohe update kar dey muje ajj ke porey din k activities
How many people attended the march and whats their future plans?
When NS will resign?
When naya pakistan with naya sohna selfless prime minister Ik will take charge?

This looser khan is only good for marches and protests and disrupting peace. When it comes to real ground work he's zero. What is his big accomplishment in his elected province KPK? Nothing.

I would even say that he's trying to hide his failures in KPK in the guise of this march. May this fitna face another failure and humiliation at the hands of Pakistani awam.

Where did I say a law is not a law, whether it's constitutional law, statutory law or any other law, a law is a law. These laws are different because they cover different areas, their application is different, their basis are different - you would charge a murderer with criminal laws not with constitutional laws. The constitutional laws per se define the framework for other laws, you simply can't make various terms synonymous to each other (of course all are laws). It is interesting to see on one hand sir you ask about differences and on other hand define differences yourself!

Well, let us move the discussion on lest we get sidetracked on this tangential issue, but suffice to say that in a properly working legal system of justice, it is the courts that have the responsibility to define exactly what laws relevant to each case mean, precisely and clearly.

The point perhaps you seem to have overlooked despite of repeated clarification is that the law in situ doesn't entitle high court to interpret and define constitution. The point in question here is the constitutionality of something not the original or appellate jurisdiction of the high court or any other court. That said the high court was not in a position to define or clarify the laws, that's the reason why the verdict we have read lacks the clarification.

There is a big difference between Pawns and Nawaz's march.
Nawaz's march was for Justice, not for Prime Ministership.
Imran's march is only for Prime Ministership.
But of course it takes a brain to understand that...

Forgive me for asking such a basic question, but isn't it the primary job of the Judiciary to interpret laws that the Legislature makes, including the Constitution, which is the Supreme Law of the Land?

When LHC says in its order that "The respondents No.4 and 5 (Pakistan Tehreek-e-Insaf P.T.I. and Pakistan Awami Tehreek P.A.T.) are restrained meanwhile from launching Azadi March, Inqlab March or holding Dharna at Islamabad, in any unconstitutional way, keeping in view the sanctity of the independence day and the current chaotic and uncertain situation prevailing in the Country", what does it actually mean?

What laws are being used as the basis for saying this, specially the underlined part? If the Honorable Court itself does not know what laws it is using to pass an order, then may be the said Court has no business hearing the case.
