NAB talks of Rs44 bn loss but fails to catch big fish
ISLAMABAD: The National Accountability Bureau (NAB) has informed the apex court in the mega corruption Ogra case that Rs44 billion have been lost through the manipulation of stocks to benefit an influential stockbroker-cum-tycoon of the Karachi Stock Exchange and others.

Like other cases of corruption involving the high and the mighty in the present set-up, NAB in this case too is playing its usual tricks - ensuring that the rulers are not touched and the blame goes to political appointees and bureaucrats.

In its report presented to the Supreme Court recently, NAB said that after the interrogation of SNGPL and SSGPL executives and the scrutiny of record it has been established that the state exchequer has lost Rs44 billion through stocks manipulation.

“The suspected beneficiaries include Lahore-based firm Mirza & Minto and a stock broker tycoon of Karachi Stock Exchange.”The report said that this matter relates to the issuance of the notification of increase in UFG (Unaccounted for Gas) from 5% to 7% for 45 days from October 15, 2010 to December 2, 2010. The matter, it is said, was minutely interrogated and members of board of both the companies (SNGPL and SSGPL) are suspected to have manipulated the bullish and bearish trends of the stock market for these particular 45 days to their own interest and to benefit the stock broker tycoon and others.

The report dated 28 September and signed by NAB chairman did not name the stock broker tycoon(s) but sources in the NAB said that a few influential brokers, a cabinet member and some key Ogra officials particularly the then chairman Tauqir Sadiq are alleged to have been hand in glove with each other in this Rs44 billion alleged fraud.

These sources said that although the apex court has not been informed, the bureau has acquired call records and email exchanges between these powerful accused, none of whom has been arrested by the Bureau as yet. These sources admit that under the present circumstances, the tamed NAB could not proceed in this case on merit and it is hard for its investigators to summon suspected powerful cabinet members and influential stock brokers, who have direct links with the top rulers.

The NAB report confirmed that irregularities were committed in the appointment of Tauqir Sadiq as chairman NAB but it did not explain the role of former Prime Minister in this highly controversial appointment. It simply says, “Replies of the approving authority and others have been received and are being scrutinised by the Prosecution Division on the basis of which further course of action will be taken.”

Like in other cases, the NAB seems to be protecting the key public office holders, who have been making such appointments despite objections raised in the media. In an earlier investigation, the NAB conveniently spared former Prime Minister Yusuf Raza Gilani in the appointment of his ‘jail days’ friend Adnan Khawaja as chairman OGDC.

The report also talks about the warrants having been issued for the arrest of Mir Kamal Mari, member Gas Ogra, on August 15, 2012 but he is said to have “fled” the country on July 15, 2012 - one month before the issuance of the warrants.

There is no mention in the report of Mari’s appearance before the NAB investigator on May 18, 2012 after which the NAB never contacted Mari, who is son of respected former governor and chief minister Blaochistan and ex-CJ BHC Justice Khuda Mux Mari.

In the absence of any summon or any call from NAB, Mari applied for ex-Pakistan leave to visit his ailing mother in Switzerland, and was allowed the same on June 29, 2012. Before he could proceed on his sanctioned leave, chairman Ogra sought NAB’s clearance. After waiting for almost two weeks and getting no reply from NAB, he proceeded on his leave but only after informing chairman Ogra about his foreign address and phone numbers. But still he is shown before the SC by the NAB to have fled.

Mari is accused to have allowed change of sites to different CNG stations. The NAB report said, “Warrant of Mir Kamal Fareed Bijrani Mari were issued on 15.8.2012 whereas he fled the country on 15.07.2012 while NAB had recommended to Ministry of Interior for placement of his name on ECL on 05.07.2012.”

The report added, “It is important to mention here that these licences (for change of sites) were issued by Mir Kamal Fareed Mari. The link of the ill-gotten money by the said Member has been established from a bank account which is jointly in the name of Mir Kamal Mari and his wife......”

The NAB has though “successfully” found Mari’s bank account containing Rs3.6 million, ignored the role of the former Prime Minister Gilani, the Prime Minister’s Secretariat and Cabinet Division in this controversial policy of change of site for CNG stations.

The Ogra documents show the PM’s Secretariat conveying to Ogra chairman in February 2010 MNA Riaz Hussain Pirzada’s request for change of existing site of his CNG station M/S Chaudhry Gas Station in relaxation of policy and directing that Ogra should formulate a “rational policy” for change of sites of the CNG stations for the existing licences.

The PM’s Secretariat and the Cabinet Division later sent reminders asking Ogra to furnish progress report. Under pressure, the politicised Ogra formulated a policy in line with the Prime Minister’s directive.

The policy was sent to the PM’s Secretariat and the Cabinet division, none of which raised any objection. Even after the introduction of this policy two members of Ogra - Syed Hadi Hasnain and Dr Ilyas Fazil - picked up the courage to refer the cases of site change to PM’s Secretariat following which they were issued warning and were snubbed for approaching the PM’s Secretariat.

A fair investigation on part of NAB in this case would unveil the real faces behind the mega scandal but it has failed as yet to catch Tauqir Sadiq, the political appointee and brother-in-law of Jehangir Badar, besides issuing warrants against Kamal Mari when he was abroad on ex-Pakistan leave. The sources said that all this is being done to save the powerful and mighty and grill the ordinary souls as has been done in other cases.

So, I am an outsider looking in. My question to you would be, that is there a proof of 'such' corruption through the world bank or the IMF? Have they cancelled aiding the Punjab gov't on some of the largest programs worth many billions of dollars?
Have they rejected future sponsorships of additional programs that the gov't of Punjab is going to undertake (some as a partner with China, Turkey and the UK and not just seeking loans)??

Why is it that the international institutes prefer dealing with Gov't of Punjab vs. the Gov't of Pakistan in YOUR opinion? The ONLY thing is that you can audit and track the flow of the money and yes, there WILL ALWAYS be corruption in any country, but it's minimum in this case. So everything is transparent. While for Islamabad....the money goes down inside this dark well and the Aliens take it or the Dogs eat it !!! Nothing is accountable through your federal gov't.

Again, I am an outsider and ONLY know the reputation based on international standing. You can probably highlight the fact that why the Punjab gov't has much better reputation than your own federal gov't and other provincial governments.

ISLAMABAD - In an apparent ‘damage control’ bid following exchange of hostile statements between NAB Chairman Admiral (retd) Fasih Bokhari and the PPP-led federal government regarding corruption, the NAB chief on Thursday, passing the buck on the Punjab government, said the province with a majority of population of the country shared more responsibility of the money lost to corruption.
An official handout issued by the NAB here on Friday said the bureau chairman had welcomed the Cabinet Committee that would verify the allegations of corruption against the government. In a telephonic call to Law Minister Farooq H Naek, he requested for an early meeting of the committee. He suggested that representatives of the Punjab government should also be asked to attend the meeting as the Punjab represented majority of the country’s population and shared 65 percent responsibility. NAB Chairman Fasih Bokhari said a few days back the country was losing Rs 7 billion to corruption daily. Addressing a press conference on Thursday, he stated that corruption figures had jumped up to Rs 10-12 billion per day.
A source in the NAB said the chairman was apologetic in the press conference, succumbing to the pressure of the cabinet meeting which severely criticised his remarks. “Now by releasing such statements, the chief is trying to appease the PPP leadership which is not happy with his remarks,” the source added.
NAB spokesman Zafar Iqbal Khan rejected the claim that the NAB had issued such a statement regarding the Punjab government to woo the federal government or under any pressure. “After the chairman highlighted the corruption money in the press conference, media, in general, and some TV talk shows, in particular, were giving an impression that the whole responsibly of the huge corruption falls on the shoulders of the federal government,” he said, adding the notion was wrong. He further said that this responsibility fell on the shoulders of the whole country and since the Punjab represented the major population of the country, more resources were utilised there and it shared more responsibility of corruption. "The figures about corruption mentioned by the NAB chairman represent the whole country,” he asserted.
Staff Reporter from Lahore adds: A spokesman of Punjab government has rejected the statement of Chairman NAB in which he stated that Punjab is responsible for 65 per cent corruption in the province, terming it unclear and ambiguous.
He said that Chairman NAB should verify against whom he is levelling this allegation.
The spokesman further said that the Chairman NAB should elaborate why he has targeted Punjab and is silent about Federal and other provincial governments working.
He said that Punjab government strongly denies any allegation of corruption against provincial government, Chief Minister Punjab, his Cabinet or the political leadership of the province and consider such statements as condemnable which creates doubts.
The spokesman stated that if Chairman NAB wants to level any allegation of corruption against Punjab government the statements of international institutions like World Bank, and Transparency International are enough to refute such charges.
He said that in the statement of Country Director World Bank Rashid Bin Masood published in all national papers on October 26, 2012 complete satisfaction was expressed over the transparent utilisation of funds and timely completion of development and welfare projects in Punjab and he had described Punjab government as a role model for other provincial governments.
Similarly, Pakistan branch of Transparency International in a letter in April 2012 termed setting up of IT labs in the province and the entire process of laptop distribution transparent, he added.
The spokesman elaborated Punjab govt’s stance that if Chairman NAB is referring to the corruption in various government departments, it is worth mentioning that Punjab government has introduced clear and well-coordinated Citizens Feedback System for its elimination and this system is proving very effective for the eradication of this menace in police, Revenue, Land Record and other government departments.
“In this system any citizen who has telephoned police emergency service or contacted the concerned department for the transfer of his land receives a telephone call or SMS message under a comprised system inquiring from him did anyone of the concerned department ask him for illegal gratification and what was the standard of service. According to the statistics of national newspapers 1500 persons daily give their feedback.”
The spokesman said that the land record computerisation project has been implemented in some districts of Punjab while it is nearing completion in other districts.
Moreover, the salaries of police employees have been substantially enhanced to root out corruption from the department, he stated.

ISLAMABAD: During Thursday’s hearing of the case pertaining to arrest orders against former chairman of the Oil and Gas Regulatory Authority (Ogra), Tauqir Sadiq, the Supreme Court was informed that Sadiq’s passports had been cancelled and instructions had been sent to the Interpol in relation with the arrest orders against him, DawnNews reported.

Counsel for the National Accountability Bureau (NAB) informed the court that Sadiq’s passports had been cancelled.

Officials from the Federal Investigations Agency (FIA) told the court that instructions had been sent to the Interpol in this regard, adding that red-warrants against the former Ogra chief could not be issued until he was declared an absconder.

Earlier this week, the NAB and police officials expressed their helplessness in arresting the former Ogra chief by the Dec 31 deadline given by the court and informed a two-judge bench hearing the case that he had escaped to Nepal.

Sadiq and three other officials of Ogra – Mansoor Ali Muzaffar, Mir Kamal Frid Bijarani Muree and Jawad Jamil – are accused of misusing authority, embezzling funds and causing Rs82 billion losses to the national exchequer by converting operating income (regular income) into non-operating income in violation of an agreement signed with the Asian Development Bank and the World Bank, relocating several CNG stations, making illegal appointments, etc. Sadiq is also said to be a close relative of Pakistan People’s Party’s Secretary General Jehangir Badar.

ISLAMABAD: The Supreme Court asked the National Accountability Bureau on Monday what action it had taken against those who were behind the escape of former chairman of the Oil and Gas Regulatory Authority Tauqir Sadiq from the country.

NAB and police officials expressed their helplessness in arresting the former Ogra chief by the Dec 31 deadline given by the court and informed a two-judge bench hearing the case that he had escaped to Nepal.

At the last hearing three days ago, Inspector General of Punjab Chaudhry Habibur Rehman informed the court that the accused had escaped to Dubai.

The court directed Additional IG of Punjab Malik Khuda Baksh to submit by Wednesday a report highlighting the whereabouts of the accused, along with airport camera and finger print records.

The Federal Investigation Agency claimed that Sadiq could not escape abroad because his name was on the exit control list (ECL).

“If he has flown to another country what action the NAB has taken against those involved in his escape,” asked Justice Jawwad S. Khawaja, a member of the bench.

He asked the NAB and police officials how Tauqir Sadiq had managed to escape abroad if his name was on the ECL and in the presence of close-circuit cameras at airports.

Tauqir Sadiq and three other officials of Ogra – Mansoor Ali Muzaffar, Mir Kamal Frid Bijarani Muree and Jawad Jamil – are accused of misusing authority, embezzling funds and causing Rs82 billion losses to the national exchequer by converting operating income (regular income) into non-operating income in violation of an agreement signed with the Asian Development Bank and the World Bank, relocating several CNG stations, making illegal appointments, etc.

FIA official Azam Khan informed the court that wife and daughter of Tauqir Sadiq had also left for Kathmandu in a PIA flight PK-268 on Dec 10. He said Sadiq’s name was put on the ECL on January 25 and he returned to the country on March 27. “FIA record shows that he has not left the country after that,” he added.

The Punjab IG said the former Ogra chief might have escaped abroad on a fake passport and a police team had been sent to Kathmandu for his arrest.

Justice Khawaja said it meant that fake passports were also being made in the country.

Justice Khilji Arif Hussain said no-one involved in the escape of Sadiq should be spared. “Everyone should be given equal treatment even if a constable, IG, adviser or minister is involved in the escape,” he said.

Tauqir Sadiq is said to be a close relative of PPP’s Secretary General Jehangir Badar. Earlier, the apex court had given a deadline of Oct 5 for the arrest of Sadiq, but NAB failed to lay its hands on the accused.

On Nov 25 last year, the court had declared the appointment of Tauqir Sadiq as Ogra chairman illegal and ordered NAB to investigate corruption cases against him and submit its findings within 45 days. The court had observed that five people were involved in the illegal appointment of Sadiq, including Prime Minister Raja Pervez Ashraf.

According to media reports, the former Ogra chief recently wrote a letter to the cabinet committee investigating NAB’s claims that the country was losing billions of rupees everyday because of corruption. He claimed that he too was made a victim of “such baseless allegations where NAB made claims that were hard to substantiate”.
