Need some Advice for CR-1/IR-1 Visa

Ok guys i need some help regarding visa issue ..So my wife is Applied CR-1 visa for me , yesterday I got a response from NVC on their website CEAC ..I am mentioning the message below .

Case FE review note :

"(My wife name) does not appear to meet the minimum income requirement to sponsor the intending immigrants for this case. The consular officer will make a decision regarding this requirement at the time of the interview. To view the current poverty guidelines, please visit https://www.uscis.gov/files/form/i-864p.pdf. In order to avoid delays, an additional Affidavit of Support Form I-864 for a joint sponsor to assist in sponsoring the intending immigrants may be submitted. If joint sponsor is used to assist in sponsoring the intended immigrants, please note that a Form I-864EZ may not be used and a Form I-864 must be submitted, if it has not been already. "


I dont have anyone who can be a joint sponsor , Please can anyone tell me what i can do , and if someone else have the same issue ? ? and what to expect in interview ?


PS , My wife work in Walmart Deli , 40 hr per week for 11.50$ per hour wage . it does make enough annually which is above US poverty guidelines for 2018 in South Carolina .

Her yearly is around $ 23920 which is kind of low...if you have some of your own income..you should attach that.

the point is to exceed the USICS poverty guidelines which according to our calculations are met, but i don't understand why they said she does not meet the income Requirement unless they calculated the income after TAX deduction which is a lot ..
and no i don't have anything which i can give her to increase assets or income .

If her income exceeds the requirements (which it looks like it does), the rejection could be based on her employment status (ie on a temp contract, or a flexible/casual contract), her evidence (tax returns, pay stubs), the period of employment (usually they look at 3-6 months minimum). They might have just made a mistake. Immigration departments are overworked, and usually packed with racists...lol

I would advice telling her hiring a competent immigration lawyer who can look at the paperwork submitted and file a proper appeal or provide other guidance.

I don't have anyone who can be a joint sponsor , all my US relatives either moves to Canada or they already sponsoring like 8-10 people so they can't sponsor anyone else . I don't understand how NVC calculated my Wife's income , when we did its more than USICS poverty line ... do they deduct tax when calculating income ?

Find a relative or friend who can be a joint sponsor(so their tax returns and associated paperwork will be needed).
Not a big issue, just the time delay will be a headache due to an already slow uscis process.

That's what i am confused about, she works more or less 40 hours a week depends on her schedule , for example this one week she worked 6 days for 8 hours each .. she is making 11.50$ per hour , and she has attached her pay stub and she don't have Tax return because its not been a year she started her job but its more like 8+ months .

A joint sponsor can be anyone who is an LPR or citizen. The income used is pre-tax for calculation. To say any more would require looking at the entire 864 as submitted, but the comment means that unless you get a joint sponsor, your visa is likely to be denied or delayed.

Oscar bhai I already knock on every Possible door in USA but no help , most of my relatives already moved to Canada and some of them are already sponsoring 8-10 people which covers their incomes, and some of them are typical Pakistani relative ( Mai America mai hun tu mera koi Rishtedar America nai a sakta mentality ) ..

That is boilerplate language, but without a joint sponsor, the chances are slim to none given the above.

A few options could be to get a better job, wait a few months and file a tax return, or have one of your wife's relatives to become a joint sponsor. A delay would be better than a denial.

Dont worry about the consular officer, but yeah you need a financial sponsor.
It’s usually the stingiest thing to ask for from anyone.
Perhaps reaching out to someone in your social media might help?
It may be a little bruising for you to ask but with the current situations with uscis higher scrutiny you might need to sound a little desperate to folks- ask your wife to pitch in too.

The reason people are hesitant is because the clause with the sponsorship is that if you end up in any sort of financial distress they end up being asked to cover for you(or at least that is what I remember it was about).

This is why i suggest getting a competent immigration lawyer involved. He will be able to look at the case and tell you exactly what the problem is, or arrange and appeal if it's being judged poorly.

Also is your wife financially responsible for anyone else? Is she living with her parents or has a place of her own? It might come into their calculation of how many people are in your "household".
