NEW DELHI: India’s chief justice said on Monday that Italy’s envoy, Daniele Mancini, who helped secure the release of two Italian marines who skipped bail while on trial in New Delhi, was not entitled to diplomatic immunity.

“A person who comes to court and gives an undertaking has no immunity,”Altamas Kabir told a hearing into the case, which has caused a diplomatic crisis between Rome and New Delhi.

The Supreme Court on Monday adjourned the Italian marines case till April 2 . The court also restrained the ambassador from leaving the country. The court said that a person who comes to court and gives an undertaking has no immunity. Italy's ambassador to New Delhi, who was ordered last week to remain in India amid a row over two Italian marines charged with murder, faces a tense hearing in the Supreme Court on Monday.

Daniele Mancini had personally negotiated the release on bail of the two marines last month, enabling them to return to Italy to vote in the country's general election.

After a year of disagreement over their fate between Rome and New Delhi, the Italian government announced last Monday that it would renege on its commitment to send the men back and they would remain at home.

Indian government has warned of "consequences" and is reviewing its ties with Italy, while the Supreme Court ordered that Mancini should remain in the country and explain himself in court on Monday.

The restraining order appeared to run contrary to international rules guaranteeing diplomats freedom of movement, but India has insisted that Mancini willingly submitted himself to the jurisdiction of its top court.

Orders were issued to Indian airports last Friday asking them to prevent Mancini from leaving if he tried to board a plane without permission.

The envoy, who signed an affidavit personally guaranteeing the return of the marines, is not expected to appear in court personally on Monday and is likely to reply either in another written statement or via his lawyers.

The marines shot dead two fishermen off India's southwestern coast in February last year when a fishing boat sailed close to the Italian oil tanker they were guarding. They say they mistook the fishermen for pirates.

Italy insists the marines should be prosecuted in their home country because the shootings involved an Italian-flagged vessel in international waters, but India says the killings took place in waters under its jurisdiction.

Relations between the two countries have also been soured by corruption allegations surrounding a $748 million deal for the purchase of 12 Italian helicopters which the Indian government is now threatening to scrap.

The hearing into the case is set to open in the Supreme Court at 10:45 am.

Stunt ? Buddy, GOI is pressed against Italy, which has information on Choppergate scandal, and if it leaks out, Congress will get a huge beating. On the other hand, there is Indian SC and opposition parties pushing the Italians to respect the Court's decision.

And by the way, why didn't they vote in Delhi I though there are ballot boxes at the embassies and foreign consular offices at the time of election?

The SC doesn't live in a vacuum. It, too, will take note of India's long term interests and find a compromise.

The issue of long term interests or geo politics does not figure in SC books, all they look for is rule of law - that's why this situation is more ****ed up because the SC is involved.

Yes.... I think it will be just symbolic one.

That SC judges need to answer, on what base they permitted these marines to go and vote in Italy, instead of they voting in there Embassy.

I just can't fathom what the Italians were thinking. They should have called back the ambassador or transferred him before this matter exploded. Did they actually think that there would be no consequences? Don't they have lawyers that they could have consulted who might have told them that there was a risk of this happening? They got 2 marines out but put their ambassador & their entire relationship with India at risk? Stupid...stupid....stupid....:hitwall:

Thats what. It actually sounds funny. I am wondering are they Sailors really or some other guys that Italy can risk their ambassador...

If the marines were not back, in any given case, the relation would have suffered anyway.
With or without the Ambassador to be in Italy.

That would be true but the angry reaction of the SC (expected & valid) increases the heat.

The highlighted part is a laughable one on the contrary Italians are proving to be stupid in this case, with their mob mentality and mischief.

Supreme court is a court which runs according to the law even Italians can argue their case there.
