what if they dont need any right or obligation being enforced. what if they want to cohabit with their free will knowing well that they dont want such right.

This goes back to two things :

(a) Does an individual have the right to act in such a manner to begin with ?

(b) Does a society has a right to have certain societal standards of propriety, conventions etc. enforced or not ?

@hinduguy yea, like when you purchase a house or DO ANYTHING important in life...You have a transaction written under the law so it is legalized and rightful with some do and donts! So why not for the most impo decision?

I would definitely enter into such contract if I am buying a bride, otherwise it will be a decision based on both person's wish.

well they should not. Why do you think nobody will want them, are human beings same as commodity?
Also how is it different from divorce (or in your case breaking the contract)
