Well this issue is getting hype UN way or ICJ way..India do not have any choice.. This is what Pakistan wanted to promote this issue on international level and on different forums ..

NEW DELHI: International Court of Justice has not confirmed the Indian reports of stay order against the Kukbhushan Yadav death sentence by Pakistan Military Court.

However ICJ confirms that India has requested for the same and to get it declared illegal order.

New Delhi has instituted proceedings in the International Court of Justice in the matter of Kulbhushan Jadhav, an Indian spy captured and sentenced to death in Pakistan earlier this year.

Jadhav alias Hussein Mubarak Patel was arrested on March 3, 2016, through a Counter-Intelligence Operation from Mashkel area of Balochistan for his involvement in espionage and sabotage actives in Pakistan.

According to a press release on Tuesday from The Hague based ICJ, India has requested the United Nations' judicial organ to provide relief "by way of immediate suspension of the sentence of death awarded to the accused".

India has contended that it was not granted consular access to Jadhav, which was in violation of the Vienna Convention on Consular Relations. India has also claimed that it learned about the death sentence by way of a press release.

Any request to International Court of Justice should be consider a stay order but it depends on the country who agrees to be a party or not, If Pakistan didn't agree and hang Kulbhushan ICJ can't do any thing just a formal condemnation nothing more.

Perhaps you are not aware of Court hierarchies.

When a case goes to a higher court, the de facto execution of a lower court's order is suspended pending affirmation from the higher court. Technically it IS a stay PROVIDED IR Pakistan accepts ICJ as a higher judicial authority.

I think IR Pakistan will simply ignore the court order.

I think IR Pakistan will simply ignore the court order.

There is no court order. Indian media to date is lying, referring to Indian request as "court's response". Pakistan has anyway decided to fight war of law vigorously if the case is taken up anyway.

But it will be a new precedence in the world where terrorists death sentences would be fought in ICJ. UN has already snubbed India, no country of the world is standing with India on Kubhushan and it would be very surprising if international judicial bench thinks self admitted terrorists have a case to be fought at global level.

We are waiting for a response from ICJ - unlike India, we do not sell lies at media.

Please reread the press release. The court has not ordered to suspend the death sentence to KJ, but its about Indian request to ICJ.

Secondly, according to principle of non-interference in International law, ICJ is not allowed to interfere in the domestic matters of a country.

But still you can try your luck. :p:
