It happens only in India:A COAS with fake encounter case pending in court

I knew some of YOU gur-gobars will come up with this excuse.....here is latest on the case.....

HC reserves judgment in Army chief case

Jammu, Nov 7: The State High Court has reserved its judgment in the alleged 2001 fake encounter case, in which Army Chief General Bikram Singh, who was then a Brigadier commanding Rashtriya Rifles in Anantnag was injured.

Justice Hasnain Masoodi reserved the judgment today after all the concerned parties concluded their arguments in the case.

Advocate General, M Ishaq Qadri completed his argument on November 1 and had sought dismissal of the case. Army counsels Karnail Singh and K S Johal had also completed their arguments and had claimed that the petition was part of a conspiracy to malign the image of Gen Bikram Singh.

The complainant's counsel, Zaffar Qureshi has also concluded his arguments. The petition had been filed by family members of a civilian, Abdullah Bhat, alleging that the encounter at Janglat Mandi, Anantnag on March 1, 2001, wasn't genuine.

The Union of India (UoI) counsel K S Johal had stated before the Bench that the litigation against the Army Chief General Bikram Singh was motivated and was filed to forestall his elevation.

"The Supreme Court has already given a clean chit to the General Bikram Singh by dismissing the petition against him. Even the Selection Committee that recommended General Singh's name for elevation as country's Army Chief had also discussed the case of Mandi encounter", said the counsel K S Johal.

The counsel submitted before the High Court, "How can Janglat Mandi encounter be fake when it has resulted in the death of a Colonel and a soldier? Besides, General Singh also sustained serious injuries in this encounter". He added that the litigation claiming that the foreign militant killed in the 2001 encounter was labourer from Kupwara is full of malafide. "Where was the petition since last 10 years and why he has approached the court after so much delay", he added while praying for dismissal of the petition.

The State Government has also taken similar view before the Court and argued that the petition had been filed to play mischief as the petitioner has approached court after prolonged delay. "The case isn't maintainable on many grounds and must be dismissed", stated Mohammad Ishaq Qadri before the Court, while substantiating his argument.

Police and Defence Ministry have already submitted their objections to the petitioners' pleas. The State Government has already adopted the version of the police in High Court.

In its objections, the Ministry of Defence has strongly denied the allegation that Janglat Mandi encounter was fake. Lieutenant Colonel Sandeep Sharma in his objection on behalf of the Ministry of Defence had denied the allegation that Lieutenant General Bikram Singh had influenced the police investigations into the encounter by hatching a conspiracy with the then SSP Anantnag and the then SHO Anantnag police station.

The petitioner, Zytoona Begum, in October 2011 had moved High Court alleging that her son, Abdullah Bhat, was killed in fake encounter in Janglat Mandi and was later identified by the Army as foreign militant Mateen Chacha.

The petitioner's counsel, during his arguments in May, had sought identification of the grave and DNA testing.
 
Aren't you flying the flag of the country, who's president has cases going on against him from supreme court of Pakistan to Switzerland??!!

Whatever happened to innocent till proven guilty?
COAS is not a politician. btw Gen. Bikram singh may be the first one to get promoted as chief of the army even after case pending against him in court.

@Topic: If the Army Chief is doing somethign that is pi$$ing off some poor enemy Pakistani into opening countless threads, then good job future Army Chief. You are doing your job 100% right if it is pi$$ing of Pakistanis.

When the armies start awarding gallantry awards for murdering innocent people, where else can one go. I do not know of any other Army Chief who had a case pending for murder against him and he is still promoted to command the Indian Army. It is indeed surprising and shameful that the Chief himself accepted the appointment without being cleared by the courts.

And offcourse COAS outranks the President?? In India president is the supreme commander of the armed forces and COAS is just chief of the army.

Well one of perks living in a free country..any one can file a case against anyone but on the plus side, we follow procedure know as treating everyone innocent of a crime, until they are proven guilty of it.

And if and when he is proven guilty, he will be removed from COAS and stripped of his award.. but until he is..he is as innocent as any other Indian.. Comprende ??

Only thing this silly petition has achieved is convince Indians that continuation of article 370 is dangerous...
PIL was dissmissed by SC not the case itself.case is still going on in HC J&K.

You don't, that is shame on how much you don't know about your adopted country ..because many of your army chiefs have went to do much worse(after they were appointed to the position.)

They have gone on to dismiss elected democratic govts and impose their own laws.

Some of them have conspired with judiciary to get the elected Prime Minister of your country executed.

Some of them have arranged for mass murders in parts of your country.

And some of them have cases filled against them but have chosen to fled your country and not return..rather than face those cases.

Would you like their names?

President is an appointed by the parliament and not the people, just like how COAS is appointed by the President(on PM's advise).
President outranks the the COAS in armed forces hierarchy.
Both President and COAS are rubber stamp guys..they have to follow Prime ministers orders(at-least in functioning democracies).

You should learn about Indian politics and federal structure before commenting on it. Your post reflects your low intellectual level. COAS in proper democratical setup like India has virtually no power, even President has more power.

not really. COAS is more active with army he commands then the president who just become active when its time to take guard of honour. COASleads the army in the battle. .president is just rubber stamp commander in chief of the army in name only.
